All items listed are heard and acted upon by the City Council unless otherwise noted. 1. CALL TO ORDER: Mayor Parvin called the meeting to order at 6:31 p.m. 2. PLEDGE OF ALLEGIANCE: Parks and Recreation Director Jeremy Laurentowski led the Pledge of Allegiance. 3. ROLL CALL: Present: Absent: Staff Present: Councilmembers Enegren, Groff, Pollock, and Mayor Parvin. Councilmember Castro. Troy Brown, City Manager; Kevin Ennis, City Attorney; PJ Gagajena, Assistant City Manager; Karen Vaughn, Community Development Director; Kambiz Borhani, Finance Director; Jeremy Laurentowski, Parks and Recreation Director; Daniel Kim, City Engineer/Public Works Director; Brian Chong, Assistant to the City Manager; Chris Thompson, Senior Information Systems Analyst; Mack Douglass, Program Manager; Captain Victor Fazio, Ventura County Sheriffs Office; and Ky Spangler, City Clerk. 4. PROCLAMATIONS AND COMMENDATIONS: A Proclamation Declaring April 30, 2021, as the City of Moorpark's Observance of Arbor Day. Mayor Parvin presented Jeremy Laurentowski, Parks and Recreation Director, with a Proclamation declaring April 30, 2021, as the City of Moorpark's Observance of Arbor Day. B. Proclamation for Declaring April as Earthquake Preparedness Month. Mayor Parvin presented Mack Douglass, Program Manager, with a Proclamation declaring April as Earthquake Preparedness Month. REORDERING OF, AND ADDITIONS TO, THE AGENDA: April 21, 2021 CONSENSUS: It was the consensus of the Council to pull Consent Calendar Items 10.8. and 1 0.C. for individual consideration upon the request of Councilmember Pollock as he needs to abstain from those items. 7. ANNOUNCEMENTS, FUTURE AGENDA ITEMS, AND REPORTS ON MEETINGS/CONFERENCES ATTENDED BY COUNCILMEMBERS AND MAYOR: Councilmember Pollock announced on April 15 he participated in the League of Cities Environmental Quality Committee meeting reporting the Committee has been addressing solid waste diversion and Public Safety Power Shutoff (PSPS) events. Councilmember Pollock reported on April 20 he attended a Southern California Association of Governments (SCAG) Legislative Committee meeting noting three bills that are being monitored, reporting on three in particular: 1) Senate Constitutional Amendment SEA 2 (Senator Allen) that will remove Article 34 from the California Constitution which will allow City's to engage in affordable housing; 2) Senate Bill 9 (Senator Atkins) regarding land division for duplexes which would allow subdivision into two lots to allow four units, by-right; and 3) Senate Bill 10 (Senator Weiner) regarding upzoning up to 10 units on a parcel, noted if it is amended, SCAG plans to support the bill. Councilmember Pollock announced he participated in the League of California Cities legislative briefing meeting which he and Assistant to the City Manager Brian Chong attended. He noted they are tracking and monitoring bills in the legislature. Mayor Parvin announced the City of Moorpark's annual Earth Festival and Arbor Day Celebration on Saturday, May 1 from 9:00 a.m. to 1 :00 p.m. at the Arroyo Vista Community Park. Mayor Parvin announced Moorpark is now in the third week of the 2021 Wyland National Mayor's Challenge for Water Conservation and encouraged citizens to join the challenge by taking an online pledge to conserve water energy. Minutes of the City Council/Successor Agency Moorpark, California Page 3 April 21, 2021 Mayor Parvin reported she spoke at the Senate Committee on Energy, Utilities and Communications in support of Senator Stern's Bill 533 regarding Public Safety Power Shutoffs (PSPS) impacts on the community, noting elected official are doing everything possible to mitigate the impacts of PSPS events. A. City Manager COVID-19 Update. None. 8. PUBLIC HEARINGS: None. 9. PRESENTATION/ACTION/DISCUSSION: A. Consider Adoption of Landscape and Lighting Maintenance Districts Reserve Fund Study Report and Approval of Revisions to Council Policy 5.5: Landscape and Lighting Assessment District. Staff Recommendation: 1) Approve adoption of the Landscape and Lighting Maintenance Districts Reserve Fund Study Report; and 2) Approve revisions to Policy 5.5: Landscape and Lighting Assessment District (LLAD), and direct staff to incorporate the revised Policy 5.5 into the next comprehensive update of the City Council Policies Resolution. Mr. Laurentowski gave the staff report. He noted a Supplemental Report was distributed today revising five of the diagrams to correctly reflect the maintenance responsibility to the associated district and confirmed the report consists of 64 pages. There were no speakers. MOTION: Councilmember Enegren moved and Councilmember Groff seconded a motion to 1) Approve adoption of the Landscape and Lighting Maintenance Districts Reserve Fund Study Report, as amended, and 2) Approve revisions to Policy 5.5: Landscape and Lighting Assessment District (LLAD), and direct staff to incorporate the revised Policy 5.5 into the next comprehensive update of the City Council Policies Resolution. The motion carried by a roll call vote 4-0 with Councilmember Castro absent. B. Consider Approval of Agreement with National Demographics Corporation, Inc. for Redistricting Consulting Services. Staff Recommendation: Approve Agreement with National Demographics Corporation, Inc. for the provision of Redistricting Consulting Services, subject to final language approval by the City Manager and City Attorney. April 21, 2021 MOTION: Mayor Parvin moved and Councilmember Enegren seconded a motion to approve an Agreement with National Demographics Corporation, Inc. for the provision of Redistricting Consulting Services, subject to final language approval by the City Manager and City Attorney. The motion carried by 4-0 roll call vote, with Councilmember Castro absent. 10. CONSENT CALENDAR: MOTION: Councilmember Pollock moved and Councilmember Groff seconded a motion to approve the Consent Calendar with the exception of Items 10.B and 10.C. which were pulled from the Consent Calendar for individual consideration. The motion carried by a roll call vote 3-0 with Councilmember Castro absent and Councilmember Pollock abstaining. A. Consider Warrant Register for Fiscal Year 2020/21 -April 21, 2021. Staff Recommendation: Approve the warrant register. B. Consider Resolution Accepting Public Street and Drainage Improvements and Surety Bond Reductions and Resolution Approving Surety Bond Exoneration for K. Hovnanian at Meridian Hills, LLC -Tract Nos. 5187-1, 5187-2, and 5405. Staff Recommendation: 1) Adopt Resolution No. 2021- 4001, accepting the completion of public street and drainage improvement work for Tracts 5187-1, 5187-2, and 5405; and 2) Authorize the City Clerk to reduce surety bond SNO4002559 to $100,000.00; and 3) Authorize the City Clerk to reduce surety bond SNO4002560 to $100,000.00; and 4) Authorize the City Clerk to reduce surety bond SNO4002557 to $50,997.54; and 5) Authorize the City Clerk to reduce surety bond SNO4002558 to $14,994.13; and 6) Adopt Resolution No. 2021-4002, exonerating surety bond SNO4002556; and 7) Authorize the City Clerk to exonerate the Bonds as shown in the agenda report and draft resolution. MOTION: Mayor Parvin moved and Councilmember Enegren seconded a motion to approve staff's recommendations including adoption of Resolution No. 2021-4001 accepting the completion of public street and drainage improvement work for Tracts 5187-1, 5187-2, and 5405, and Resolution No. 2021-4002 exonerating surety bond SNO4002556. The motion carried by a roll call vote 3-0 with Councilmember Castro absent and Councilmember Pollock abstaining. C. Consider Authorizing Acceptance of Phase II Landscape Maintenance Improvements in Landscape Maintenance District 20 (Meridian Hills). Staff Recommendation: Adopt Resolution No. 2021-4003, accepting Phase II landscape improvements in Tracts 5187 and Tract 5405 as complete and authorizing City to assume maintenance responsibilities effective May 1, 2021. The motion carried by a roll call vote 3-0 with Councilmember Castro absent and Councilmember Pollock abstaining . 11 . ORDINANCES : (ROLL CALL VOTE REQUIRED) None . 12 . CLOSED SESSION : Mr. Brown requested the Council go into closed session for discussion of Item 12 .A. on the agenda. The time was 6:59 p .m .
