SUBJECT: Consider Removal of Library Board Member for Failure to Complete
AB 1234 Ethics Training in Violation of City Council Policy 2.4 and
Direct Staff to Initiate a Recruitment to Fill an Unscheduled Vacancy
SUMMARY
Adopted City Council Policy 2.4 requires all members of City legislative bodies, as defined
in Government Code Section 54952, to attend two (2) hours of ethics training within twelve
(12) months of assuming office and every two (2) years thereafter, as required by
Government Code Section 53235 et seq., adopted by Assembly Bill (AB) 1234 effective
January 1, 2006. Library Board Member Michael Marshall has not completed the required
training and additionally, has missed the last two meetings of the Moorpark Library Board.
DISCUSSION
The Moorpark Library Board is comprised of five (5) members appointed by the City
Council to serve three-years terms pursuant to California Education Code Section 18910 et
seq. Library Board Member Michael Marshall was appointed by the Mayor on June 17,
2020, to a term ending June 30, 2023.
Every two years, an ethics training session typically provided by the City Attorney’s Office is
scheduled for attendance by the City’s legislative body members and management staff.
Due to the COVID-19 pandemic, in-person training was delayed until November at which
time two in-person training sessions were scheduled on November 22 and November 29,
2021. Two different online training options were also provided for those who were unable
to attend an in-person training session, one through Richards Watson Gershon (City
Attorney’s Office) and one through the Fair Political Practices Commission.
As part of scheduling this training, Board Member Marshall was contacted by email on
several occasions but did not respond to participate in the in-person training opportunities.
Following the in-person sessions, staff reached out to Board Member Marshall via email
and via telephone to request that he complete one of the online training courses and

provide his Proof of Participation to the City Clerk’s Office. Electronic communications and
voice messages did not receive a response.
Additional attempts to contact Board Member Marshall via email and telephone took place
in mid and late December to provide further opportunities to fulfill this requirement. On
January 7, 2022, a letter was mailed to his home address advising of the outstanding
requirement and requesting immediate completion of the ethics training course. To date,
no response has been received.
At this time, staff requests Council consideration for removal of Library Board Member
Marshall for failure to complete the state-mandated ethics training in violation of City
Council Policy 2.4, and to direct staff to initiate a recruitment to fill the unscheduled vacancy
which will conclude on June 30, 2023.
FISCAL IMPACT
Aside from staff time associated with recruitment to fill an unscheduled vacancy, there is no
direct fiscal impact associated with this action.
COUNCIL GOAL COMPLIANCE
This action does not support a current strategic directive.
STAFF RECOMMENDATION
Consider removal of Library Board Member Michael Marshall for failure to complete
AB 1234 Ethics Training in compliance with City Council Policy 2.4 and direct staff to initiate
a recruitment to fill an unscheduled vacancy.
