SUBJECT: Consider Resolution Establishing Parking Restrictions on South Side
of Third Street East of Moorpark Avenue to Aid School Buses
BACKGROUND AND DISCUSSION
On September 16, 2019, the Superintendent of the Moorpark Unified School District
requested that the City install a no parking zone for the first twenty-five feet of
eastbound Third Street to aid school buses turning in from Moorpark Avenue/State
Route 23. The City Manager requested that the issue be brought forward to the
Transportation and Public Works Standing Committee for consideration.
Staff learned that approximately eight buses come in between 7:45 and 8:30 a.m. and
six buses come in between 2:50 and 3:20 p.m. on school days at the Flory Academy
site. The District reported that there have been no reportable traffic collisions at this
location but that their drivers remain concerned about traffic conflicts. City staff is
concerned about safety but also receives numerous complaints about the critical
parking needs in the downtown area. On balance, City staff believes that there are
enough school bus trips each day to warrant some reduction in parking.
Staff invited District staff and the owner and tenants of the two residences that would be
directly affected by the parking restrictions to attend the meeting. The Standing
Committee convened on February 3, 2020, and heard from the attendees and staff.
Two approaches were discussed:
• First, establish a no parking zone during the times needed by the District.
• Second, if that effort does not result in a satisfactory improvement in bus turns, bring
in a traffic engineer to study Third Street school related traffic and see if all parking
should be eliminated in this area, turns out onto Moorpark Avenue should be
restricted or other changes implemented. This second step needs to be engineered
so that solving one problem does not create additional problems for the school or the
neighborhood.

A no parking sign has been purchased and can be quickly installed before in-classroom
education is restored.
The Committee took serious account of the District’s request and decided that the issue
should be heard by the Council with their recommendation for approval of the District’s
request for restricted parking.
FISCAL IMPACT
Staff estimates that the City would incur costs of approximately $100 to install a no
parking sign. Funding is available in the Public Works Department Street Maintenance
budget for the materials and labor required to do the work.
COUNCIL GOAL COMPLIANCE
This action does not support a current strategic directive.
STAFF RECOMMENDATION
Approve the District’s request to establish parking restrictions on school days for the
first twenty-five feet of curb on the south side of Third Street east of Moorpark Avenue.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, ESTABLISHING PARKING
RESTRICTIONS ON THE SOUTH SIDE OF THIRD
STREET EAST OF MOORPARK AVENUE AND
DETERMINATION THAT THIS ACTION IS EXEMPT FROM
ENVIRONMENTAL REVIEW UNDER THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT
WHEREAS, Section 22507 of the California Vehicle Code authorizes the City to
establish parking restrictions on any City street; and
WHEREAS, Section 10.04.190.N of the Moorpark Municipal Code states that no
person shall park, stop or leave standing any vehicle, trailer or camper, whether attended
or unattended, except when necessary to avoid conflict with other traffic or in compliance
with the directions of a peace officer or official traffic-control device alongside curb space
authorized for the loading and unloading of passengers of a bus engaged as a common
carrier in local transportation when indicated by sign or red paint on the curb erected or
painted by the City pursuant to a resolution of the City Council; and
WHEREAS, it is has been determined that more street width is required for
School buses to turn from Moorpark Avenue onto eastbound Third Street between 7:30
and 8:45 a.m. and 2:45 and 3:30 p.m. on school days and that a 25 foot no parking zone
on the south side of Third Street, east of Moorpark Avenue will accomplish that; and
WHEREAS, the Community Development Director has determined that this project
would qualify for a General Rule Exemption in accordance with Section 15061(b)(3) of
California Code of Regulations (CEQA Guidelines), in that there would not be a physical
change to any existing land uses in Moorpark as a result of this resolution.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. ENVIRONMENTAL DETERMINATION: The City Council concurs
with the determination of the Community Development Director that this project would
qualify for a General Rule Exemption in accordance with Section 15061(b)(3) of
California Code of Regulations (CEQA Guidelines), in that there is no possibility that the
activity in question may have a significant effect on the environment as a result of this
resolution. Based on its independent analysis and judgment of the City Council, it can be
seen with certainty that there is no possibility that establishing parking restrictions on
Third Street may have a significant impact on the physical environment. No further
environmental documentation is required.
SECTION 2. A "No Parking zone between 7:30 and 8:45 a.m. and 2:45 and 3:30
p.m. on school days” is hereby established at the following location (which is described
in Exhibit "A" attached hereto and made part hereof):
