Time Extensions on Construction of Public Improvements
This is in response to our recent discussion concerning Time
Extensions which frequently are presented to the City Council
for their review and approval.
The following is the general procedure which was in affect when
the County Publ Works Agency was handling subdivision agreements.
This procedure has appeared to work well and we have continued
its use while act as the City's ineer.
1. The initial subdivison agreements, guaranteeing the construction
of public improvements, is good for fifteen months.
2. Initial time extensions (when requested) are for a nine month
period of time. The reason for this is that the initial
fifteen months plus an additional nine months is equal to
twenty-four months or two years.
3. Anything beyond the first time extension is for a period of
twelve months.
There appears to be no maximum time extension limit according to
State law or City ordinance. This is purely a discretionary
action. As a practical matter, unless there is a public need for
the construction of the improvements, I would see no reason not
to grant a request for a time extension. Fees are paid to the
City which cover the costs administrating the time extensions.
