Carrillo, Associate Planner ll 9/01/2021 1 Green Island Villas Request 9/01/2021 2 The applicant is requesting the following modifications to the previously-approved residential project: •Reduce number of units from 69 to 63 •Remove a condition of approval regarding utilities to be placed underground •Modify the terms of a development agreement between the City and Sky Line 66,LLC Aerial Map 9/01/2021 3 Los Angeles Avenue Leta Yancy Road Mission Bell Plaza Shopping Center Shasta Avenue Existing Poles Approved Site Plan 9/01/2021 4 Entrance to Site Secondary Access 9/01/2021 5 Approved Architecture Changes to Approved Project 9/01/2021 6 •Project approved with 2-car garages that do not comply with code. •Reduce units from 69 units to 63 units to provide 20’ by 20’ two-car garages •Reduce number of guest parking spaces from 35 spaces to 33 spaces (+1 beyond code requirement) . 9/01/2021 7 Proposed Site Plan Utility Undergrounding 9/01/2021 8 •Standard Condition of Approval 145 requires poles to be placed underground •Three existing 66Kv high voltage transmission poles placed in front of Project site. •Remove condition and pay the City a fee of $3,333 per unit in lieu of the undergrounding. Affordable Housing 9/01/2021 9 •Development Agreement requires 15%, or 11 units of the 69 units. •Require 10 units to reflect 15% of revised project. •Offset Project Development Fees: •Development Fee per unit •Traffic Mitigation Fee •Park Fees Modification No. 1 to Residential Planned Development Permit No. 2014-02 Findings •Provide condominiums as well as deed- restricted affordable units •Project is similar to adjacent uses, and access to or utility of those adjacent uses are not hindered by this project •Be located within a residential neighborhood 9/01/2021 10 Development Agreement Findings •Achieve the goals of the Land Use Element and Housing Element •Consistent with provisions of Chapter 15.40 (Development Agreement) and processed through a public hearing as required by law. 9/01/2021 11 California Environmental Quality Act (CEQA) •A Negative Declaration was adopted for the original permit. •First Amendment to the DA and Modification No. to the Residential Planned Development Permit No. 2014- 02 and determined this action to be consisted with the previously-approved project. 9/01/2021 12 Planning Commission Recommendation Planning Commission voted unanimously to recommend that the City Council approve the requested modification and proposed first amendment to the development agreement. 9/01/2021 13 Recommendation •Open the public hearing, accept public testimony and close the public hearing; and •Introduce Ordinance approving First Amendment to Development Agreement between the City of Moorpark and Sky Line 66, LLC. •Adopt a Resolution, approving Modification No. 1 to Residential Planned Development Permit No. 2014-02, subject to conditions of approval. 9/01/2021 14 Any Questions? 9/01/2021 15
