MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Brian Chong, Assistant to the City Manager DATE: 02/03/2021 Regular Meeting SUBJECT: Consider a Resolution Adopting a Unified Schedule of Fees and Service Charges and Direction to Staff to Initiate a Comprehensive Fee Study BACKGROUND Since incorporation, the City Council has adopted numerous resolutions establishing and updating various fees and service charges. These cover such items as permits, park and facility rentals, business registrations, and even photocopies. The City currently has dozens of active fee resolutions, resulting in an unwieldy experience for customers trying to identify and calculate fees that may apply to their situation. To remedy this and allow for easier administration of the City’s various fees and service charges, staff recommends that the City Council adopt a unified Schedule of Fees and Service Charges so customers can see all City fees and service charges in a single document. No fees are proposed to be changed, added or amended as part of this adoption; rather, the purpose is to compile all fees and service charges in a single document. In general, fees and service charges are calculated so that the City can recover the costs of providing a municipal service. The City has not recently conducted a comprehensive review of all of its fees and charges, instead occasionally adopting them piecemeal. As a result, the City currently has fees for obsolete services (for example, the City no longer needs a charge for printing/mailing City Council agendas because they are distributed for free by E-mail) and does not have fees for various items (such as a citywide traffic impact fee), but rather collects fees based on Areas of Contribution. To purge unneeded fees, calibrate current fees to ensure they do not undercharge or overcharge the costs to provide associated municipal services, and to develop new fees, staff recommends that the City Council direct staff to initiate a comprehensive study of the City’s fees and service charges at this time. Item: 10.B. 316 Honorable City Council 02/03/2021 Regular Meeting Page 2 DISCUSSION Unified Schedule of Fees and Service Charges The attached resolution would adopt a unified Schedule of Fees and Service Charges consistent with the City Council’s previously-adopted fee resolutions. No new fees are added or edited by unifying the resolutions into a single document. Any new future fees, or adjustments to existing fees, would need to be adopted by the City Council via a future resolution and may, depending on the type of fee or service charge, be subject to a public hearing. However, the proposed Unified Fee Schedule does incorporate a correction to one typographical error in the Building & Safety fee for sign permits. Signs may or may not include electrical/lighting components, and Resolution No. 2010-2971 contained an additional $18.20 charge for signs with electrical/lighting components to cover the costs of a simple plan check and inspection for those components. However, the line was mistyped into the “no electrical” line of the resolution. In practice, City staff has been collecting the electrical fee only for signs with electrical/lighting and will continue to do so. However, the proposed unified Schedule of Fees and Service Charges correctly displays this fee. Comprehensive Fee Study The City can receive several benefits from retaining a consultant to complete a comprehensive fee study. 1) Ensure Fees/Charges Match Cost to Provide Services: Fees and charges should be based on the costs of providing the associated services, typically calculated by identifying the number of staff hours needed to provide a service and then multiplying those hours by the City’s hourly cost to employ those staff members (salaries, benefits, and overhead). In the case of a service provided by a City contractor, then those costs would be passed through to customers. As technology advances, regulations are added or amended, and procedures change, the number of hours needed to provide a specific service change over time. Completing a comprehensive fee study would recalibrate charges to match the costs of providing them. 2) Add New Fees: A Fee Study consultant can help identify and calculate fees for services that are not currently in the City’s Fee Schedule. For example, the City does not have an adopted fee for permitting and inspecting an electric vehicle charger (in which case the City’s Building Official applies a similar adopted fee). A consultant could help calculate such a fee and identify fees that are frequently part of other jurisdictions’ fee schedules. 317 Honorable City Council 02/03/2021 Regular Meeting Page 3 3) Purge Obsolete Fees: The City has fees for a number of obsolete services that, in practice, it no longer provides. For example, the City has a fee for mailing all City Council agendas to a requester for $30.00 per year. However, this process has been replaced by a free E-mail subscription service to receive all City Council agendas, and the fee is no longer needed. 4) Calculate Development Impact Fees: Currently, the City does not have officially adopted impact fees for developments. In practice, developers of large-scale projects are typically required by the Zoning Ordinance to enter into Development Agreements with the City, which typically include development impact fees for community impacts such as traffic. When the City’s comprehensive General Plan Update is completed, the need for General Plan Amendments and Development Agreements will largely disappear. To ensure that the City continues to be able to collect development impact fees at that time, the City will need to formally adopt development impact fees. The work generally consists of completion of a nexus study identifying all of the projects needed at the City’s buildout in a particular category (such as transportation infrastructure), determining the cumulative costs of those projects, and then distributing those costs against all future development in the City. Impact fees are then collected when buildings are constructed, typically on either a per-unit basis (residential) or a per-square foot basis (non-residential) and then aggregated to complete specific projects (such as road widening or a new signal). The December 2019 Community Development Organizational Audit prepared by Management Partners recommended that the City complete a nexus study to determine the infrastructure and improvements required to serve new development, and then subsequently adopt impact fees based on that nexus study (Recommendations 3 and 4). 5) Cost Allocation Plan Update: The City’s Cost Allocation Plan calculates the distribution of general governmental and support service costs of an organization across its various municipal operations. For example, the City’s Human Resources Division provides general support to all City staff across all operations, and the Cost Allocation Plan would distribute the General Fund costs of the Human Resources operations to the General Fund, Public Works Funds, Community Development Funds, etc. The City’s Cost Allocation Plan has not been comprehensively updated in many years, and some consultants who specialize in fee studies also specialize in cost allocation plan analysis. As such, staff recommends that any Request for Proposals for a comprehensive fee study also include an optional proposal for an update to the City’s Cost Allocation Plan. Upon receiving costs and qualifications from proposers, the City Council can then decide to include or not include it as part of an awarded contract. 318 Honorable City Council 02/03/2021 Regular Meeting Page 4 The City’s adopted Fiscal Year 2020/21 Annual Budget does not include funding for a comprehensive fee study or an update to the City’s Cost Allocation Plan. If the City Council directs staff to prepare a Request for Proposals for a comprehensive fee study or an update to the City’s Cost Allocation Plan, then staff will bring a funding plan for the City Council’s consideration at such time as an award of contract is considered. FISCAL IMPACT There is no fiscal impact associated with adopting a unified Schedule of Fees and Service Charges or releasing a Request for Proposals for a comprehensive fee study or cost allocation plan update. Staff estimates that the costs would be in the tens of thousands of dollars, and an exact figure would be provided following the Request for Proposals process depending on responses received. Costs would likely be offset by recalibrating fees to reflect the current costs of providing services. COUNCIL GOAL COMPLIANCE This action is consistent with City Council Strategy 6, Goal 2 (6.2): “Identify and deploy feasible revenue enhancement strategies.” STAFF RECOMMENDATION 1.
