HomeMy WebLinkAboutRES CC 2020 3919 2020 0603RESOLUTION NO. 2020-3919 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DECLARING 347 MOORPARK AVENUE TO BE SURPLUS PROPERTY IN ACCORDANCE WITH GOVERNMENT CODE SECTION 54220 ET SEQ ("SURPLUS LAND ACT") WHEREAS, in October 2005, the Redevelopment Agency of the City of Moorpark purchased the property at 347 Moorpark Avenue (Property) for road widening and future development; and WHEREAS, on February 1, 2012, the Redevelopment Agency of the City of Moorpark was dissolved, and the City of Moorpark elected to become the Successor Agency to the Redevelopment Agency of the City of Moorpark ("Successor Agency"), responsible for winding down the affairs of the Redevelopment Agency; and WHEREAS, on February 12, 2015, the Successor Agency's Long Range Property Management Plan was approved by the State Department of Finance (DOF) on which the Property was listed in the "Retain for Future Development" permissible use category; and WHEREAS, In October 2016, the City of Moorpark purchased the Property from the Successor Agency, and all proceeds from the sale were distributed to the taxing entities by the Ventura County Tax Collector; and WHEREAS, under the Surplus Property Land Act (SLA), Government Code Section 54220 -54234, as amended and clarified by AB 1486, surplus property is defined as "land owned by an agency of the state, or any local agency" as well as "sewer, water, utility, and local and regional park districts, joint powers authorities, successor agencies to former redevelopment agencies, housing authorities, and other political subdivisions of this states" shall go through a surplus property disposition process for land owned in fee simple that is declared no longer necessary for the agency's use, subject to some exemptions in the SLA; and WHEREAS, the required road widening easement has previously been granted to the City by the Redevelopment Agency, and it has been determined that there is no further need for the property for municipal uses. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Finds that the Property at 347 Moorpark Avenue is surplus property and that there is no other municipal use for the property. SECTION 2. Directing Staff to dispose of the property in accordance with Government Code Section 54220 et seq. Resolution No. 2020 -3919 Page 2 SECTION 3. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. PASSED AND ADOPTED this 3rd day of June, 2020.
