SUBJECT: Consider Authorization for City Manager to Engage in Outside
Consulting Services to Serve as an Expert Witness
BACKGROUND
On February 7, 2018, the City approved an Employment Agreement between the City
and Troy Brown wherein Mr. Brown is to serve as City Manager. The employment
contract details the terms and conditions of City Manager Brown’s employment which
include: Duties and Authority of the City Manager, Employee’s Obligations, Salary and
Benefits, Indemnification, Evaluations, and other obligations of the parties.
The City Manager has over 25 years of municipal experience in multiple cities in
California. In addition to experiential knowledge gained as a result of b eing in local
government, City Manager Brown has voluntarily served on numerous boards and
committees related to the local government profession. Brown has also recently been
selected as the President of the International City/County Management Association
(ICMA) and was notified by ICMA that he will be receiving the designation of an ICMA
Credentialed City Manager, which recognizes professional local government managers
qualified by a combination of education and experience, adherence to high standards of
integrity, and a commitment to lifelong learning and professional development.
Brown has been sought to serve as an expert witness in providing testimony in a legal
matter involving a City Manager and City in California. Brown would be providing expert
testimony into the inner workings of the Council-Manager form of government and
would not be participating as or representing the City of Moorpark or the International
City/County Management Association. Section 3 of the Employment Agreement with
Brown requires “prior authorization from the City Council for any outside employment,
consulting, teaching or enterprise.” Consistent with Section 3 of the employment
agreement, Brown is seeking City Council authorization to participate in the trial as an
expert witness.

DISCUSSION
Troy Brown was appointed as City Manager for the City of Moorpark in 2018. Brown has
over 25 years of public sector experience that began in the City of Santa Clarita, CA.
He has served as Assistant to the City Manager for the cities of Riverside and Elk
Grove, Assistant City Manager for the City of Livermore, and City Manager for the City
of Tracy.
Brown is the Chief Executive Officer of a municipal corporation of 56 employees, an
annual operating and capital budget of approximately $48 million, and a city population
of approximately 37,000 residents. Appointed by the Mayor and City Council, Brown is
responsible for improving the community’s public infrastructure and enhancing quality of
life for residents. Throughout his municipal career he has appointed executive
leadership, reorganized City departments, overseen construction of numerous capital
improvement projects, enhanced transparency, and elevated the professionalism of
local government.
Having served on numerous community organizations and policy committees with the
League of California Cities, Brown has also served a West Coast Regional Vice
President for the International City/County Management Association (ICMA) and was
recently selected by the ICMA Board as the association’s President-Elect. Brown has
also served as a Director of the VantageTrust Company, an investment company that
provides for the commingled investment of $50 billion in assets of retirement plans
administered by ICMA-Retirement Corporation.
Brown has a Bachelor’s degree in Political Science from California State University,
Northridge and a Master’s of Public Administration from California State University, San
Bernardino.
Due to his depth and breadth of experience in local government and the City
Management profession, Brown has been sought to serve as an expert witness in a civil
matter involving a City Manager within the state of California. Brown’s participation
would be that of an individual, not the City Manager of Moorpark or the President-Elect
of ICMA. Service in the matter would not be conducted during work hours and for any
work needed that would occur during work hours, the appropriate leave time will be
taken. It is projected that no more than 40 hours of work is required between July –
November 2021.
FISCAL IMPACT
There is no fiscal impact to the City in allowing the City Manager to serve as an expert
witness.
