MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Karen Vaughn, Interim Deputy City Manager DATE: 02/03/2021 Regular Meeting SUBJECT: Consider a Resolution to Suspend the Processing of General Plan Amendment Pre-Screening Requests during the Comprehensive General Plan Update and Consider a Resolution to Allow an Expedited Schedule for a Revised General Plan Amendment Pre- Screening Request by Warmington Homes SUMMARY The City is currently in the midst of a comprehensive General Plan Update that will, among other things, consider future land use designations of all property within the City. The General Plan Update is a considerable undertaking being led by staff, PlaceWorks (City consultant), the General Plan Advisory Committee (GPAC), and the public. After the adoption of a vision statement (Item 9.A. on tonight’s agenda), the next steps in the General Plan Update will be the identification of opportunity sites for future development, consideration of a Preferred Land Use Map, and preparation of the draft Housing and Land Use Elements. As we move into these discussions with the GPAC, Planning Commission, City Council and the public, it will become increasingly difficult to concurrently process General Plan Amendment requests by private parties while maintaining the integrity of the community-based General Plan that we are striving to create. Staff is, therefore, seeking Council direction on whether to continue to accept GPA pre-screening applications during the General Plan Update. Additionally, per City Council direction on January 6, 2021, staff has prepared an alternative schedule to allow the Warmington Homes GPA pre-screening request to move forward for consideration. DISCUSSION Acceptance of GPA Pre-screening Applications during General Plan Update: The General Plan serves as the principal policy document guiding community growth and the provision of public services within the City of Moorpark. The Plan is defined by a community vision for the future, and goals and policies meant to help achieve that Item: 9.B. 266 Honorable City Council 02/03/2021 Regular Meeting Page 2 vision. On January 15, 2020, City Council approved budget appropriation and a contract with PlaceWorks Inc. to begin the process of developing a comprehensive General Plan Update and associated program environmental impact report (EIR). On September 2, 2020, City Council appointed the GPAC as a citizen body to act as a conduit with the public and provide policy guidance throughout the General Plan Update process. To date, the GPAC has held four meetings and discussed topics including community outreach strategies, review of existing conditions, and development of a draft vision statement. On November 19, 2020, the City also hosted a virtual community visioning session to both gather input from the community and confirm community vision ideals developed by the GPAC. The comprehensive General Plan Update is well underway, with next steps focused on land use and housing. The GPAC will soon consider opportunity sites for future housing and development/redevelopment as well as a preferred land use plan to assign proposed land use designations to all properties within the City. Land Use and Housing are two of the most critical elements of a General Plan. This work will require significant efforts of staff, our consultants, the GPAC, Planning Commission and the Council. In past years, our City General Plan has been amended per individual requests by private parties including developers, investors and property owners. With the General Plan Update underway, we are setting forth on a path where the community will determine future land uses in a cohesive and comprehensive way. Processing of GPA pre-screening requests during this time would draw staff resources away from the General Plan Update effort and require the concurrent duplication of efforts to determine appropriate land uses, densities and intensities of use. It would also set the Council in a position to consider land use changes outside of community discussions on the same topics. Staff is recommending that the GPA pre-screening process be suspended and no new GPA pre-screening requests be considered until a new Land Use Element is adopted by the City Council. Private parties would be encouraged to participate in the community discussions as part of the General Plan Update. Warmington Homes General Plan Amendment Pre-screen Application No. 2019-02: City Council initiation is required for all GPA’s because they are legislative actions. Approval of the initiation through the GPA pre-screening process is a prerequisite for filing a formal entitlement application for a change of land use. The purpose of the GPA pre-screening is to consider whether the proposed use and density/intensity are appropriate at the location. Because it is a policy decision, the Council has broad discretion to consider whether the proposal would help the City achieve various General Plan goals, City Council strategic goals, other community benefits, or cause community impacts. 267 Honorable City Council 02/03/2021 Regular Meeting Page 3 The GPA pre-screening process is outlined in City Council Resolution No. 2015-3466 (Attachment 1). The process includes two cycles per year for the Community and Economic Development Committee (CEDC) and the City Council to consider GPA requests. On November 21, 2019, Warmington Homes submitted a GPA Pre-screening request for property located on Los Angeles Avenue, referred to as Beltramo Ranch. The request was originally scheduled to be considered by the CEDC on March 18, 2020 but was delayed due to the emerging COVID-19 pandemic and closure of City Hall. On May 13, 2020, Council allowed the request to continue forward off-cycle. The GPA request was reviewed by the CEDC on June 24, 2020, and a modified request on September 16, 2020. At that time, the CEDC recommended denial of the request to the City Council. On January 6, 2021, the GPA Pre-screening request was considered by the full City Council. At that hearing, the Council voted 5-0 to deny the request as presented (Attachment 2), but to allow Warmington Homes to bring forward a further modified request in an expedited manner outside of the prescribed cycle timeframes. As noted above, a comprehensive update to the City’s General Plan is currently underway. A community workshop on Land Use is tentatively planned sometime in February or March. Further, the GPAC’s tentative schedule for spring 2021 is as follows: • February 2021: Opportunity Sites • March 2021: Housing and Land Use • April 2021: Land Use In order to consider the Warmington Homes GPA request ahead of the imminent land use discussions that will be occurring as part of the General Plan Update, staff recommends that Warmington be allowed to submit their revised request for staff analysis and consideration by the full City Council. Thus, staff recommends the following alternative schedule: A. Submission of revised GPA pre-screen request and associated plans by February 17, 2021. B. City Council consideration on March 17, 2021. ENVIRONMENTAL DETERMINATION Amendments to processes are not considered a project that would be subject to the California Environmental Quality Act and, therefore, no analysis is required. 268 Honorable City Council 02/03/2021 Regular Meeting Page 4 FISCAL IMPACT There are no fiscal impacts associated with this request. The legislative action of this request is not considered a Project, as defined by CEQA Section 15378 and would have no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. ENVIRONMENTAL DOCUMENTATION: The City Council concurs with the determination that action on a General Plan Amendment Pre Screening application is not a project subject to the California Environmental Quality Act. SECTION 2. REJECTION OF GENERAL PLAN AMENDMENT REQ UEST: Staff is hereby authorized to reject for review a General Plan Amendment Request No. 2019-02. In accordance with Section 17.44.060(0) of the Zoning Ordinance, no resubmittal of a similar application may be made for one (1) year after a denial decision. SECTION 3. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. KyS� (seal) 276 ATTACHMENT 3 RESOLUTION NO. 2021-____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, SUSPENDING THE GENERAL PLAN AMENDMENT PRE-SCREENING PROCESS AND DIRECTING STAFF NOT TO ACCEPT NEW GENERAL PLAN AMENDMENT PRE-SCREENING REQUESTS UNTIL A NEW GENERAL PLAN LAND USE ELEMENT IS ADOPTED WHEREAS, on December 16, 2015, the City Council adopted Resolution No. 2015-3466 outlining the General Plan Amendment Pre-Screening Process; and WHEREAS, on January 15, 2020, the City Council approved budget appropriation and a contract with PlaceWorks Inc. to prepare a comprehensive update to the City’s General Plan and an associated program environmental impact report (EIR); and WHEREAS, on September 2, 2020, the City Council appointed the General Plan Advisory Committee (GPAC) as a citizen body to act as a conduit with the public and provide policy guidance throughout the comprehensive General Plan Update; and WHEREAS, the GPAC and community will soon begin discussions on development opportunity sites, housing and land use; and WHEREAS, to maintain the community-based integrity of the General Plan Update effort and eliminate the duplication of efforts that would be needed to process concurrent General Plan Amendment Pre-Screening requests; and WHEREAS, the Community Development Department has determined that the temporary suspension of the General Plan Amendment Pre-Screening process is not a project subject to the California Environmental Quality Act (CEQA). Suspension of this process would not have the potential to create adverse impacts to the environment. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council, based on its own independent analysis and judgment, concurs with the Community Development Director’s determination that the temporary suspension of the General Plan Amendment Pre-Screening process is not a project subject to CEQA. No environmental analysis of this action is required. SECTION 2. The City Council hereby suspends the General Plan Amendment Pre-Screening process outlined in City Council Resolution No. 2015-3466 and directs staff to not accept any new General Plan Amendment Pre-Screening requests until a new General Plan Land Use Element is adopted by the City Council. 277 Resolution No. 2021-____ Page 2 SECTION 3. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book or original resolutions. Parvin, Mayor ATTEST: Ky Spangler, City Clerk 278 ATTACHMENT 4 RESOLUTION NO. 2021-____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ALLOWING A REVISED GENERAL PLAN AMENDMENT REQUEST FOR THE PROPOSED BELTRAMO RANCH PROJECT TO PROCEED ALONG AN EXPEDITED PROCESSING TIMELINE WHEREAS, on December 16, 2015, the City Council adopted Resolution No. 2015-3466 outlining the General Plan Amendment Pre-Screening Process; and WHEREAS, on January 6, 2021, the City Council considered the agenda report and supplements thereto, written public comments, and Community and Economic Development Committee recommendation; opened the public hearing and took and considered public testimony; closed the public hearing and voted 5-0 to adopt Resolution No. 2021-3983 to deny the application for General Plan Amendment Request No. 2019-02 as presented; and WHEREAS, on January 6, 2021, upon denying the General Plan Amendment Request, the City Council moved to allow Warmington Homes (Applicant) to submit a revised General Plan Amendment Request for expedited processing; and WHEREAS, efforts are currently underway for a comprehensive update to the City’s General Plan and community discussions regarding development opportunity sites, housing and land use will begin in spring 2021; and WHEREAS, an expedited review and processing schedule is necessary to consider the revised General Plan Amendment Request by Warmington Homes ahead of the community-wide General Plan land use discussions. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council approves an expedited review schedule for a revised General Plan Amendment Request by Warmington Homes for the proposed Beltramo Ranch project, outside of the process outlined in City Council Resolution No. 2015-3466, as follows: A. Submission of revised GPA pre-screen request and associated plans by February 17, 2021. B. City Council consideration on March 17, 2021. 279 Resolution No. 2021-____ Page 2 SECTION 2.
