SUBJECT: Consider a Resolution Directing the Planning Commission to Hold a
Public Hearing and Provide a Recommendation to the City Council
on Amendments to Chapter 17 (Zoning) of the Moorpark Municipal
Code and the Downtown Specific Plan for the Creation of a Mixed-
Use Overlay Zone
BACKGROUND/DISCUSSION
The City Council adopted the Downtown Specific Plan (DTSP) in 1998, which set forth
the vision for downtown and identified the potential for mixed-use development along
High Street.
On May 15, 2019, the City Council held a workshop on a proposed mixed-use
development project in downtown (High Street Station – The Daly Group) and provided
policy guidance to staff on the development of the necessary regulatory tools to
implement the DTSP mixed-use vision for High Street. Staff also discussed that a
mixed-use overlay would provide a vital tool for revitalization of other underutilized
properties as well by providing an entitlement pathways for others that may be
interested in development of mixed use projects. The Council concurred with staff
recommendation on the creation of a Mixed-Use Overlay Zone that could be applied to
commercially-zoned properties in order to allow residential uses in conjunction with a
mixed-use project.
Section 17.44.050 of the Municipal Code requires the adoption of a resolution of intent
by the City Council to proceed with amendments to the zoning code and specific plans.
Staff is seeking Council initiation of amendments to Section 17 (Zoning) for the creation
of a Mixed-Use Overlay Zone and amendments to the Downtown Specific Plan to refer
to the appropriate sections of the amended zoning code pertaining to mixed-use
regulations.

If the resolution of intent is approved, staff will prepare the necessary amendments to
the Zoning Code and DTSP, and schedule a public hearing for review and
recommendation by the Planning Commission. The Planning Commission’s
recommendation and the proposed amendments would be considered by the City
Council for decision at a future public hearing.
ENVIRONMENTAL DETERMINATION
The action by the City Council to authorize staff to prepare amendments to the Zoning
Code is considered administrative policymaking and is therefore not subject to
environmental review pursuant to Section 15378(b)(2) of the California Environmental
Quality Act (CEQA).
FISCAL IMPACT
Other than staff time, there are no direct fiscal impacts associated with this request.
COUNCIL GOAL COMPLIANCE
This action supports City Council Strategy 1, Goal 3: “Evaluate and deploy tools for
adaptive reuse of vacant and existing underutilized sites with property owners.”

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, DIRECTING THE PLANNING
COMMISSION TO HOLD A PUBLIC HEARING AND
PROVIDE A RECOMMENDATION TO THE CITY COUNCIL
ON AMENDMENTS TO CHAPTER 17 (ZONING) OF THE
MOORPARK MUNICIPAL CODE AND THE DOWNTOWN
SPECIFIC PLAN FOR THE CREATION OF A MIXED-USE
OVERLAY ZONE
WHEREAS, Section 17.44.050 of the Municipal Code provides that the City
Council may initiate proceedings to consider amendments to the Zoning Ordinance and
Specific Plans by the adoption of a resolution of intent; and
WHEREAS, the City Council wishes to initiate proceedings to consider
amendments to Chapter 17 (Zoning) of the Municipal Code in order to create a Mixed-
Use Overlay Zone; and
WHEREAS, the City Council wishes to initiate proceedings to consider
amendments to the Downtown Specific Plan in order to appropriately reference and cite
the amended Zoning Code pertaining to mixed-use regulations; and
WHEREAS, the Community Development Director has determined that the
initiation of proceedings for a Zoning Ordinance Amendment is not subject to
environmental review, pursuant to Section 15378(b)(2) of the California Environmental
Quality Act.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. ENVIRONMENTAL DETERMINATION: The City Council concurs
with the determination of the Community Development Director that the initiation of
proceedings for a Zoning Ordinance Amendment is not subject to environmental review,
pursuant to Section 15378(b)(2) of the California Environmental Quality Act.
SECTION 2. INITIATION OF PROCEEDINGS: The City Council hereby
authorizes the initiation of proceedings to consider a Zoning Ordinance Amendment that
would amend Chapter 17 (Zoning) of the Moorpark Municipal Code and a Specific Plan
Amendment to the Downtown Specific Plan in order to create the necessary regulatory
tools to enable and implement mixed-use development within the City.
SECTION 3. DIRECTION TO PLANNING COMMISSION: The Planning
Commission is hereby directed to study, hold a public hearing, and provide a
recommendation to the City Council on this matter.

SECTION 4. CITY CLERK CERTIFICATION AND FILING: The City Clerk shall
certify to the adoption of this resolution and shall cause a certified resolution to be filed
in the book of original resolutions.
