accept the grant deed for the property; and 3) Adopt Resolution No. 2021-4046,
amending the Fiscal Year 2021/22 Budget by allocating $711,446.73 from the LA
AOC Fund (2014) to project C0021 to fund the purchase of 240 Los Angeles

BACKGROUND & DISCUSSION
The property at 240 Los Angeles Avenue is a critical piece of the project to widen Los
Angeles Avenue between Moorpark Avenue and Spring Road. At various times over the
last 15 years, the City has attempted to negotiate with the property owner to purchase the
property, but no deal was made.
In June of 2021, staff was made aware that the property had been put on the open real
estate market. The City Council authorized staff to make an offer on the property in July
2021, which the City did. After some back and forth negotiation, the terms of the
purchase were agreed upon in September 2021. In addition to agreeing to the sales
price, the seller has requested to lease back the property at no cost for two years from
the date of close of escrow. The seller would sign a separate lease agreement with the
City outlining the terms of the tenancy, which will include all maintenance and utility costs
being borne by the tenant. The lease agreement will be brought back to City Council for
approval at a subsequent meeting. Staff is conducting a property inspection to ensure
that the property is safe for the extended tenancy.
GENERAL PLAN DETERMINATION
Pursuant to Government Code Section 65402, on September 28, 2021, the Planning
Commission found that the acquisition of the property is in accordance with the General
Plan.

ENVIRONMENTAL DETERMINATION
Staff has evaluated the acquisition of 240 Los Angeles Avenue for compliance with the
California Environmental Quality Act (CEQA). The action is exempt from CEQA as a
Class 1 (existing facilities) exemption from CEQA based on State CEQA Guidelines
Section 15301. This applies on the basis that the property will continue to operate as a
residential dwelling which is consistent with the current use on the site. In addition, the
acquisition is exempt from CEQA under the “catch-all exception” because it can be seen
with certainty that its acquisition will not have the possibility to have a significant effect on
the environment. This exception applies because the City is not proposing to use the
property or to change the property to a new use at this time. If and when the City proposes
to use the property for a new and different use, or for road widening, environmental review
of those projects would be conducted at that time.
FISCAL IMPACT
The negotiated sales price for the property is $800,000. Funds needed for property
inspection and estimated closing costs are $10,000 for a total of $810,000. The adopted
fiscal year 2021/22 budget includes funding for property acquisition for the Los Angeles
Avenue Widening (Moorpark Avenue to Spring Road) (C0021) in the amount of
$98,553.27. Staff is requesting a budget amendment from the Los Angeles Avenue Area
of Contribution (AOC) (Fund 2014) in the amount of $711,446.73.
COUNCIL GOAL COMPLIANCE
This action does not support a current strategic directive. However, the widening of Los
Angeles Avenue has been a long-term Capital Improvement Project of the City of
Moorpark.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, AMENDING THE FISCAL YEAR
2021/22 BUDGET BY APPROPRIATING $711,446.73 FROM THE
LOS ANGELES AVENUE AREA OF CONTRIBUTION FUND (2014)
TO FUND ACQUISITION OF 240 LOS ANGELES AVENUE
WHEREAS, on June 16, 2021 the City Council adopted the Operating and Capital
Improvement Projects budget for Fiscal Year (FY) 2021/22; and
WHEREAS, a staff report has been presented to the City Council requesting a
budget amendment in the amount of $711,446.73 from the Los Angeles Avenue Area of
Contribution (AOC) Fund (2014) to fund the acquisition of 240 Los Angeles Avenue for
road widening purposes; and
WHEREAS, Exhibit “A”, attached hereto and made a part hereof, describes said
budget amendment and the resultant impact to the budget line items.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. A budget amendment in the amount of $711,446.73 from the Los
Angeles Avenue AOC Fund (2014), as more particularly described in Exhibit “A”, attached
hereto, is hereby approved.
SECTION 2. The City Clerk shall certify to the adoption of this resolution and shall
cause a certified resolution to be filed in the book of original resolutions.
