MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Jeremy Laurentowski, Parks and Recreation Director BY: Jessica Sandifer, Community Services Manager DATE: 12/16/2020 Regular Meeting SUBJECT: Consider Resolution Authorizing Submittal of Per Capita Grant Application for Inclusive Playground Project BACKGROUND On November 20, 2019, the City Council approved Tierra Rejada Park as the location for the City’s inclusive playground. The existing playground equipment will be removed and the location will be expanded for the new inclusive playground equipment design. In conjunction with the City Council’s action, Architerra, Inc. was selected as the landscape architect to help design the playground and Landscape Structures, Inc. was recommended as the playground equipment vendor. In January 2020, the City Council authorized staff to apply for a Land and Water Conservation Fund (LWCF) grant to offset the cost of the inclusive playground. The LWCF grant will cover 50% of the total project cost, which is currently estimated at $1,551,500. DISCUSSION In 2018, the State of California invested in the largest grant funding for critically underserved communities with the passage of Proposition 68: California Drought, Water, Parks, Climate, Coastal Protection, and Outdoor Access for All Act. The Per Capita Grant is a non-competitive grant program that provides funding to local government agencies to support the rehabilitation, creation and improvement of local parks and to address deficiencies in neighborhoods lacking access to outdoor recreation facilities. Sixty percent of the general Per Capita funds are allocated to cities and eligible districts (other than regional park districts, regional park and open-space districts, and regional open-space districts) based on population. Per Capita projects not serving a “severely disadvantaged community” (median household income less than 60 percent of the statewide average) require a 20 percent match. Item: 10.H. 141 Honorable City Council 12/16/2020 Regular Meeting Page 2 Staff is requesting authorization to submit a Proposition 68 Per Capita Grant application for the Inclusive Playground project. Under the State’s allocation formula, Moorpark is eligible to receive $187,639. Moorpark is not a disadvantaged community under the grant program, therefore a 20 percent match is required. Since the Land and Water Conservation Fund grant already requires match funding, no additional match funding will need to be provided for the Per Capita grant. Applying the Per Capita Grant funds to the Inclusive Playground project reduces the City’s out-of-pocket expenses. Like the LWCF grant, the Per Capita grant is a reimbursement grant, which means the City will fund the entire project and be reimbursed by the grant funding. FISCAL IMPACT There is no fiscal impact from submitting the grant application. As mentioned above, the total project cost for the Inclusive Playground project is $1,551,500. The LWCF grant will supply 50 percent of the cost of the project ($775,750). The Per Capita Grant will cover $187,639. The City’s out of pocket costs for the Inclusive Playground project will total $588,111. The funding for the project will come from a combination of the Art in Public Places Fund (2007) ($300,000), due to the custom art component of the playground structure, and the Community-wide Park Development Fund (2010) ($288,111). No General Fund monies are proposed to be spent on this project. COUNCIL GOAL COMPLIANCE This action is consistent with City Council Strategy 5, Goal 5- Objective 3 (5.5.3): “Seek grant funding for installation of universally accessible play equipment.” STAFF RECOMMENDATION Adopt Resolution No. 2020-_____ authorizing submittal of Proposition 68 Per Capita Grant funding and authorize the City Manager to sign all grant related paperwork. Attachment: Draft Resolution No. 2020-____ 142 RESOLUTION NO. 2020-_____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING APPLICATION FOR PER CAPITA GRANT FUNDS FOR INCLUSIVE PLAYGROUND PROJECT AT TIERRA REJADA PARK WHEREAS, the State Department of Parks and Recreation has been delegated the responsibility by the Legislature of the State of California for the administration of the Per Capita Grant Program, setting up necessary procedures governing application(s); and WHEREAS, said procedures established by the State Department of Parks and Recreation require the grantee’s Governing Body to certify by resolution the approval of project application(s) before submission of said applications to the State; and WHEREAS, the grantee will enter into a contract(s) with the State of California to complete project. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Approves the filing of project application(s) for Per Capita program grant project. SECTION 2. Certifies that said grantee has or will have available, prior to commencement of project work utilizing Per Capita funding, sufficient funds to complete the project. SECTION 3. Certifies that the grantee has or will have sufficient funds to operate and maintain the project. SECTION 4. Certifies that all projects proposed will be consistent with the park and recreation element of the City of Moorpark general or recreation plan (PRC § 80063(a)). SECTION 5. Certifies that these funds will be used to supplement, not supplant, local revenues in existence as of June 5, 2018 (PRC § 80062(d)). SECTION 6. Certifies that it will comply with the provisions of § 1771.5 of the State Labor Code. SECTION 7. (PRC § 80001(b)(8)(A-G)) To the extent practicable, as identified in the “Presidential Memorandum--Promoting Diversity and Inclusion in Our National Parks, National Forests, and Other Public Lands and Waters,” dated January 12, 2017, the GRANTEE will consider a range of actions that include, but are not limited to, the following: ATTACHMENT 143 Resolution No. 2020-_____ Page 2 (A) Conducting active outreach to diverse populations, particularly minority, low-income, and disabled populations and tribal communities, to increase awareness within those communities and the public generally about specific programs and opportunities. (B) Mentoring new environmental, outdoor recreation, and conservation leaders to increase diverse representation across these areas. (C) Creating new partnerships with state, local, tribal, private, and nonprofit organizations to expand access for diverse populations. (D) Identifying and implementing improvements to existing programs to increase visitation and access by diverse populations, particularly minority, low- income, and disabled populations and tribal communities. (E) Expanding the use of multilingual and culturally appropriate materials in public communications and educational strategies, including through social media strategies, as appropriate, that target diverse populations. (F) Developing or expanding coordinated efforts to promote youth engagement and empowerment, including fostering new partnerships with diversity-serving and youth-serving organizations, urban areas, and programs. (G) Identifying possible staff liaisons to diverse populations. SECTION 8. Agrees that to the extent practicable, the project(s) will provide workforce education and training, contractor and job opportunities for disadvantaged communities (PRC § 80001(b)(5)). SECTION 9. Certifies that the grantee shall not reduce the amount of funding otherwise available to be spent on parks or other projects eligible for funds under this division in its jurisdiction. A one-time allocation of other funding that has been expended for parks or other projects, but which is not available on an ongoing basis, shall not be considered when calculating a recipient’s annual expenditures. (PRC § 80062(d)). SECTION 10. Certifies that the grantee has reviewed, understands, and agrees to the General Provisions contained in the contract shown in the Procedural Guide. SECTION 11. Delegates the authority to the CITY MANAGER, or designee to conduct all negotiations, sign and submit all documents, including, but not limited to applications, agreements, amendments, and payment requests, which may be necessary for the completion of the grant scope. SECTION 12. Agrees to comply with all applicable federal, state and local laws, ordinances, rules, regulations and guidelines. 144 Resolution No. 2020-_____ Page 3 SECTION 13. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
