CALIFORNIA City Council Meeting of November 18, 2020 ACTION Adopted Resolution No. 2020- 3973. (Roll Call Vote: Unanimous) BY B.Garza. A. Public Hearing to Consider a Resolution Establishing New Maximum Solid Waste Rates to be Effective January 1, 2021, and Rescinding Resolution No. 2019- 3866. Staff Recommendation: Adopt Resolution No. 2020-3973, adopting new maximum solid waste rates to be effective January 1, 2021, and Rescinding Resolution No. 2019-3866. (Staff: Mack Douglass) Item: 8.A. MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Kambiz Borhani, Finance Director BY: Mack Douglass, Program Manager DATE: 11/18/2020 Regular Meeting SUBJECT: Public Hearing to Consider a Resolution Establishing New Maximum Solid Waste Rates to be Effective January 1, 2021, and Rescinding Resolution No. 2019-3866 BACKGROUND Moorpark Municipal Code Section 8.36.350 grants the City Council the authority to establish, by resolution, a ceiling on the charges a solid waste franchisee may charge for solid waste services at the conclusion of a public hearing. At the June 6, 2018, City Council meeting, Council granted an exclusive Franchise Agreement to USA Waste of California, Inc., a subsidiary of Waste Management Holdings, Inc. (USA Waste), for the collection, management, and disposal of solid waste and recyclables within the City limits. On July 1, 2018, the new Franchise Agreement became effective, as did new maximum solid waste rates that USA Waste could charge. Subsequently, City Council amended those rates with Resolution No. 2019-3866, increasing the maximum allowable solid waste rates for 2020. DISCUSSION Prior to the July 1, 2018, rate increase, the solid waste fees had not increased since January 1, 2011, as the solid waste franchisees agreed to voluntarily defer rate increases until new agreements, or as it turned out, a new agreement, was negotiated. The Franchise Agreement allows USA Waste to request an increase in the maximum rates on or before October 1 of each year. Rate increases are allowable at an amount equal to or less than 5% per Section 5.3.1 (D) of the Franchise Agreement. Increases beyond those justified by increases in the Consumer Price Index (CPI) and Landfill Tipping Fees are considered extraordinary rate adjustments and are permissible to capture costs for services and charges for service passed down from the state or other regulatory agencies. The City received requests for extraordinary rate increases from Item: 8.A. 1 Honorable City Council 11/18/2020 Regular Meeting Page 2 USA Waste in 2018 and 2019. At this time, USA Waste is requesting only an annual adjustment based on CPI and Landfill Tipping Fee increases. No extraordinary rate increase is being sought for this cycle. For 2021, USA Waste is requesting an adjustment based on increases in Consumer Price Index (CPI) and Landfill Tipping Fees on all solid waste rates, consistent with Sections 5.3.1 (B) and (C) of the Franchise Agreement. On October 13, 2020, the US Bureau of Labor Statistics reported that the over the period between September 2019 – September 2020, the Consumer Price Index rose 1.2%. Landfill tipping fees have increased approximately 5% over 2019 rates. Sections 5.3.1 (B) and (C) of the franchise agreement cap annual rate increases at 70% of CPI increases plus 30% of Landfill Tipping Fee increases. In turn, this means that the CPI component of the proposed increase is 0.84%, while the Landfill Tipping Fee adjustment is limited to 1.50%, for a total increase of 2.34%. The proposed adjustment amounts to $0.78 per month (equivalent to 2.35%) for the standard residential solid waste service rate. The proposed commercial bin rates call for a similar increase of approximately 2.34%. If approved, these new rates would become effective January 1, 2021. This represents a significantly smaller rate adjustment than that approved by City Council Resolution No. 2019-3866, which saw an extraordinary adjustment of between 3.80% to 7.90% for residential customers and 12.72% to 18.80% for commercial customers. Table 1 illustrates a snapshot of the proposed rate increase based off of the request for increase the City received from USA Waste. All of the maximum rates being proposed are provided in Exhibit 1 of the attached resolution. Table 1: Comparison of Moorpark Current and Proposed Rates Customer Type Current Rate Proposed Rate Difference Percent Change Residential, Standard Service $34.22 $35.00 $0.78 2.35% Commercial Trash (3.0-cu. yd. bin, 1x/ week) $180.28 $184.49 $4.21 2.34% Commercial Recycling (3.0-cu. yd. bin, 1x/week) $137.37 $138.52 $0.97 0.84% It is to be expected that solid waste service rates differ between cities. For example, while Thousand Oaks has the same cart sizes as Moorpark does for residential 2 Honorable City Council 11/18/2020 Regular Meeting Page 3 standard service, (64-gallon carts for trash and recycling with a 94-gallon cart for green material), Simi Valley services include 71-gallon carts for all three categories in standard service. Nevertheless, the proposed maximum allowable rates places Moorpark $0.18 above Simi Valley and $1.73 below Thousand Oaks for standard residential service. Table 2 provides a comparison of proposed rates with those of our nearest neighboring Cities. Table 2: Comparison of Moorpark Proposed Rates to Adopted 2021 Rates at the Cities of Simi Valley and Thousand Oaks Customer Type Moorpark Proposed Rates Simi Valley Proposed Rates Thousand Oaks Proposed Rates Residential, Standard Service $35.00 $34.82 $36.73 Commercial Trash (3.0-cu. yd. bin, 1x/ week) $184.49 $167.38 $180.30 Public Resources Code (PRC) Section 40059 grants the City broad authority over solid waste collection, including “level of services, charges and fees”. PRC 40059 also grants the City the authority to set the “terms and conditions” for the provision of solid waste handling services. The City Council may adopt maximum allowable rates to which the franchised waste hauler is subject, even though the City is not a rate regulator and does not set rates. FISCAL IMPACT The increase in solid waste fees will have a minimal, positive impact on the General Fund. By increasing the solid waste rates, the City will also see an increase in the franchise fees paid by USA Waste to the City. The residential franchise fees are 6% and the commercial franchise fees are 16% of gross receipts generated by USA Waste for solid waste service in Moorpark. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. STAFF RECOMMENDATION Adopt Resolution No. 2020-____, adopting new maximum solid waste rates to be effective January 1, 2021, and rescinding Resolution No. 2019-3866.
