Ghirelli, Assistant City Attorney DATE: 12/08/2019 Regular Meeting SUBJECT: Consider Adoption on an Urgency Ordinance to Prohibit the Cultivation, Manufacturing, Testing, Storing, and Certain Sales of Industrial Hemp in the City of Moorpark, Declaring the Urgency Thereof and the Immediate Effectiveness of the Ordinance Pursuant to Government Code Section 65858, 36934 and 36937, and Making a Determination of Exemption under the California Environmental Quality Act CORRESPONDENCE RECEIVED Subsequent to the preparation of the staff report, the attached correspondence was received from members of the public. SUPPLEMENTAL From:John Novi To:City Council & City Manager Subject:Support of urgency ordinance to prohibit industrial hemp cultivation Date:Saturday, December 14, 2019 7:26:12 AM My name is John Novi and I live at 14967 Marquette Street and I wanted to provide my support of the urgency ordinance on the December 17th City Council agenda for the prohibition on the cultivation of industrial hemp in the City limits. While I am not opposed to industrial hemp all together, I do believe the odor nuisance of outdoor cultivation should require at a minimum a 1 mile buffer from residential properties. I also believe that indoor cultivation may be acceptable, if the project is conditioned to have sufficient air filtration systems to prevent odors from escaping the facility. Thank you for your consideration and, I support the urgency ordinance. -John Novi From:Barbara Loczi To:City Council & City Manager Subject:Hemp Issue Date:Wednesday, December 18, 2019 9:49:32 AM We reside in the Seranata development, immediately adjacent to the unincorporated area where there are currently 90 acres of medcinal hemp planted. The invasion of our air quality/ability to be outside or have open windows is pronounced, pervasive and unavoidable, causing us to experience breathing problems (particularly to an asthmatic condition requiring medication) and headaches. We were never informed of the proposed planting by the county, when it is well-documented that having close proximity of this crop to residential areas and schools in other Ventura County communities such as Carpenteria, has had a profound, detrimental effect on the quality of life and health of the residents and minor children in those areas. We appreciate every council member taking this issue seriously, and we appreciate their vote to enforce no less than a year moratorium on ANY planting of medicinal hemp within city limits, and to insist that the moratorium be honored by the County Agricultural Commissioner that affects any unincorporated areas immediately adjacent to Moorpark residential areas. We respectfully ask to be informed and apprised of any consideration/permitted allowance for additional planting in the Tierra Rejada site that may have preceded the actions taken by the Moorpark City Council or the Ventura County Board of Supervisors to limit such planting until such time as the health and other detrimental affects on such a decision are fully vetted and determined.
