MINUTES OF THE CITY COUNCIL AND SUCCESSOR AGENCY OF THE REDEVELOPMENT AGENCY OF THE CITY OF MOORPARK Moorpark, California June 2, 2021 A Regular Meeting of the City Council of the City of Moorpark and the Successor Agency was held on June 2, 2021, in the Council Chambers of said City located at 799 Moorpark Avenue, Moorpark, California. All items listed are heard and acted upon by the City Council unless otherwise noted. 1.CALL TO ORDER: Mayor Parvin called the meeting to order at 6:33 p.m. 2.PLEDGE OF ALLEGIANCE: Ventura County Sheriff’s Captain Victor Fazio led the Pledge of Allegiance. 3.ROLL CALL: Present:Councilmembers Enegren, Pollock, Castro, Groff and Mayor Parvin. Mayor Parvin presented Certificates of Recognition to Sophia Bryson, Isobel Coursey, Jesse Gallego, William Gratke, Anishka Jain, Jaynie Jindarat, Ethan Jones, Aaron Luekenga, Shreya Nadkarni, Delilah Sichmeller, Lia Sina, Neha Thiyagarajan, Jordyn Washington, Ollie Webb for their service on the Teen Council. C.Recognition of Moorpark Unified School District Color Guard on its First Place Gold Medal Finish in the Winter Guard Association of Southern California Virtual Championships. Item: 10.B. 82 Minutes of the City Council/Successor Agency Moorpark, California Page 2 June 2, 2021 Mayor Parvin presented Certificates of Recognition to the Rob Guzman, Caption Head, Bri Vargas, Coach, and Co-Captains Sarah Bauer and Rachel Geen of the Moorpark Unified School District Color Guard. B. Proclamation Recognizing June 2021 as LGBTQ+ Pride Month in the City of Moorpark. Mayor Parvin presented a Proclamation to Tess Allen, Executive Director of Ventura County Diversity Collective. 5. PUBLIC COMMENT: None. 6. REORDERING OF, AND ADDITIONS TO, THE AGENDA: CONSENSUS: It was the consensus of the Council to adjourn the meeting in memory of Moorpark resident Steven Castro upon the request of Councilmember Pollock . 7. ANNOUNCEMENTS, FUTURE AGENDA ITEMS, AND REPORTS ON MEETINGS/CONFERENCES ATTENDED BY COUNCILMEMBERS AND MAYOR: Councilmember Pollock reported he attended the M emorial Day service at Veterans Memorial Park. Councilmember Pollock reported he attended the Moorpark Chamber of Commerce monthly mixer along with Councilmember Groff and Mayor Parvin. Councilmember Pollock reported that although the Governor has announced the reopening of California and masks will no longer be required after June 15, the Executive Order that relaxed the Brown Act and al lowed for remote meetings will continue which will allow the Southern California Association of Governments and League of California Cities additional time to transition back to in -person meetings. Councilmember Enegren reported on May 28 he visited Moorpark’s Angry Ferret Brewery. Councilmember Enegren reported on May 29 he participated in the inaugural ride of Metrolink train service on Saturdays to downtown Los Angeles, commented on the train schedule and on the desire for a morning train coming from Los Angeles to bring visitors to Moorpark and Ventura County. 83 Minutes of the City Council/Successor Agency Moorpark, California Page 3 June 2, 2021 Councilmember Enegren reported he attended the M emorial Day service at Veterans Memorial Park. Councilmember Groff reported on May 29 he also participated in the inaugural ride of Metrolink train service on Saturdays to downtown Los Angeles. Councilmember Groff reported on May 30 he attended the Farmers M arket. Councilmember Groff reported on May 31 he participated with Moorpark Rotary to place 50 flags in various locations in the City in recognition of Memorial Day. Councilmember Groff reported he attended the Moorpark Chamber of Commerce monthly mixer. Councilmember Castro extended thank s to the American Legion for the M emorial Day event. Councilmember Castro reported on May 30 he attended the Farmers M arket. Mayor Parvin announced the summer concert series with the first Concert in the Park on Saturday, June 5 at Arroyo Vista Community Park featur ing Raymond Michael as Elvis. Tickets must be purchased in advance and are on sale now at moorparkca.gov/concerts for $5.00 per family. Mayor Parvin announced registration is open for Camp Moorpark, a day camp program for children ages 5 to 12 held at the Arroyo Vista Recreation Center from 7:00 a.m. to 6:00 p.m. and offering many activities. Mayor Parvin announced the City is excited to proclaim the return of the City’s 3rd of July Fireworks Extravaganza on Saturday, July 3 at Arroyo Vista Community Park which will include live music, food vendors, and an aerial fireworks display. Tickets are $5.00 per person and tickets must be purchased in advance; no tickets will be sold at the gates. For event information and to purchase tickets, please visit m oorparkca.gov/f ireworks. Mayor Parvin announced Moorpark residents participated in the Wyland National Mayor’s Challenge for Water Conservation during Earth Month in April. This annual challenge brings awareness to the benefits of conserving water, including reduc ing energy use and pollution. Residents took online pledges to conserve water in different ways during April and c ompeted against more than 500 cities in the 30,000-100,000 population category with Moorpark finishing at #141, up from last year’s ranking of #214. 84 Minutes of the City Council/Successor Agency Moorpark, California Page 4 June 2, 2021 Mayor Parvin announced Pentair, one of the largest employers in Moorpark manufactures products that filter and clean water, is hiring. Pentair is hosting a job fair on Saturday, June 5 from 9:00 a.m . to 1:00 p.m. at its facility at 10951 Los Angeles Avenue and invites Moorpark and Ventura County residents to consider joining their assembly and production teams as entry level and lead workers. Mayor Parvin announced the Moorpark Farmer’s Market, a certified farmers market sponsored by Enriched Farms, is now open every Sunday from 9:00 a.m . to 2:00 p.m . at the City Hall parking lot at 799 Moorpark Avenue. You can find organic produce, taste unique foods, and discover handmade arts and crafts. Go to enrichedf arms.com for more information. Mayor Parvin announced applications are currently being accepted for appointment to the Moorpark Teen Council. If you want to learn more about this appointment, visit the City’s website for information and the on -line application at moorparkca.gov /serve. If interested, apply to serve before 5:00 p.m. on Tuesday, June 8. Mayor Parvin reported on the following: on May 6 attended the Southern California Association of Governments (SCAG) annual General Assembly meeting; on May 8 attended the High Street Eats event; on May 13 participated in the Regional Water Quality Control Board meeting and requested the Board consider separate stormwater NPDES MS4 (National Pollutant Discharge and Elimination System Municipal Separate Storm Sewer System ) permits for Ventura and Los Angeles Counties; on May 13 attended the Ventura Council of Governments meeting; on May 15 attended the Peace Officers M emorial Day event via Zoom ; on May 16 attended the opening day of the Farmers M arket; on May 18 attended a food pantry distribution event; on May 19 attended the Local Agency Formation Commission (LAFCo) meeting where its annual budget was approved; on May 21 attended the Moorpark Cham ber of Commerce break fast; on May 26 participated in the annual Moorpark Rotary Club golf tournament; on May 27 attended the Ventura Counc il of Governments (VCOG) Administration Meeting and then attended the Memorial Day v eterans ceremony ; on June 1 attended the Moorpark Chamber of Commerce mixer at Grocery Outlet; and on June 2 attended a surprise retirement gathering for Carrie Pentis, Moorpark High School Principal. A. City Manager COVID-19 Update. Mr. Brown provided a COVID-19 update, directing people to venturacountyrecovers.org, where the latest information on vaccinations and cases in Moorpark is available and residents can sign up to receive the information related to vaccinations, cases, prevention, pop up events and more. You can also visit the City’s website at www.moorparkca.gov to find a link to County ’s webpage. 85 Minutes of the City Council/Successor Agency Moorpark, California Page 5 June 2, 2021 Effective at 12:01 a.m. on June 2, Ventura County moved into the Yellow Tier, the least restrictive tier in California’s roadmap to recovery. Ventura County’s adjusted case rate improv ed from 1.5 new cases per 100,000 people to 1.2 with overall test positivity rate remaining at 0.7%, and in health equity areas the test positivity rate dropped from 1.4% to 1.1%. Currently, 66% of the County aged 12+ have received at least one dose and 54% of the those 12 and older are fully vaccinated. Also on the vaccination front, Moorpark Unified School District partnered with Ventura County Public Health to offer a walk -up/drive to "pop-up" COVID-19 vaccine clinic on June 1 at Chaparral Middle School from 12:00 p.m. to 5:00 p.m. open to anyone in the community with those families with children aged 12 and up specifically targeted to be vaccinated. A second “pop-up” event will be held at Chapparal in the coming weeks (at least 21 days) for second shots. Moving into the Yellow Tier allows for increases in capacity in many sectors and will also allow bars to begin providing indoor service at 25% capacity. Sectors with increases in capacity limits include amusement parks and fairs, gyms and fitness centers, yoga studios, private e vents, bars, hotels and short-term lodging rentals, private gatherings, breweries, indoor playgrounds, restaurants, cardrooms and racetracks, indoor and outdoor live events and performances, wineries and tasting rooms, family entertainment centers, and museums, zoos, and aquariums. Ventura County made the shift to the Yellow Tier two weeks in advance of Governor Newsom’s June 15 re-opening date, which he has signaled will be an end of the current color-coded tier system. It is unclear exactly what the plans are for after June 15 and further updates will be provided as information becomes available. 8.PUBLIC HEARINGS: A.Consider Final Review of the Assessment Engineer’s Report for the Parks and Recreation Maintenance and Improvement Assessment District and Resolution Confirming the Levy Amount and Ordering the Continuation of Assessment for Fiscal Year 2021/22. Staff Recommendation: 1) Open the public hearing, take public testimony, and close the public hearing; and 2) Adopt Resolution No. 2021-4008. (ROLL CALL VOTE REQUIRED) Mr. Borhani gave the staff report. The motion carried by unanimous roll call vote. B. Consider Final Review of the Assessment Engineer’s Report for the Landscaping and Lighting Maintenance Assessment Districts and Resolution Confirming the Levy Amounts and Ordering the Continuation of Assessment for Fiscal Year 2021/22. Staff Recommendation: 1) Open the public hearing, take public testimony, and close the public hearing; and 2) Adopt Resolution No. 2021-4009. (ROLL CALL VOTE REQUIRED) Mr. Borhani gave the staff report. Mayor Parvin opened the public hearing at 7:10 p.m. Having no speakers, the public hearing was closed. MOTION: Councilmember Pollock moved and Councilmember Groff seconded a motion to adopt Resolution No. 2021-4009. The motion carried by unanimous roll call vote. 9. PRESENTATION/ACTION/DISCUSSION: A. Consider Presentation from Applicant and Make Appointment to Fill One Vacancy on the Library Board. Staff Recommendation: Hear presentation from applicant and appoint one representative to fill the vacancy on the Library Board for a three-year term ending June 30, 2024. Ms. Spangler gave the staff report. Library Board applicant Linda Goble spoke. MOTION: Mayor Parvin moved and Councilmember Groff seconded a motion to appoint Linda Goble to the Library Board for a three-year term ending June 30, 2024. The motion carried by unanimous roll call vote. B. Consider Appointments to Fill Two Vacancies on the Area Agency on Aging Advisory Council. Staff Recommendation: Appoint two Area Agency on Aging Advisory Council representatives to serve two -year terms ending June 30, 2023. Ms. Spangler gave the staff report. MOTION: Mayor Parvin moved and Councilmember Pollock seconded a motion to appoint Sandra Fide to the Area Agency on Aging Advisory Council for a two- year term ending June 30, 2023. The motion carried by unanimous roll call vote. 87 Minutes of the City Council/Successor Agency Moorpark, California Page 7 June 2, 2021 MOTION: Mayor Parvin moved and Councilmember Enegren seconded a motion to appoint Breeze Zuckerman to the Area Agency on Aging Advisory Council for a two-year term ending June 30, 2023. The motion carried by unanimous roll call vote. C. Consider an Agreement with Lee & Associates – LA North/Ventura, Inc. for an Exclusive Right to Represent the City for the Purchase or Lease of Real Property to Relocate City Hall. Staff Recommendation: Authorize the City Manager to sign an Exclusive Right to Represent Agreement for Purchase or Lease of Real Property with Lee & Associates – LA North/Ventura, Inc. subject to final language approval of the City Manager and City Attorney. Mr. Gagajena gave the staff report. Discussion among Council and staff followed regarding: 1) the cost associated with new space and relocation; 2) a phased approach to move a portion of staff to another location if possible; and 3) the commission percentage and parameters proposed in the draft agreement. Mike Tingus with Lee & Associates spoke to address Council question s regarding public/private partnerships opportunities and spoke regarding the various options which may exist in the community that he would investigate and present for consideration and stated there is no fee or commission unless there is a transaction. Mr. Ennis noted changes can be incorporated into the agreement to address the Council’s concerns regarding payment of a broker commission. MOTION: Mayor Parvin moved and Councilmember Enegren seconded a motion to execute an Exclusive Right to Represent the City for Purchase or Lease of Real Property subject to final language approval of the City Manager and City Attorney . The motion carried by unanimous roll call vote. 10. CONSENT CALENDAR: MOTION: Councilmember Pollock moved and Councilmember Groff seconded a motion to approve the Consent Calendar. Consider Agreement with Library Systems & Services, LLC (LSS) for Provision of Services for Operation of the Moorpark City Library . Staff Recommendation: Authorize the City Manager to sign the Agreement with Library Systems & Services, LLC (LSS) for operation of the Moorpark City Library, which includes the scope of services and compensation plan for the five-year term of the agreement, subject to final language approval of the City Manager and City Attorney. H. Consider Agreement with Linda L. Toth dba Home Sweet Hom e Property Management for Property Management Services at City -owned properties. Staff Recommendation: Approve Agreement with Linda L. Toth dba Home Sweet Home Property Management; and authorize the City Manager to sign the Agreement, subject to final language approval of the City Manager. I. Consider Amendment to Agreement with West Coast Arborists, Inc. for Tree Maintenance Services. Staff Recommendation: Approve Amendment No. 1 to Agreement with West Coast Arborists, Inc. for tree maintenance services, and authorize the City Manager to sign the Amendment, subject to final language approval of the City Manager. J. Consider Award of Agreement to Parkwood Landscape Maintenance, Inc. for Landscape Maintenance Services in Landscape Maintenance District Zone 22. Staff Recommendation: Approve Agreement with Parkwood Landscape Maintenanc e, Inc. and authorize the City Manager to execute the Agreement, subject to final language approval of the City Manager. K. Consider Amendment No. 1 to Stantec Consulting Services, Inc. for Arroyo Drive Design Services, Adding Prevailing Wage Language . Staff Recommendation: Authorize the City Manager to sign the Agreement with Hartzog & Crabill, Inc. in an amount not -to-exceed $50,000 for a three-year term expiring June 30, 2024, subject to final language approval by the City Manager. M.Consider the Design Specifications and Authorization to Advertise for Bids for the 2021 Sidewalk Rehabilitation Project (MPK 21-01). Staff Recommendation: 1) Approve Specification No. MPK 21-01 for the 2021 Sidewalk Rehabilitation Project; and 2) Authorize staff to advertise to obtain construction bids. N.Consider the Notice of Completion for the 2020 Slurry Seal and Pavement Rehabilitation Project (Project No. M0047) Specification No. MPK 20-01; Consider Authorization for Release of Project Bonds in Accordance with the Contract Provisions; and Consider Resolution Authorizing a Budget Amendment to Fiscal Year 2020/21 Budget. Staff Recommendation: 1)Authorize the City Clerk to file the Notice of Completion for the 2020 Slurry Seal and Pavement Rehabilitation Project, Project Specification No. MPK 20-01; and 2) Authorize the City Clerk to release the Faithful Performance and Material Suppliers and Laborers Bond, Bond No. 107296589, one year after the date of recordation of the Notice of Completion; and 3) Adopt Resolution No. 2021-4010 amending the Fiscal Year 2020/21 budget as noted in Exhibit “A” to the attached resolution. Mr. Ghirelli and Mr. Spondello left the meeting at 8:36 p.m. The Council reconvened into open session at 8:56 p.m. Mr. Brown stated one case under Item 12.A., and Item 12.B . were discussed and there was no action to report. 13.ADJOURNMENT: Mayor Parvin adjourned the meeting in memory of Moorpark resident, Steven Castro.
