A.Second Reading Ordinance No. 500 Redrawing City Council Voting District Boundaries following the 2020 Decennial Census, Adopting a New Official Council District Map to Implement the Redrawn District Boundaries, Amending Chapter 2.08 (“Municipal Elections”) of the Moorpark Municipal Code to make Corresponding Changes, and Making a Determination of Exemption Pursuant to the California Environmental Quality Act. Staff Recommendation: Waive full reading, declare Ordinance No. 500 read for the second time, and adopted as read. (ROLL CALL VOTE REQUIRED) Item: 11.A. ORDINANCE NO. 500 AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, REDRAWING CITY COUNCIL VOTING DISTRICT BOUNDARIES FOLLOWING THE 2020 DECENNIAL CENSUS, ADOPTING A NEW OFFICIAL COUNCIL DISTRICT MAP TO IMPLEMENT THE REDRAWN DISTRICT BOUNDARIES, AMENDING CHAPTER 2.08 (“MUNICIPAL ELECTIONS”) OF THE MOORPARK MUNICIPAL CODE TO MAKE CORRESPONDING CHANGES, AND MAKING A DETERMINATION OF EXEMPTION PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, on April 19, 2019, the City Council of the City of Moorpark adopted Ordinance No. 467 transitioning from an at-large election system to a by-district election system for electing City Councilmembers; and WHEREAS Ordinance No. 467 created four (4) City Council voting districts, established a sequence of elections for the election of City Councilmembers to four-year terms, and maintained a directly-elected Mayor with a two-year term of office, with by-district elections commencing with the November 3, 2020, general municipal election; and WHEREAS, California Elections Code Section 21601 and Moorpark Municipal Code Section 2.08.060 requires that following each decennial federal census, and using that census as a basis, the City Council shall, by ordinance and in compliance with the United States and California Constitutions and the federal Voting Rights Act of 1965 (52 U.S.C. Section 10301 et seq.), adjust the boundaries of any or all of the council districts of the city so that the districts are substantially equal in population; and WHEREAS, on September 27, 2021, the California Statewide Database provided the City of Moorpark with an official population of 36,326 residents; and WHEREAS, on October 20, 2021, the City Council held a public hearing pursuant to California Elections Code Section 21607.1(a) where the public was invited to provide input regarding the composition of council districts; and WHEREAS, on December 1, 2021, the City Council held a public hearing pursuant to California Elections Code Section 21607.1(a) where the public was invited to provide additional input regarding the composition of council districts; and WHEREAS, on January 5, 2022, the City Council held a public hearing pursuant to California Elections Code Section 21607.1(a) where the public was again invited to provide input regarding the composition of council districts and proposed boundary maps alternatives prepared by the City’s retained demographer, National Demographics Corporation, Inc. (NDC), and the City Council selected its preferred alternative map titled “NDC Yellow Map” depicted in Exhibit “A” of this Ordinance and incorporated herein by Item: 11.A. 1155 Ordinance No. 500 Page 2 this reference. Demographic data supporting this map is also attached hereto as Exhibit “A”; and WHEREAS, in accordance with Elections Code Section 21607.1(a), the City Council held a fourth, duly noticed public hearing regarding the alternative Council District Maps on February 2, 2022, and after closing the public hearing, selected the map titled “Yellow Map,” depicted in Exhibit “A” as the Official Council District Map for the City of Moorpark and introduced this Ordinance for first reading. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The map entitled “Moorpark Redistricting 2022 Yellow Map” attached hereto as Exhibit “A” to this Ordinance and incorporated herein by this reference is hereby approved and adopted as the Official Council District Map for the City of Moorpark. SECTION 2. Section 2.08.030 of the Moorpark Municipal Code is hereby amended to replace the map denoted as “City of Moorpark 2019 Districting, Map 401b” with the map attached hereto as Exhibit “A” and denoted as “Moorpark Redistricting 2022 Yellow Map.” SECTION 3. Pursuant to Moorpark Municipal Code Section 2.08.050, the voters in Council Districts 1 and 3 shall elect City Councilmembers from each of those districts at the general municipal election in 2022 and thereafter for full four (4) year terms and the voters in Council Districts 2 and 4 shall elect City Councilmembers from each of those districts at the general municipal election in 2024 and thereafter for full four (4) year terms. The Mayor shall be elected at large for a two (2) year term at the general municipal election in 2022 and thereafter. SECTION 4. Adjusting the district boundaries from which voters elect their City Councilmembers is exempt from review under the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the State CEQA Guidelines because it can be seen with certainty that the change will not have any potentially significant adverse impact on the environment. SECTION 5. This ordinance shall become effective thirty (30) days after its passage and adoption. SECTION 6. If any section, subsection, sentence, clause, phrase, part or portion of this Ordinance is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase, part or portion thereof, irrespective of the fact that any one or more section, subsections, sentences, clauses, phrases, parts or portions be declared invalid or unconstitutional. 1156 Ordinance No. 500 Page 3 SECTION 7. The City Clerk shall certify to the passage and adoption of this ordinance; shall enter the same in the book of original ordinances of said City; shall make a written record of the passage and adoption thereof in the minutes of the proceedings of the City Council at which the same is passed and adopted; and shall publish notice of adoption in the manner required by law.
