Consider Authorization for Recordation of the Notice of Completion for the Metrolink South Parking Lot South Entry Project and Release of Bonds in Accordance with the Contract. Staff Recommendation: 1) Authorize the City Clerk to file the Notice of Completion; and 2) Authorize release of the Performance Bond (Number CMGP0002895) and Payment Bond (Number CMGP0002895) as outlined in the Agenda Report. MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Shaun Kroes, Program Manager DATE: 02/03/2021 Regular Meeting SUBJECT: Consider Authorization for Recordation of the Notice of Completion for the Metrolink South Parking Lot South Entry Project and Release of Bonds in Accordance with the Contract BACKGROUND & DISCUSSION On December 18, 2019, the City Council awarded the Metrolink South Parking Lot South Entry Project (Project) to United Construction & Landscape Inc. (United) for $318,000, plus a contingency of $31,800, for a total contract value of $349,800.00. There were four change orders issued for the project with a net increase of $16,135.35. The Change Orders and their individual costs are itemized below: Change Order # Description Cost/(Credit) Change Order #1 Costs for changing the planned installation of an irrigation mainline and point of connection from the south side of the existing driveway to the north side of the existing driveway, tree and shrub removal, and septic tank abandonment. Total Costs: $15,708.06. Credits for removal of original bid item of irrigation mainline work. Total Credits: $15,000.00 $ 708.06 Change Order #2 Costs for additional rounded corners (two) on the concrete pedestrian crossing between the pedestrian crossing and greenscape area. $ 651.45 Change Order #3 Costs for replacing existing concrete curb and form a new concrete curb between an existing catch basin and new crosswalk; remove and replace approximately 1,600 square feet at the new driveway intersection; additional grinding of asphalt on 1st Street; and add a new asphalt curb by existing catch basin. $ 12,184.43 Change Order #4 Costs for a topographic survey of new intersection and repainting of a stop legend on Moorpark Avenue common wire replacement. $ 2,591.41 Change Order Total: $ 16,135.35 Item: 10.H. 626 Honorable City Council 02/03/2021 Regular Meeting Page 2 The final contract cost is $334,135.35, as broken down below: Initial Contract Cost 318,000.00$ Contingency/Change Order Items 16,135.35$ TOTAL CONTRACT COST 334,135.35$ Staff is recommending that the City Council authorize the recordation of the Notice of Completion. With the City Council’s authorization to record the Notice of Completion, the project bonds will be released as follows: • Performance Bond No. CMGP0002895 shall be null and void one (1) year after the recordation of the Notice of Completion; and • Payment Bond No. CMGP0002895 shall be null and void one (1) year after the recordation of the Notice of Completion. FISCAL IMPACT There is no fiscal impact with the release of performance and payment bonds. Construction costs of the Project are 80% reimbursable with a Federal Transit Administration (FTA) Section 5307 grant. The City will receive $267,308.00 in reimbursement for construction costs ($127,232.00 was received in Fiscal Year (FY) 2019/20 and the remaining $140,076.00 will be received in FY 2020/21). Additionally, the City is eligible to receive reimbursement for staff time associated with the project, which so far included $34,040.00 in staff reimbursement in FY 2019/20. The City will have up to $39,363 in available funding for staff reimbursements in FY 2020/21. The staff-time reimbursement frees additional Transportation Development Act (TDA) Article 8c Funds (2414) for transit programs. Table 1 below also provides a summary of remaining Project funds that will become available for other City projects/programs. STAFF RECOMMENDATION 1. Authorize the City Clerk to file the Notice of Completion; and 2. Authorize release of the Performance Bond (Number CMGP0002895) and Payment Bond (Number CMGP0002895) as outlined in the agenda report.
