CITY OF MOORPARK PARKS AND RECREATION COMMISSION AGENDA REPORT TO: The Parks and Recreation Commission FROM: Jeremy Laurentowski, Parks and Recreation Director BY: Stephanie Anderson, Recreation Services Manager DATE: 10/5/20 Regular Meeting SUBJECT: Consider Revising Rules for Tennis, Pickleball, and Multiuse Court Facilities and Establishing Hours for Tennis and Pickleball Courts BACKGROUND In 2016, the Parks and Recreation Commission (Commission) made a recommendation to the City Council to convert the single tennis court at Tierra Rejada Park to four pickleball courts. This was in response to requests from Moorpark residents for pickleball courts. Since building new pickleball courts was costly and funding was not currently available, the Commission considered converting an existing tennis court to new pickleball courts. According to the Parks and Recreation Master Plan that was approved by the City Council in 2009, the City has a surplus of nine tennis courts. This was based on a population of 35,000 residents and trends in recreation at the time the report was prepared. The Commission considered all parks with tennis courts and ultimately selected the single tennis court at Tierra Rejada Park for several reasons: Mammoth Park only has a single tennis court and is the only court north of Los Angeles Avenue; the City has a Use Agreement with Moorpark Unified School District for use of the tennis courts at Arroyo Vista Community Park; Miller Park would be costly, as it would require additional fencing to convert one of the tennis courts to permanent pickleball courts. The City Council concurred with the Commission's recommendation and approved funding to convert the single tennis court at Tierra Rejada Park to four pickleball courts. The courts were completed in 2017. Since the single tennis court at Tierra Rejada Park was converted to four pickleball courts, interest in pickleball increased. In 2019, the Commission requested that staff prepare an agenda report regarding pickleball and options for more courts. This request was timely, as staff had recently received a letter and petition from Moorpark residents requesting more pickleball courts, particularly lighted pickleball courts so that individuals could play during the evening hours. The Commission again considered all Parks and Recreation Commission 10/5/20 Regular Meeting Page 2 parks with tennis courts, as funding was not available to build new pickleball courts. Ultimately, the Commission made a recommendation to the City Council to restripe the two tennis courts at Miller Park and install portable pickleball nets so that the courts could be used for both tennis and pickleball. The City Council concurred with the Commission's recommendation and approved restriping the courts at Miller Park for both tennis and pickleball. The pickleball courts at Miller Park were completed in March, 2020. DISCUSSION In response to the pickleball courts that were constructed at Tierra Rejada Park in 2017, the City Council adopted the current Rules for Tennis Courts, Pickleball Courts, and the Multiuse Court resolution (Court Rules). Since that time, the tennis courts at Miller Park have been converted to dual use courts for tennis and pickleball and the Rules and Regulations Governing City Facility Rentals resolution (Rental Rules) has been revised. Over the last several years, the pickleball courts at Tierra Rejada Park have become popular. The courts are used daily and there are frequently lines on the weekend of teams waiting to play. However, over the course of the last year, staff has received quite a few noise complaints from nearby residents, as the courts at Tierra Rejada Park are located less than 100' from several homes. Staff has spent some time at the pickleball courts at Tierra Rejada Park in order to determine the noise levels adjacent to the rear of the homes directly south of the courts. The ambient noise level in the park when the courts are not in use is between 45 and 55 decibels and increases to approximately 60 decibels with vehicular traffic on Tierra Rejada Road. Decibel readings taken on two separate occasions with either two or three courts in use resulted in an increase in the noise levels between 60 to 75 decibels when pickleball is played. This is primarily due to the fact that pickleball is played with a hard ball and paddle. Tennis on the other hand is played with a soft ball and racquet. The noise levels measured when tennis was being played was approximately 55 to 60 decibels, which is comparable to normal noise levels in the park. For comparison purposes, the decibel level of a normal conversation between two people is approximately 60 to 70 decibels. A lawn mower is approximately 90 decibels, a vacuum cleaner is 75 decibels, and a household refrigerator is approximately 55 decibels. Although the noise levels caused by pickleball at Tierra Rejada Park are generally not excessive, the noise levels tend to increase on the weekend when all four courts are in use and teams are lined up waiting to use the courts. Staff believes that the popularity of the courts and the constant 'pop' noise from the pickleball when it is hit with the paddle has made it uncomfortable for several adjacent residents. The current Court Rules lists the court hours at Tierra Rejada Park from 7:00 a.m. to sunset. Staff recommends revising the hours for the pickleball courts at Tierra Rejada Park to 8:00 a.m. to sunset. Parks and Recreation Commission 10/5/20 Regular Meeting Page 3 In order to ensure consistency between the Court Rules and Rental Rules, and to address the new dual use courts at Miller Park, and the noise concerns at Tierra Rejada Park, staff is recommending the following changes to the Court Rules resolution. It should be noted that the resolution has also been reorganized by court type rather than court location. Permitted Activities: Recently, due to the COVID-19 pandemic and resulting public health orders, certain businesses have requested use of the tennis courts for activities not normally associated with a tennis court, such as martial arts lessons. Permitted Activities has been revised to add language authorizing the City Manager to permit uses not typically intended for tennis, pickleball, and the multiuse courts. Reservations: The Rental Rules have been revised to set 25 as the attendance threshold requiring a rental permit for all parks. Previously, the threshold was 15 at all parks except Arroyo Vista Community Park. Therefore, the Reservations sections of the Court rules have all been revised to reflect that permits are required for groups of 25 or more, not 15 or more. Use of Courts: In June of this year,- the tennis courts at Miller Park were converted to dual use tennis and pickleball courts. A section for Use of Courts specific to these dual use courts has been added. This section specifies that both pickleball courts on a tennis court must be in use before play can begin on another pickleball court, as well as requiring pickleball players to put nets away at the conclusion of their play. Court Hours: Staff is recommending changing the hours for the pickleball courts at Tierra Rejada Park from 7:00 a.m. to sunset to 8:00 a.m. to sunset to mitigate early morning noise from pickleball. For consistency with how park facility hours are established for other park facilities, the hours will be removed from the court rules. Staff has prepared a separate draft resolution to formally designate tennis and pickleball court hours, consistent with Section 12.16.020, Hours of Operation. Chapter 12.16, Parks and Open Space, of the Moorpark Municipal Code states that parks and open space are closed from sunset to 6:00 a.m., unless otherwise approved by City Council, and that the City Council may by resolution approve more or less restrictive hours of operation for a specific park and for certain facilities or structures. The court hours at Miller Park will remain 7:00 a.m. to 10:00 p.m. In addition to the changes in the court hours, staff is recommending the installation of sound attenuation material on the south facing side of the pickleball court at Tierra Rejada Park to help mitigate the noise originating from the courts. There are several manufacturers that make products specifically for noise reduction on pickleball courts. The material is flexible and manufactured for outdoor use. It is delivered in pre- measured panels and can be installed by City staff by attaching it to the chain link fence Parks and Recreation Commission 10/5/20 Regular Meeting Page 4 with steel grommets. The material comes in either black or green in order to match the wind screen typically installed on the court fences. There are many factors that contribute to the success of these products, but most manufacturers claim to reduce noise levels by approximately 20 decibels within close proximity to the courts. The cost to install sound attenuation material on the pickleball court at Tierra Rejada Park is approximately $6,500. However, there is only $3,991.00 remaining in the Park Improvement fund for Zone 2 (Fund 2013), as the majority of the funding was recently used to complete the playground improvements at Country Trail Park, Glenwood Park, Campus Park, Campus Canyon Park, Miller Park, Peach Hill Park and Tierra Rejada Park. Additionally, the FY 20/21 operating budget has been significantly reduced this year due to anticipated losses in sales tax revenue due to the Covid-19 pandemic. However, there is sufficient funding in the Community Wide Park Improvement Fund (Fund 2010). Funding from Fund 2010 was utilized to build the pickleball courts at Tierra Rejada Park in 2017. As a reminder, the Park Improvement Funds are one-time money provided through development projects. The funding for this work will ultimately be determined by the City Council. STAFF RECOMMENDATIONS 1. Recommend to the City Council the Draft Rules for Tennis Courts, Pickleball Courts, and the Multiuse Court, and the Draft Tennis and Pickleball Court Hours of Operation; and 2. Recommend to the City Council the installation of sound attenuation material on the pickleball court at Tierra Rejada Park. The next party in line shall move their racquet/paddle to the next up position on the board. • Waiting individuals/groups must be present when the court becomes available. Wheelchairs and other mobility devices must have special soft sports tires and rubberized stops that will not damage the court (no urethane or dark tires). 2. PERMITTED ACTIVITIES: Only activities appropriate to a multi-use court are permitted (for example, roller hockey, basketball, lacrosse, or futsal). Any other use requires the written permission of the City Manager. 3. PROHIBITED ITEMS AND ACTIVITIES: Bicycles, skateboards, scooters, strollers, tricycles, remote controlled or motorized toys/vehicles, animals, food, and beverages(other than water in plastic containers)are NOT permitted inside the fenced area. 4. RESERVATIONS: Reservations are required for: Groups of 25 or more; regular or reoccurring activities;for-profit and fee-based activities; setting up equipment (including goals); amplified sound; and exclusive use of the court. The court must be relinquished to the waiting group on the hour. > The purpose of this court is to encourage group play. Groups of three or less using the court must relinquish it to groups of four or more immediately upon request. > If the court opens up prior to the top of the hour, players have the option of waiting to begin play precisely on the hour, or using the remaining minutes in the present hour and vacating the court at the top of the hour if another group is waiting. • Waiting individuals/groups must be present when the court becomes available. The court shall not be held while waiting for players to arrive. Priority designated playing times for specific sports challmav be established by the Parks and Recreation Director. The schedule of playing times shall be posted at the entrance to the multi-use court. During the designated playing times,the scheduled sport shall have priority use over all other activities, except permitted rentals. The City reserves the right to change the schedule at any time. SECTION 45. This resolution shall become effective on November 1,20172020. SECTION 56. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council hereby determines that the tennis courts located at Tierra Rejada Park shall be closed from sunset to 7:00 a.m. and the pickleball courts located at Tierra Rejada Park shall be closed from sunset to 8:00 a.m. SECTION 2. The City Council hereby determines that the tennis courts located at Arroyo Vista Community Park and Mammoth Highlands Park and the dual tennis/pickleball courts located at Miller Park shall be closed from 10:00 p.m. to 7:00 a.m., with the condition that between the hours of sunset and 10:00 p.m.,courts shall be closed when the lights associated with each court are off. Between sunset and 10:00 p.m., walkways and trails without lighting specifically designed for active night time use may be used only to go to or from the lighted park facility. SECTION 3. The City Manager or his/her designee may modify the hours of said tennis and pickleball courts in accordance with Section 12.16.020, Hours of operation, of Chapter 12.16, Parks and Open Space, of the MMC. SECTION 4. Notice of court hours of operation shall be posted at each facility in accordance with Section 12.16.030, Signs, of Chapter 12.16, Parks and Open Space, of the MMC. SECTION 5. This resolution shall become effective upon adoption. SECTION 6. It is my understanding that people living near the courts are complaining about the noise. 1) If this is a noise issue than you should look at Moorpark's existing ordnance, Title 17 Chapter 17.53- 17,53.070 (A)(1). In short loud noise is not permitted between 10:00PM and 7:00AM.Any policy adopted by the Commission should be consistent with other Moorpark ordnances. It doesn't make since to me that an individual can play an electronic device loudly before a time set for the start of pickleball or tennis. 2)With more individuals working at home now, some would like to exercise playing pickleball and/or tennis before they start work. I recommend that you set the time period for not playing pickleball and tennis from 10:00PM to 7:00AM. Same as the existing noise ordnance. Here are my comments. 1. The hours of operations and noise control policy should be consistent across all activities that create noise.An example is the gardeners. a. This morning(Wednesday,September 30) I was at the courts at 7:20AM. I was the first to arrive. I noticed the gardeners were working and creating a significant amount of noise around the courts. b. In my own neighborhood,the landscapers and other construction workers arrive before 7am to begin working at 7am. I personally don't think they should be allowed to start until 8am. However, Moorpark's policy states they can start at 7AM. 2. Half of the players are still working and can't play later so they start playing at 7:30 AM. I am one of the players. Changing the hours to 8AM will hinder my ability to partake in playing as I have to start working at 9AM. I live across town so I need to be done by 8:30. It's not worth playing for 30 minutes. In addition,this activity is good for my mental health as I do work from home and this is my only form of socializing and obtaining exercise, especially in this current time of Covid. No gym in Moorpark is open. 3. The residents knowingly bought houses next to the park.The park is available for the community to enjoy and come together. It's well know noise will come from parks.The community as whole should not be penalize for this. 4. Winter and Day Light Savings is coming,which will push the start time for play later due to the sunrise being later.So the next 5+months should not be an issue. It's the Spring and Summer months where people player earlier due to the available light and beating the summer heat. I recommend you change the time to Moorpark's current Noise control policy,which is 7am to 10pm.The 10pm is nonsensical as you can't play past sunset due to there not being any lights. FYI, PickleBall is the fast growing recreational sport. In the morning and late afternoon of everyday of the week,the Moorpark courts in both Tierra Rejada and Miller Park are usually occupied with people waiting to play.The tennis courts in Moorpark are rarely used by tennis players. Moorpark needs to address this growth and provide more dedicated Pickleball courts. Simi Valley,Thousand Oaks, and Camarillo all have built new courts or converted courts due to this increasing demand by the community.
