MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Jeremy Laurentowski, Parks and Recreation Director By: Jessica Sandifer, Community Services Manager DATE: 04/08/2020 Special Meeting SUBJECT: Consider Resolution Authorizing Acceptance of Landscape and Trail Maintenance Improvements Between Tract 5187 (Meridian Hills) and Tract 4928 (Country Club Estates) (Peters Driveway Trail) and Inclusion of Maintenance Expenses in Citywide Landscape and Lighting Maintenance District (Fund 2300) BACKGROUND & DISCUSSION A condition of the Development Agreement for the Meridian Hills Development was for a public multi-use trail to be constructed through the Meridian Hills project to the Country Club Estates multi-use trails. The improvements also include lighting, landscaping and drainage facilities. Upon acceptance of the improvements, the maintenance of the improvements will be turned over to the City of Moorpark. William Lyons Homes has completed construction of the multi-use trail and associated improvements from the boundary of Tract 5187 to the Country Club Estates boundary. Since the trail and landscape improvements are outside of the Meridian Hills tract boundary, they were not included within the formation documents for Landscape Maintenance District 20. For this reason, staff is recommending that the trail and landscape improvements be accepted and that maintenance costs for the improvements be included within the Citywide Landscape and Lighting Maintenance District (LLMD) (Fund 2300). The City will take over the maintenance of the improvements on April 1, 2020. FISCAL IMPACT The costs to maintain the trail and landscape improvements, including water and electricity, are estimated to be approximately $12,000 annually. The Citywide LLMD (Fund 2300) will provide funding for the maintenance of the landscape improvements. However, because the Citywide LLMD is not fully funded, the maintenance costs will increase the General Fund subsidy to the City Landscape Maintenance Districts by approximately $12,000 per year. Sufficient funds exist in the Fiscal Year 2019/20 budget and funding will be appropriated in future fiscal year budgets. Attachment: Draft Resolution No. 2020-____ 166 RESOLUTION NO. 2020-____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ACCEPTING TRAIL AND LANDSCAPE IMPROVEMENTS BETWEEN TRACT 5187 (MERIDIAN HILLS) AND TRACT 4928 (COUNTRY CLUB ESTATES) AS COMPLETE AND AUTHORIZING ASSUMPTION OF MAINTENANCE RESPONSIBILITIES AS OF APRIL 1, 2020; AND INCLUSION OF MAINTENANCE COSTS INTO CITY-WIDE LANDSCAPE AND LIGHTING MAINTENANCE DISTRICT (FUND 2300) WHEREAS, the City Council approved Residential Planned Development (RPD) 99-02 and Tract 5187 which allowed West Pointe Homes to construct the Meridian Hills housing project (“Project”) within the City of Moorpark; and WHEREAS, the Development Agreement required construction of a trail segment between the east boundaries of Tract 5187 (Meridian Hills) and Tract 4928 (Country Club Estates); and WHEREAS, subsequent to that approval, West Pointe Homes, sold the Project to William Lyon Homes in 2007, who sold the Project to ORA Ashford 94, LLC, ORA Marquis 89, LLC, and ORA Brighton 17, LLC (collectively, ORA Ashford) in 2008; and WHEREAS, pursuant to the Amended Implementation Agreement, William Lyons Homes maintained responsibility for construction of the trail segment between the east boundaries of Tract 5187 (Meridian Hills) and Tract 4928 (Country Club Estates); and WHEREAS, William Lyon Homes has completed construction of the trail and landscape improvements and is requesting that the City take over maintenance obligations for the completed improvements; and WHEREAS, in order to take over the maintenance obligations of the Improvements, the City Council must accept the improvements as complete. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City of Moorpark hereby accepts the Trail and Landscape Improvements detailed in Attachment 1 as complete pursuant to RPD 99-02 and authorizes the City to assume the responsibility to maintain such improvements, effective April 1, 2020. SECTION 2. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. 167 Resolution No. 2020-____ Page 2 PASSED AND ADOPTED this 8th day of April, 2020. __________________________________ Janice S.
