MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Jeremy Laurentowski, Parks and Recreation Director BY: Jessica Sandifer, Community Services Manager DATE: 09/02/2020 Regular Meeting SUBJECT: Consider Resolution Amending Fiscal Year 2019/20 Budget to Fund Historical Resources Consultant for Land and Water Conservation Fund Grant Application from the Community-Wide Park Improvement Fund (2010) SUMMARY A budget amendment is requested in the amount of $7,500 to hire a Historical Resources Consultant to prepare a Section 106 Historical Resources report to complete the Land and Water Conservation Fund grant application process for the Inclusive Playground Project. Costs for this work will be reimbursed by the grant. BACKGROUND On November 20, 2019, the City Council approved Tierra Rejada Park as the location for the City’s inclusive playground. After community outreach and input the consulting team designed a ‘Whimsical’ themed playground that is 100% inclusive, includes a larger playground footprint, and an expanded parking area with additional accessible parking spaces. The whimsical theme that was identified during the outreach process generally includes a fun twist on natural and architectural elements such as play houses, seating elements, flowers, trees, mushrooms, forest animals, insects, boulders, and logs, to name a few. Additionally, the playground designer has suggested the inclusion of the Moorpark apricot into the design. Item: 10.L. 481 On January 15, 2020, the City Council authorized staff to submit a Land and Water Conservation Fund (LWCF) Grant Application to help fund the project. The total cost of the project is estimated at $1.5 million and the LWCF grant would provide 50% of the costs of the playground and other park improvements as a reimbursement. The City will be required to cash flow 100% of the project. The City’s match is proposed to come from a combination of Community-wide Park Improvement Fund (2010), Art in Public Places Fund (2007). Staff will also be seeking funding from the Proposition 68 Per Capita Grant Program to offset the required match. The Per Capita Grant is a guaranteed grant program that allocates funding public agencies based on population. The City anticipates receiving $187,639 from this grant program to be used towards the Inclusive Playground project. DISCUSSION The City’s LWCF Grant Application has been moving along favorably. California State Parks (Grant Administrator) has requested that we submit the next step in the application process, which is to prepare a report as required by Section 106 of the National Historic Preservation Act of 1966 (Section 106). Since the LWCF grant is a pass thru grant from the Federal Government, Section 106 applies. Section 106 requires that agencies consider the effect of the proposed development on historical properties. The process outlined by the Grant Administrator requires that the City contract with a California Historical Resources Consultant (CHRC) to prepare the Section 106 report. The CHRC helps research and prepare the area of perceived effect, and then researches any potential historical resources that are affected by the project, perform research at the historical information research centers, and perform a physical inspection of the site. In addition, they also perform consultation with the interested Native American Tribes who have submitted notice that they would like to be consulted when federally funded projects are undertaken in our area. Staff has identified Rincon Consultants (Rincon) as the California Historical Resources consultant. Rincon is a Ventura County based company and has extensive experience in preparing Section 106 reports and extensive knowledge of historical resources in the County. The cost to hire Rincon to perform the required tasks is $7,330, based on actual time spent on the tasks. The Agreement can be signed under the Parks and Recreation Directors signing authority, however, a budget amendment is needed to fund the work. FISCAL IMPACT A budget amendment in the amount of $7,500 is requested from the Community-Wide Park Improvement Fund (2010) for this work. This work is eligible to be reimbursed by the Proposition 68 Per Capita Grant funds. 482 COUNCIL GOAL COMPLIANCE This action is consistent with City Council Strategy 5, Goal 5- Objective 3 (5.5.3) - Seek grant funding for installation of universally accessible play equipment. Attachment: Resolution No. 2020-____ 483 RESOLUTION NO. 2020-____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING THE FISCAL YEAR 2020/21 BUDGET TO APPROPRIATE $7,500 FROM COMMUNITY WIDE PARK FUND (2010) TO FUND HISTORICAL RESOURCES CONSULTANT FOR INCLUSIVE PLAYGROUND (C0063) GRANT APPLICATION WHEREAS, on June 17, 2020, the City Council adopted the Operating and Capital Improvement Budget for Fiscal Year (FY) 2020/21; and WHEREAS, a staff report has been presented to City Council requesting a budget amendment in the amount of $7,500 from the Community Wide Park Fund (2010) to fund a historical resources consultant to prepare a Section 106 report for the Land and Water Conservation Fund grant application for the Inclusive Playground project (C0063) at Tierra Rejada Park; and WHEREAS, Exhibit “A” hereof describes said budget amendment and its resultant impact to the budget line items. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. An aggregate budget amendment of $7,500 from Community Wide Park Fund (2010) to fund Historical Resources Consultant for Inclusive Playground Project at Tierra Rejada Park, as more particularly described in Exhibit A, attached hereto, is hereby approved. SECTION 2. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
