MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Carlene Saxton, Community Development Director DATE: 02/16/2022 Regular Meeting SUBJECT: Consider the Re-Establishment of an Ad Hoc Committee to Continue the Negotiation of the Terms of the Development Agreement between the City and the John C. Chiu Family Limited Partnership for the Everett Street Terrace Project BACKGROUND On December 5, 2005, an application was submitted for Residential Planned Development No. 2005-02, Tentative Tract Map 5739, General Plan Amendment No. 2005-02, and Zone Change No. 2005-02, requesting approval for construction of a 60-unit residential building on 2.4 acres of vacant property, located at the northeast corner of Everett Street and Walnu t Canyon Road on an application of Dr. John Chui. This project is known as Everett Street Terrace. On September 19, 2007, an initial Ad Hoc Committee was formed for the review of the Development Agreement (DA), which included prior Council Members Van Dam and Millhouse. On December 7, 2016, Council Member Simons replaced prior Council Member Millhouse. On December 5, 2018, Council Member Enegren replaced prior Council Member Van Dam. Therefore, the latest assignment of an Ad Hoc Committee for the project included Councilmembers Enegren and Simons. Councilmember Simons is no longer a member of the City Council and therefore appointment of a new Ad Hoc Committee is requested to see the project through to resolution. The work of the past Ad Hoc Committee has been completed. Therefore, a new Ad Hoc Committee is now requested to address the current project. Over the course of the project’s review, several revisions have been submitted to the City. On March 30, 2016, a revised application was resubmitted, which includes the current project scope. In 2019, it was determined that the latest revisions to the project required additional and revised entitlements and amendments to the General Plan, Downtown Specific Plan and Zoning Map. As such, expanded review was necessary to comply with the California Environmental Quality Act (CEQA). In July 2020, the City initiated a revised CEQA review of the project, including a technical review of reports and project scope. An earlier Draft Mitigated Negative Declaration (MND) was prepared in 2018, which did not address all aspects of the project and required entitlements. The Item: 9.F. 829 Honorable City Council 02/16/2022 Regular Meeting Page 2 City is currently working to prepare an updated Initial Study and expects to circulate a Draft MND in the late Spring of 2022. The proposed project requires a general plan amendment and zone change. Pursuant to Section 65864 of the Government Code of the State of California a Development Agreement (DA) may be entered into by the City and the Applicant to provide assurances to both parties regarding public improvements and costs associated with the development. Within the City of Moorpark, DAs are negotiated with two Councilmembers, city staff and the applicant. City staff and Council set the param eters regarding the negotiations and terms of the DA with the applicants. In order, to move forward into the DA negotiations, staff is requesting that the City Council identify two members to serve on an ad hoc committee to negotiate the terms of the DA f or the Everett Street Terrace Project. Below is a list of the current Ad Hoc Committee assignments. COUNCIL GOAL COMPLIANCE This action supports City Council Goal 1 to “Identify Options and Solutions to Barriers for Housing for All Economic and Age Ranges.” STAFF RECOMMENDATION Select two members of the City Council to participate on the Ad Hoc Committee for the Everett Street Terrace Project.
