John Brand, Senior Management AnalystI October 5, 2005 (CC meeting of October 19, 2005) Consider Resolution Authorizing the City's FY 2005 -2006 Transportation Development Act Claim Each year the City Council is asked to approve a resolution authorizing the City Manager to submit a claim for the City's Transportation Development Act (TDA) funds. The City is required to file this claim annually in order to receive the funds. TDA revenue is generated from a 1/0 sales tax that must first be spent on transit projects. After meeting any "unmet transit needs that could be reasonably met using TDA funds," the remaining local TDA funds may be used for streets and road related purposes. If approved, the City would claim its entire $1,179,740 apportionment. DISCUSSION The funds are apportioned to the formula based on population. apportionment is $1,179,740. TDA also funds the City's share of the VISTA -East (Ventura Intercity Service Transportation Authority) regional bus. An annual $400,000 countywide contribution to Metrolink operating costs is taken "off the top" of TDA funds prior to apportioning the funds among the county jurisdictions, as are funds for the Ventura County Transportation Commission (VCTC) . After transit and other expenses are met, the remainder is available for streets and roads. Consistent with the Fiscal Year 2005 -2006 adopted budget it is proposed that $500,000 be claimed for Transit, leaving $679,740 to be claimed for Streets & Roads. In anticipation of the City's annual TDA allocation, the TDA revenue from this claim and the associated expenditure of funds were included in the FY 2005 -2006 budget. At the time of budget preparation, staff estimated that apportionment for Streets & Roads would be $681,142, as shown above, the actual amount available is $679,740, a difference of $1,402 less for Street and Roads. The claim can be considered for approval at this time, and the revenue budget adjustment will be made when the Council considers the midyear budget adjustment. STAFF RECOMMENDATION Adopt Resolution No. 2005- , authorizing the City Manager to sign the Fiscal Year 2005 -2006 TDA Claim on behalf of the City for submittal to VCTC. Attachment 000016 M:URrand \M\Moorpark \City Council \CC Agenda Staff Re[xirts \CC 2005UDA Staff Report 2005- 2006.doc RESOLUTION NO. 2005- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AUTHORIZING THE FILING OF A CLAIM FOR FISCAL YEAR 2005/2006 TRANSPORTATION DEVELOPMENT ACT FUNDS WHEREAS, the Transportation Development Act (TDA), as amended (Public Utilities Code Section 99200 et seq.), provides for the allocation of funds from the Local Transportation Fund and the State Transit Assistance Fund, for use by eligible claimants for various transportation purposes; and WHEREAS, pursuant to the provisions of the TDA, as amended, and pursuant to the applicable rules and regulations thereunder (Cal. Code of Regulations Sections 6600 et seq.), a prospective claimant wishing to receive an allocation from the Local Transportation Fund or the State Transit Assistance Fund shall file its claim with the Ventura County Transportation Commission; and WHEREAS, the City has a need for these funds for both transit and street purposes in 2005/2006; and WHEREAS, the City is eligible for an estimated amount of $1,179,740 in Transportation Development Act Funds, Article 8 monies for Fiscal Year 2005/2006. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Manager and or his designee is authorized to execute and file the City's 2005/2006 TDA Claim in the amount of $1,179,740, broken down as follows: 1. $679,740 - Local Transportation Funds Article 8a (Streets and Roads), and 2. $500,000 - Local Transportation Funds Article 8c (Transit). 0000-17 TDA Reso 2005 - Page 2 SECTION 2. The City Clerk is directed to transmit a copy of this resolution to the Ventura County Transportation Commission. SECTION 3. The City Clerk shall certify to the adoption of the resolution and shall cause a certified resolution to be filed in the book of original Resolutions.
