MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Ky Spangler, City Clerk DATE: 01/06/2021 Regular Meeting SUBJECT: Consider Presentations from Applicants for Santa Monica Mountains Conversancy Advisory Committee and Appointment of a Representative to Serve a Two-Year Term BACKGROUND At its meeting of December 2, 2020, the City Council considered appointments to City Council Standing and Ad Hoc Committees and Other Assignments. During that discussion, it was noted that the City of Moorpark needed to make an appointment to the Santa Monica Mountains Conservancy Advisory Committee (SMMCAC) as vested in the California Public Resources Code (PRC) Section 33213, which sets forth the composition of the SMMCAC and provides the City Council with the discretion to appoint a member of the Council, a member of staff, or a member of the public to serve as the City’s representative on the Committee. The Council voted to establish a two-year term of appointment for the position to coincide with appointments made by the City Council on other boards and commissions, and directed staff to initiate recruitment for applicants with appointment consideration to be scheduled for the January 6, 2021, Council meeting. DISCUSSION Based on the Council’s direction and its waiver of City Council Policy 2.2, which calls for a 30-day recruitment for Board/Commission/Committee applications, the City Clerk’s Office initiated recruitment on December 4, 2020, seeking individuals interested in filling the existing vacancy on the SMMCAC for a two-year term. Recruitment closed on Monday, December 28, 2020, at 5:00 p.m. Three applications were received and have been transmitted to the Council under separate cover. It is recommended that the City Council receive presentations from the applicants, not- to-exceed three (3) minutes, on qualifications and interest to serve on the Committee. Following the interviews, the Council is asked to make an appointment for a public representative to serve on the SMMCAC. Item: 9.B. 348 Honorable City Council January 6, 2021 Regular Meeting Page 2 The City Clerk will conduct a random drawing of the names of the applicants prior to the start of the meeting to determine the order in which they will speak. The Council’s Policy resolution also provides the procedure for appointments as follows: A. The Mayor shall solicit suggested nominees from members of the Council. B. Prior to making a motion for appointment, the Mayor shall announce the names of all persons he/she intends to nominate, and in the order to be nominated, for a board, commission, or committee. C. The Mayor shall make a motion putting forth each individual name to be approved for appointment. D. A second shall be required. E. The Council shall vote on each appointment individually. FISCAL IMPACT None. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. Establishment and Functions of the Santa Monica Mountains Conservancy [33200 - 33215] ( Chapter 3 added by Stats. 1979, Ch. 1087. ) (a) The Santa Monica Mountains Conservancy Advisory Committee is hereby created. The advisory committee consists of 26 members, as follows: (1) Fifteen representatives of local governments from jurisdictions including the Santa Monica Mountains, one of whom shall be appointed by the Mayor of the City of Los Angeles, one of whom shall be appointed by the Board of Supervisors of the County of Los Angeles, one of whom shall be appointed by the City Council of the City of Thousand Oaks, one of whom shall be appointed by the Board of Supervisors of the County of Ventura, one of whom shall be appointed by the City Council of the City of Agoura Hills, one of whom shall be appointed by the City Council of the City of Westlake Village, one of whom shall be appointed by the City Council of the City of Malibu, one of whom shall be appointed by the City Council of the City of Calabasas, one of whom shall be appointed by the City Council of Burbank, one of whom shall be appointed by the City Council of Glendale, one of whom shall be appointed by the City Council of La Canada-Flintridge, one of whom shall be appointed by the City Council of Pasadena, one of whom shall be appointed by the City Council of Sierra Madre, one of whom shall be appointed by the City Council of South Pasadena, and one of whom shall be appointed by the Board of Supervisors of Los Angeles County to represent the unincorporated communities within the jurisdiction of the East Rim of the Valley Trail Corridor, after consultation with the Town Council of Altadena and the Crescenta Valley Town Council. (2) Six public members, two of whom shall be appointed by the Governor, two of whom shall be appointed by the Senate Committee on Rules, and two of whom shall be appointed by the Speaker of the Assembly. (3) One representative of the Rancho Simi Recreation and Park District, to be appointed by the district board of directors. (4) One representative of the Conejo Recreation and Park District, to be appointed by the district board of directors. (5) One representative of the Pleasant Valley Recreation and Park District, to be appointed by the district board of directors. (6) One representative of the City of Santa Clarita, to be appointed by the city council. (7) One representative of the City of Moorpark, to be appointed by the city council. (b) The appointing powers shall make every effort to ensure that the ethnic and racial composition of the advisory committee reflects the racial and ethnic composition of the population of the state. (c) The advisory committee shall select from among its members a chairperson and a vice chairperson. (d) The members of the advisory committee shall serve without compensation, but shall be reimbursed for necessary expenses incurred in the performance of their duties. (e) The advisory committee has the following duties: (1) Propose and review projects for conservancy action and report to the conservancy regarding the conformity of the projects with the plan. (2) Review proposed amendments to the plan. (3) Provide opportunities for public participation. (f) Twelve members of the advisory committee shall constitute a quorum for the transaction of any business of the advisory committee. (Amended by Stats. 2000, Ch. 991, Sec. 3.
