SUBJECT: Consider a Resolution Directing the Planning Commission to Hold a
Public Hearing, and Provide a Recommendation to the City Council
on Amendments to Title 17 (Zoning) of the Moorpark Municipal Code
to Address Changes in State Law Related to Accessory Dwelling
Units
BACKGROUND/DISCUSSION
During the 2019 State legislative session, Governor Newsom signed into law several
bills related to Accessory Dwelling Units (ADU) that became effective on January 1,
2020. These include Assembly Bill Nos. 68, 671, and 881. Generally, this legislation
limits the City’s ability to impose local controls regarding the development of ADUs and
Junior ADUs. As a result, Title 17 (Zoning) of the Moorpark Municipal Code must be
updated in order to comply with State law.
Section 17.44.050 of the Municipal Code (Amendments to the General Plan, Specific
Plans, Zoning Map, and Zoning Code) establishes that the City Council must adopt a
resolution of intent in order for the Planning Commission to provide a recommendation
on an amendment to the Code. The attached resolution initiates an amendment to the
Zoning Code necessary to address inconsistencies between the current Code and State
law regarding ADUs.
If the resolution of intent is approved, staff will prepare the necessary amendments to
the Zoning Code and conduct a public hearing for a recommendation on this matter by
the Planning Commission. The Planning Commission’s recommendation and the
proposed amendments will be considered by the City Council for decision at a future
public hearing.

ENVIRONMENTAL DETERMINATION
The action by the City Council to authorize staff to prepare amendments to the Zoning
Code is considered administrative policymaking and is therefore not subject to
environmental review pursuant to Section 15378(b)(2) of the California Environmental
Quality Act (CEQA). If staff is authorized to initiate the amendments to the Zoning
Code, any potential environmental impacts associated with the amendments will be
evaluated pursuant to CEQA.
FISCAL IMPACT
Other than staff time, there are no direct fiscal impacts associated with this request.
COUNCIL GOAL COMPLIANCE
This action does not support a current strategic directive.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, DIRECTING THE PLANNING
COMMISSION TO HOLD A PUBLIC HEARING AND
PROVIDE A RECOMMENDATION TO THE CITY COUNCIL
ON AMENDMENTS TO TITLE 17 (ZONING) OF THE
MOORPARK MUNICIPAL CODE TO ADDRESS CHANGES
IN STATE LAW RELATED TO ACCESSORY DWELLING
UNITS
WHEREAS, Section 17.44.050 of the Municipal Code provides that the City
Council may initiate proceedings to consider amendments to the Zoning Ordinance by
the adoption of a resolution of intent; and
WHEREAS, the City Council wishes to initiate proceedings to consider a Zoning
Ordinance Amendment that would amend Title 17 (Zoning) of the Moorpark Municipal
Code to address changes in State law related to accessory dwelling units; and
WHEREAS, the Community Development Director has determined that the
initiation of proceedings for a Zoning Ordinance Amendment is not subject to
environmental review, pursuant to Section 15378(b)(2) of the California Environmental
Quality Act.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. ENVIRONMENTAL DETERMINATION: The City Council concurs
with the determination of the Community Development Director that the initiation of
proceedings for a Zoning Ordinance Amendment is not subject to environmental review,
pursuant to Section 15378(b)(2) of the California Environmental Quality Act.
SECTION 2. INITIATION OF PROCEEDINGS: The City Council hereby
authorizes the initiation of proceedings to consider a Zoning Ordinance Amendment that
would amend Title 17 (Zoning) of the Moorpark Municipal Code to address changes in
State law related to accessory dwelling units.
SECTION 3. DIRECTION TO PLANNING COMMISSION: The Planning
Commission is hereby directed to study, hold a public hearing, and provide a
recommendation to the City Council on this matter.

SECTION 4. CITY CLERK CERTIFICATION AND FILING: The City Clerk shall
certify to the adoption of this resolution and shall cause a certified resolution to be filed
in the book of original resolutions.
