MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Karen Vaughn, Community Development Director DATE: 05/13/2020 Special Meeting SUBJECT: Consider Allowance of an Alternative Schedule for the General Plan Amendment Pre-Screening Request by Warmington Homes SUMMARY City Council has adopted specific timeframes for the review and consideration of General Plan Amendment (GPA) pre-screening requests (Resolution No. 2015-3466). A GPA pre-screening request by Warmington Homes was in process and scheduled for review by the Community and Economic Development Committee (CEDC) on March 18, 2020, which was subsequently cancelled due to the quickly evolving coronavirus pandemic and the declaration of a local health emergency. Staff is seeking approval to move this GPA pre-screening request forward off-schedule from the normal cycle dates. BACKGROUND City Council Resolution No. 2015-3466 outlines the review procedure and timeframe for GPA pre-screening requests as follows: Warmington Homes submitted a GPA pre-screening request on November 21, 2019, for properties along and near Beltramo Road. The request was scheduled for review and recommendation by the CEDC on March 18, 2020. Beginning in early March 2020, Ventura County and the City of Moorpark began monitoring the coronavirus and its impacts in the local region. Conditions changed rapidly and within a matter of days, on March 11, 2020, the Governor of California issued a Notice that all mass gatherings should be postponed or canceled to slow the spread of the virus. On March 12, 2020, Ventura County issued a Declaration of Local Health Emergency. Moorpark staff began taking preemptive actions to minimize any potential for group gatherings, including public meetings. As part of this quickly evolving effort, the March 18 CEDC meeting was canceled. The City followed shortly thereafter and on March 20, 2020 issued Executive Order No. 2020-02 cancelling all public meetings. In the intervening time, the City’s technology infrastructure has been expanded to allow for virtual public meetings. The City Council and Planning Commission have held several virtual public meetings, the format of which can be replicated for the CEDC. Should Council allow for the Warmington Homes GPA pre-screening request to move forward, staff will schedule the Item for the RegularCEDC meeting on June 17, 2020. If the CEDC moves the request forward to the full City Council, staff anticipates the Item to be scheduled for late Summer or early Fall 2020. The requested alternative schedule only pertains to the Warmington Homes request, which was impacted by emergency measures associated with COVID-19. All future GPA pre-screening requests would follow the normal cycle timeframes as established by Council. FISCAL IMPACT This action has no fiscal impact. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive, although it has the potential to lead to the creation of additional housing in the City. STAFF RECOMMENDATION Allow the General Plan Pre-Screening request by Warmington Homes to move forward to the CEDC and City Council off-schedule from the cycle timelines prescribed in Resolution No. 2015-3466. Attachment: Resolution No. 2015-3466 168 RESOLUTION NO. 2015-3466 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING THE CITY'S GENERAL PLAN AMENDMENT PRE-SCREENING APPLICATION REVIEW PROCEDURE AND RESCINDING RESOLUTION NO. 2013-3242 WHEREAS, on December 4, 2013, the City Council adopted Resolution No. 2013-3242, amending the City's General Plan Amendment Pre-Screening Application Review Procedure; and WHEREAS, the City Council wishes to amend this procedure by extending a time period for which General Plan Amendment Pre-Screening application approvals filed prior to December 4, 2013 are valid. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Resolution No. 2013-3242 is hereby rescinded. SECTION 2. PRE-SCREENING PROCEDURE: The City Council hereby amends the City's General Plan Amendment Pre-Screening Application Review Procedure as shown in Exhibit A, attached. SECTION 3. CERTIFICATION OF ADOPTION: The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. APPLICATION: An application for pre-screening must be submitted to the Community Development Department on the Universal Application form along with appropriate accompanying maps and materials required by the Community Development Department and a deposit to process the application consistent with the adopted Council resolution. Application materials may be obtained from the Community Development Department, Moorpark City Hall, 799 Moorpark Avenue, Moorpark, California, 93021 or on the City's website at www.mooroarkca.gov. SUBMITTAL CYCLES: Two application submittal cycles are established in November and May for each calendar year. Notice of the City Council Community and Economic Development Committee meetings for Pre- Screening applications shall be provided consistent with notification for public hearings required by Section 17.44.070 of the Municipal Code. The Committee recommendation regarding the requested amendment shall be forwarded to the full Council for a decision on whether or not to accept an application for amendment. A Councilmember may request in writing within 30 days of the application cycle deadline that the City Council conduct a public hearing on the General Plan Amendment Pre-Screening application without review by the Community and Economic Development Committee. Such request will be considered by the City Council within 60 days of the application cycle deadline. 170 Resolution No. 2015-3466 Page3 A duly advertised and noticed public hearing shall be held by the City Council on the pre-screening application to determine whether the Council decides to approve or deny the filing of a formal application for amendment. The City Council decision shall be made by resolution. In accordance with Section 17.44.060(0) of the Zoning Ordinance, no resubmittal of a similar application may be made for one (1) year after a denial decision. City Council approvals of General Plan Amendment Pre-Screening applications are valid for two (2) years from the date of approval, by which an application for a General Plan Amendment along with all other required applications must be filed and deemed complete, except that City Council approvals of General Plan Amendment Pre- Screening applications approved prior to December 4, 2013 are valid to March 31, 2016, by which a complete application for a General Plan Amendment along with all other required applications must be filed and deemed complete. 171 Resolution No. 2015-3466 Page 4 STATE OF CALIFORNIA COUNTY OF VENTURA CITY OF MOORPARK ) ) ) SS.
