MINUTES OF THE CITY COUNCIL AND SUCCESSOR AGENCY OF THE REDEVELOPMENT AGENCY OF THE CITY OF MOORPARK Moorpark, California September 15, 2021 A Regular Meeting of the City Council of the City of Moorpark and the Successor Agency was held on September 15, 2021, in the Council Chambers of said City located at 799 Moorpark Avenue, Moorpark, California. All items listed are heard and acted upon by the City Council unless otherwise noted. 1. CALL TO ORDER: Mayor Parvin called the meeting to order at 6:31 p.m. 2. PLEDGE OF ALLEGIANCE: Parks and Recreation Director Jeremy Laurentowski led the Pledge of Allegiance. 3. ROLL CALL: Present: Councilmembers Castro, Enegren, Groff, Pollock, and Mayor Parvin. Staff Present: Troy Brown, City Manager; Kevin Ennis, City Attorney; PJ Gagajena, Assistant City Manager; Kambiz Borhani, Finance Director; Brian Chong, Assistant to the City Manager; Daniel Kim, City Engineer/Public Works Director; Jeremy Laurentowski, Parks and Recreation Director; Douglas Spondello, Interim Community Development Director; Shaun Kroes, Public Works Manager; Jessica Sandifer, Community Services Manager; Chris Thompson, Senior Information Systems Analyst; Captain Victor Fazio, Ventura County Sheriff's Office; and Blanca Garza, Deputy City Clerk II. 4. PROCLAMATIONS AND COMMENDATIONS: A. Proclamation Declaring September 2021 Emergency Preparedness Month. Mayor Parvin presented a Proclamation to Mack Douglass, Program Manager, declaring September 2021 as Emergency Preparedness Month. B. Certificate of Recognition to Hiromi Dever, Senior Account Technician II in the Finance Department, as the First Recipient of the City’s Apricot Award. Item: 10.C. 124 Minutes of the City Council/Successor Agency Moorpark, California Page 2 September 15, 2021 Mayor Parvin presented a Certificate of Recognition to Hiromi Dever, Senior Account Technician II in the Finance Department, as the First Recipient of the City’s Apricot Award. C. Certificate of Recognition to Finance Department for Receiving the Government Finance Officers Association Certificate of Achievement for Excellence in Financial Reporting Award for Fiscal Year 2019/20. Mayor Parvin presented a Certificate of Recognition the Finance Department and Finance Director Kambiz Borhani for Receiving the Government Finance Officers Association Certificate of Achievement for Excellence in Financial Reporting Award for Fiscal Year 2019/20. 5. PUBLIC COMMENT: None. 6. REORDERING OF, AND ADDITIONS TO, THE AGENDA: None. 7. ANNOUNCEMENTS, FUTURE AGENDA ITEMS, AND REPORTS ON MEETINGS/CONFERENCES ATTENDED BY COUNCILMEMBERS AND MAYOR: Councilmember Pollock reported on September 10 he learned about brewing beer at Enegren Brewing Company, noting a special “Council Brew” will be unveiled at the Country Days event. Councilmember Pollock reported he attended a performance of Hamilton prior to attending the High Street Arts Theater annual fundraising gala. Councilmember Enegren reported on September 8 he attended a special meeting of the Ventura County Animal Services Commission where the concern of a growing feral cat population was discussed as well as ways to address the issue through spaying and neutering efforts. Councilmember Enegren reported on September 10 he attended a Ventura County Transportation Commission meeting where an update on the status of the federal infrastructure bill was provided, a Santa Paula Branch Line signal maintenance update was received, and the 2021/2022 Program of Projects was approved. Councilmember Enegren reported on September 10 he brewed beer with the rest of the Council in preparation for Country Days. 125 Minutes of the City Council/Successor Agency Moorpark, California Page 3 September 15, 2021 Councilmember Enegren reported on September 11 he attended the High Street Arts Center gala. Councilmember Groff reported on September 11 he attended the High Street Arts Center gala. Councilmember Groff reported on September 12 he attended the Farmers Market. Councilmember Castro remarked he appreciated the education on beer brewing. Councilmember Castro reported on September 8 he attended a community conversation on mental health needs in Ventura County hosted by NAMI (National Alliance on Mental Illness). Mayor Parvin announced registration is underway for fall recreation classes at the Arroyo Vista Recreation Center. Classes offered include tennis, golf, science, youth and adult dance, Parent’s Night Out, and more. For information or to register, visit MoorparkCa.gov/Recreation. Mayor Parvin announced Coastal Cleanup Day this month with an Arroyo cleanup on Saturday, September 18 at Villa Campesina Park from 9:00 a.m. to 12:00 p.m. Volunteers are asked to bring gloves and wear sturdy shoes. Mayor Parvin announced the City’s Concerts in the Park series continues with a performance by the Moorpark Symphony Orchestra on Saturday, September 18. The concert will be held at the Arroyo Vista Community Park starting at 5:30 p.m. Admission is free. For details, visit MoorparkCa.gov/Concerts. Mayor Parvin announced the Fall Apricot Slam Pickleball Tournament presented by the City of Moorpark and Lucky Fools Pub will be held on October 16 & 17. Mayor Parvin announced Moorpark Country Days will be held Saturday, October 2 from 9:00 a.m. to 5:00 p.m. with the parade down Historic High Street beginning at 10:30 a.m. The street fair features local vendors, crafts, entertainment, food trucks, live music, animals, a kid fun zone, ferris wheel, beer garden, and a corn hole tournament. Mayor Parvin announced the annual Moorpark Mammoth Run, a 5K-10K run and one mile walk sponsored by the Rotary Club of Moorpark with benefits going to local charities, will take place on Sunday, October 3 at Arroyo Vista Community Park beginning at 8:30 a.m. For more information or to register, visit MoorparkMammothRun.com 126 Minutes of the City Council/Successor Agency Moorpark, California Page 4 September 15, 2021 Mayor Parvin reported on September 2 she attended the Clean Power Alliance Board of Directors meeting where two power purchase agreements were approved. Mayor Parvin reported on September 4 she led the pledge of allegiance at Moorpark College Football’s first home game. Mayor Parvin reported on September 7 she attended the Moorpark Chamber of Commerce monthly mixer held at the Perez Funeral Home. Mayor Parvin reported on September 10 she participated in the creation of the Council Brew for Country Days and noted she didn’t realize how technical the beer making process is. Mayor Parvin reported on September 14 she met with a potential developer regarding a hotel site. Mayor Parvin reported on September 15 she participated in a Local Agency Formation Committee (LAFCo) meeting where the Bell Canyon Community Facilities District was discussed. Mayor Parvin reported on September 15 prior to the Council meeting she met with a local Hindu group, Hindu Swayamsevak Sangh, and who presented the Council with a Universal Oneness message. 8. PUBLIC HEARINGS: None. 9. PRESENTATION/ACTION/DISCUSSION: A. Consider Resolution Affirming the City of Moorpark’s Commitment to Respect, Equity and Inclusion Citywide. Staff Recommendation: Adopt Resolution No. 2021-4042 Affirming the City of Moorpark’s Commitment to Respect, Equity and Inclusion Citywide. Mr. Gagajena gave the staff report. There were no speakers. MOTION: Mayor Parvin moved and Councilmember Pollock seconded a motion to adopt Resolution No. 2021-4042. Consider the Establishment of an Ad Hoc Committee to Select Architect for New Moorpark City Library Project. Staff Recommendation: Appoint two (2) Councilmembers of the City Council to serve on the Library Architect Ad Hoc Committee to select an Architect for the new Library. Mr. Laurentowski gave the staff report. There were no speakers. CONSENSUS: It was the unanimous consensus of the City Council to appoint Councilmember Enegren and Councilmember Pollock to serve on the Library Architect Ad Hoc Committee. The motion carried by unanimous roll call vote. 10. CONSENT CALENDAR: MOTION: Councilmember Pollock moved and Councilmember Groff seconded a motion to approve the Consent Calendar. The motion carried by unanimous roll call vote. A. Consider Warrant Register for Fiscal Year 2021/22 – September 15, 2021. Staff Recommendation: Approve the warrant register. B. Consider Minutes of Regular City Council/Successor Agency Meeting of April 21, 2021. Staff Recommendation: Approve the minutes. C. Consider Minutes of Regular City Council/Successor Agency Meeting of May 5, 2021. Staff Recommendation: Approve the minutes. D. Consider Minutes of Special City Council/Successor Agency Meeting of May 26, 2021. Staff Recommendation: Approve the minutes. E. Consider 10-Day Report Pursuant to Government Code Section 65858(d) on the Measures Taken to Address Formula Retail Businesses on High Street Which Led to the City Council’s Adoption of Interim Urgency Ordinance No. 492. Staff Recommendation: Approve the Report Regarding Ordinance No. 492 Pertaining to the Prohibition of Formula- Based Retail Businesses on High Street. F. Consider Amendment with Hahn Contractors, Inc. for On-Call and Emergency General Maintenance and Repair Services. Staff Recommendation: Approve Amendment to Agreement with Hahn Contractors, Inc. for a not-to-exceed amount of $50,000, and authorize the City Manager to sign the Amendment. 128 Minutes of the City Council/Successor Agency Moorpark, California Page 6 September 15, 2021 G. Consider Authorization for Recordation of the Notice of Completion for Streetlight Turnkey Services and Release of Bonds in Accordance with the Contract. Staff Recommendation: 1) Authorize the City Clerk to file the Notice of Completion; and 2) Authorize release of the Performance Bond (Number K40552935) and Payment Bond (Number K40552935) as outlined in the agenda report. H. Consider Resolution Authorizing the Destruction of City Records (Chronological Correspondence Files, Claims, Potential Claims, and Agreements/Contracts/Leases). Staff Recommendation: Adopt Resolution No. 2021-4043. I. Consider Resolution Amending the Conflict of Interest Code of the City of Moorpark to Incorporate New Positions and Rescinding Resolution No. 2020-3953. Staff Recommendation: Adopt Resolution No. 2021-4044, rescinding Resolution No. 2020-3953. (ROLL CALL VOTE REQUIRED) 11. ORDINANCES: (ROLL CALL VOTE REQUIRED) A. Consider Ordinance No. 490 Approving First Amendment to Development Agreement By and Between the City of Moorpark and Essex Moorpark Owner, L.P, in Association with Residential Planned Development Permit No. 2012-02, a Previously-Approved Residential Project Located at 150 Casey Road. Mr. Ennis read the title of Ordinance No. 490. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING FIRST AMENDMENT TO DEVELOPMENT AGREEMENT BY AND BETWEEN THE CITY OF MOORPARK AND ESSEX MOORPARK OWNER, L.P, IN ASSOCIATION WITH RESIDENTIAL PLANNED DEVELOPMENT PERMIT NO. 2012-02, A PREVIOUSLY-APPROVED RESIDENTIAL PROJECT LOCATED AT 150 CASEY ROAD MOTION: Mayor Parvin moved and Councilmember Pollock seconded a motion to adopt Ordinance No. 490. Consider Ordinance No. 491 Approving First Amendment to Development Agreement By and Between the City of Moorpark and Sky Line 66, LLC, in Association with Residential Planned Development Permit No. 2014-02, a Previously-Approved Residential Development Located at 635 Los Angeles Avenue. Consider Ordinance No. 494 Amending Chapter 12.16 (Parks, Open Space and Civic Center) of the Moorpark Municipal Code to Establish Prohibitions on Camping, Cooking and Storing Property at the Moorpark Civic Center, Enhancing Camping and Storing of Personal Property Prohibitions in Parks, Enhancing Penalties for Violation of the Civic Center Curfew, and Making a Determination of Exemption Under the California Environmental Quality Act. Mr. Ennis read the title of Ordinance No. 494. AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING CHAPTER 12.16 (PARKS, OPEN SPACE AND CIVIC CENTER) OF THE MOORPARK MUNICIPAL CODE TO ESTABLISH PROHIBITIONS ON CAMPING, COOKING AND STORING PROPERTY AT THE MOORPARK CIVIC CENTER, ENHANCING CAMPING AND STORING OF PERSONAL PROPERTY PROHIBITIONS IN PARKS, ENHANCING PENALTIES FOR VIOLATION OF THE CIVIC CENTER CURFEW, AND MAKING A DETERMINATION OF EXEMPTION UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT MOTION: Councilmember Enegren moved and Councilmember Pollock seconded a motion to adopt Ordinance No. 494. The motion carried by unanimous voice vote. D. Consider Ordinance No. 495 Repealing and Replacing Chapter 8.36, Solid Waste, of Title 8, Health and Safety, of the Moorpark Municipal Code, and Approving a California Environmental Quality Act Exemption in Connection Therewith. The motion carried by unanimous voice vote. 12. CLOSED SESSION: Mr. Brown requested the Council go into closed session for discussion of Item 12.A. on the agenda. The Council reconvened into open session at 7:25 p.m. Mr. Brown stated Item 12.A. was discussed and there was no action to report. 13.
