MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Jessica Sandifer, Community Services Manager DATE: 06/03/2020 Regular Meeting SUBJECT: Consider Resolution Declaring 347 Moorpark Avenue Surplus Property BACKGROUND The Redevelopment Agency of the City of Moorpark (Redevelopment Agency) acquired the property at 347 Moorpark Avenue (APN: 511-0-101-350) (Property) in October 2005 for purposes of redevelopment of the site and to provide for right-of-way for the future widening of Moorpark Avenue. The property is located on Moorpark Avenue, just south of Central Market 2, near the intersection of Third Street and Moorpark Avenue. The property and adjacent properties are zoned Neighborhood Commercial (C-1). The cost to acquire the Property was $635,747 and the cost to demolish the structure was $32,975 for a total acquisition cost of $668,722. The Redevelopment Agency used Redevelopment Tax Increment funding to purchase the property. In 2012, the Redevelopment Agency was dissolved and the City elected to become the Successor Agency to the Redevelopment Agency of the City of Moorpark (Successor Agency) and assume the responsibilities of winding down the affairs of the former Redevelopment Agency. The Property was listed on the Successor Agency’s Long- Range Property Management Plan (LRPMP) under the “Retain for Future Development” permissible use category. The LRPMP was approved by the State Department of Finance (DOF) on February 12, 2015. In October 2016, the City of Moorpark elected to purchase the Property from the Successor Agency for $255,000 using Endowment Fund monies with the intent of finding a partner to acquire and develop the Property. The City purchase of the site and distribution of the funding to the taxing entities, removed the property disposition obligation from the Successor Agency, and allowed the City to control the future disposition of the property. No sale or development activity has occurred with the Property since 2016. The City of Moorpark has hired Kosmont Real Estate Services (dba Kosmont Realty) to assist with marketing and sale of the Property to a suitable buyer/development partner. Item: 10.L. 669 Honorable City Council 06/03/2020 Regular Meeting Page 2 DISCUSSION The recent enactment of Assembly Bill (AB) 1486 on January 1, 2020, expanded and clarified specific requirements under the Surplus Land Act (SLA), Government Code Sections 54200- 54232, and now requires that “land owned by any agency of the state, or any local agency” as well as “sewer, water, utility, and local and regional park districts, joint powers authorities, successor agencies to former redevelopment agencies, housing authorities, and other political subdivisions of this states” shall go through a surplus property disposition process for land owned in fee simple that is declared no longer necessary for the agency’s use, subject to some exemptions in the SLA. In accordance with the SLA, the surplus property disposition process specifically requires the City Council to declare the Property as “surplus land” or “exempt surplus land” before it takes action to dispose of property. Once the declaration has been made, City staff needs to prepare a written “Notice of Availability” and send it to the State Department of Housing and Community Development (HCD) and all interested housing sponsors who have submitted a request for notice to HCD. Interested parties have sixty (60) days from the date of the notice to notify the City in writing of their interest to purchase the Property, and the City shall negotiate for a period of not less than ninety (90) days on the price and/or terms of the sale of the Property. If the property negotiations do not result in a sale with a prospective buyer, then the City would be able to re-market the Property to other interested parties/buyers pursuant to AB 1486. Staff has determined that, other than road widening, for which the City already has recorded an easement on the Property, there is no further municipal use for 347 Moorpark Avenue and is recommending that the City Council declare the Property as “surplus land” and complete the surplus property disposition process in accordance with the Surplus Land Act. FISCAL IMPACT There is no fiscal impact from declaring the Property as surplus property. COUNCIL GOAL COMPLIANCE This action is consistent with City Council Strategy 1, Goal 3, Objective 1 (1.3.1): “Dispose of applicable former Moorpark Redevelopment Agency owned properties.” STAFF RECOMMENDATION Adopt Resolution No. 2020-____, declaring 347 Moorpark Avenue as surplus property. Attachment: Draft Resolution No. 2020-____ 670 RESOLUTION NO. 2020-_____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DECLARING 347 MOORPARK AVENUE TO BE SURPLUS PROPERTY IN ACCORDANCE WITH GOVERNMENT CODE SECTION 54220 ET SEQ (“SURPLUS LAND ACT”) WHEREAS, in October 2005, the Redevelopment Agency of the City of Moorpark purchased the property at 347 Moorpark Avenue (Property) for road widening and future development; and WHEREAS, on February 1, 2012, the Redevelopment Agency of the City of Moorpark was dissolved, and the City of Moorpark elected to become the Successor Agency to the Redevelopment Agency of the City of Moorpark (“Successor Agency”), responsible for winding down the affairs of the Redevelopment Agency; and WHEREAS, on February 12, 2015, the Successor Agency’s Long Range Property Management Plan was approved by the State Department of Finance (DOF) on which the Property was listed in the “Retain for Future Development” permissible use category; and WHEREAS, In October 2016, the City of Moorpark purchased the Property from the Successor Agency, and all proceeds from the sale were distributed to the taxing entities by the Ventura County Tax Collector; and WHEREAS, under the Surplus Property Land Act (SLA), Government Code Section 54220 - 54234, as amended and clarified by AB 1486, surplus property is defined as “land owned by an agency of the state, or any local agency” as well as “sewer, water, utility, and local and regional park districts, joint powers authorities, successor agencies to former redevelopment agencies, housing authorities, and other political subdivisions of this states” shall go through a surplus property disposition process for land owned in fee simple that is declared no longer necessary for the agency’s use, subject to some exemptions in the SLA; and WHEREAS, the required road widening easement has previously been granted to the City by the Redevelopment Agency, and it has been determined that there is no further need for the property for municipal uses. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Finds that the Property at 347 Moorpark Avenue is surplus property and that there is no other municipal use for the property. SECTION 2. Directing Staff to dispose of the property in accordance with Government Code Section 54220 et seq. ATTACHMENT 671 Resolution No. 2020-___ Page 2 SECTION 3.
