MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Karen Vaughn, Community Development Director BY: Mackenzie Douglass, Code Compliance Technician II DATE: 02/19/2020 Regular Meeting SUBJECT: Consider a Resolution Directing the Planning Commission to Hold a Public Hearing, and Provide a Recommendation to the City Council on Amendments to Chapter 17.40 (Sign Regulations) of the Moorpark Municipal Code to Ensure Compliance with Recent Case Law Related to Municipal Sign Regulations and Align City Sign Regulations with City Council Economic Development Goals BACKGROUND/DISCUSSION Chapter 17.40 of the Moorpark Municipal Code sets forth regulations for signs throughout the City. The Chapter was most recently amended in 2010. In the decade since, new case law has identified additional limitations regarding municipal sign regulations. In 2015, the United States Supreme Court clarified when and how local agencies may regulate signage in Reed v. Town of Gilbert (576 U.S. 135 S. Ct. 2218; 192 L. Ed. 236; 2015). Generally, this ruling limits the City’s ability to impose local controls on signage when those regulations are based on content. The Court’s ruling further affirms that regulations based on time, place, manner, and construction are constitutional. As a result, Chapter 17.40 (Sign Regulations) of the Moorpark Municipal Code should be reviewed and updated in order to ensure consistency with this ruling. Additionally, portions of the existing regulations seem to conflict with the City Council’s identified goals related to Economic Development. These include various regulations that place certain commercial areas of the City at a disadvantage – particularly Downtown High Street. Item: 10.E. 355 Honorable City Council 02/19/2020 Regular Meeting Page 2 Section 17.44.050 of the Municipal Code (Amendments to the General Plan, Specific Plans, Zoning Map, and Zoning Code) establishes that the City Council must adopt a resolution of intent in order for the Planning Commission to provide a recommendation on an amendment to the Code. The attached resolution initiates an amendment to Chapter 17.40 (Sign Regulations) of the Zoning Code. If the resolution of intent is approved, staff will prepare the necessary amendments to the Zoning Code and conduct a public hearing for a recommendation on this matter by the Planning Commission. The Planning Commission’s recommendation and the proposed amendments will be considered by the City Council for decision at a future public hearing. ENVIRONMENTAL DETERMINATION The action by the City Council to authorize staff to prepare amendments to the Zoning Code is considered administrative policymaking and is therefore not subject to environmental review pursuant to Section 15378(b)(2) of the California Environmental Quality Act (CEQA). If staff is authorized to initiate the amendments to the Zoning Code, any potential environmental impacts associated with the amendments will be evaluated pursuant to CEQA. FISCAL IMPACT Other than staff time, there are no direct fiscal impacts associated with this request. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. Attachment: Draft Resolution No. 2020-____ 356 RESOLUTION NO. 2020-____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DIRECTING THE PLANNING COMMISSION TO HOLD A PUBLIC HEARING AND PROVIDE A RECOMMENDATION TO THE CITY COUNCIL ON AMENDMENTS TO CHAPTER 17.40 (SIGN REGULATIONS) OF THE MOORPARK MUNICIPAL CODE WHEREAS, Section 17.44.050 of the Municipal Code provides that the City Council may initiate proceedings to consider amendments to the Zoning Ordinance by the adoption of a resolution of intent; and WHEREAS, the City Council wishes to initiate proceedings to consider a Zoning Ordinance Amendment that would amend Chapter 17.40 (Sign Regulations) of the Moorpark Municipal Code to address changes in Federal law related to municipal sign regulations and ensure consistency of sign regulation for commercial and industrial zoning districts and consistency with the economic development goals of the City Council; and WHEREAS, the Community Development Director has determined that the initiation of proceedings for a Zoning Ordinance Amendment is not subject to environmental review, pursuant to Section 15378(b)(2) of the California Environmental Quality Act. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. ENVIRONMENTAL DETERMINATION: The City Council concurs with the determination of the Community Development Director that the initiation of proceedings for a Zoning Ordinance Amendment is not subject to environmental review, pursuant to Section 15378(b)(2) of the California Environmental Quality Act. SECTION 2. INITIATION OF PROCEEDINGS: The City Council hereby authorizes the initiation of proceedings to consider a Zoning Ordinance Amendment that would amend Chapter 17.40 (Sign Regulations) of the Moorpark Municipal Code to address changes in Federal law related to municipal sign regulations and ensure consistency of sign regulation for commercial and industrial zoning districts and consistency with the economic development goals of the City Council. SECTION 3. DIRECTION TO PLANNING COMMISSION: The Planning Commission is hereby directed to study, hold a public hearing, and provide a recommendation to the City Council on this matter. CITY CLERK CERTIFICATION AND FILING: The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
