MINUTES OF THE CITY COUNCIL AND SUCCESSOR AGENCY OF THE REDEVELOPMENT AGENCY OF THE CITY OF MOORPARK Moorpark, California January 19, 2022 A Regular Meeting of the City Council of the City of Moorpark and the Successor Agency was held on January 19, 2022, in the Council Chambers of said City located at 799 Moorpark Avenue, Moorpark, California. All items listed are heard and acted upon by the City Council unless otherwise noted. 1. CALL TO ORDER: Mayor Parvin called the meeting to order at 7:01 p.m. 2. PLEDGE OF ALLEGIANCE: Councilmember Groff led the Pledge of Allegiance. 3. ROLL CALL: Present: Councilmembers Castro (via Zoom), Enegren, Groff, Pollock, and Mayor Parvin. PROCLAMATIONS AND COMMENDATIONS: A. Proclamation Recognizing the Health for Humanity Yogathon from January 15 to January 30, 2022, Organized by Hindu Swayamsevak Sangh USA. ANNOUNCEMENTS, FUTURE AGENDA ITEMS, AND REPORTS ON MEETINGS/CONFERENCES ATTENDED BY COUNCILMEMBERS AND MAYOR: Councilmember Pollock reported on January 6 he attended the Southern California Association of Governments (SCAG) Regional Council meeting where they took the position, by a split vote, to endorse the initiative to make local land use decisions preeminent and overriding any state law on land use which is in the signature gathering stages. He noted the League of California Cities Board took a no position on the initiative. Councilmember Pollock reported on January 10 he participated in a meeting to of the SCAG Host Committee which is responsible for planning the Regional Conference in Palm Desert in May. Councilmember Pollock reported on January 11 he participated in a meeting of the Ventura County Air Pollution Control District Board, noting routine business was conducted with no action to report. Councilmember Pollock reported on January 13-14 he participated in a League of California Cities Governance Task Force where they made recommendations on how the League can improve on governance. Councilmember Pollock reported on January 13 he attended the initial meeting of the Environmental Quality Policy Committee for the League of California Cities, which he is chairing this year. He noted there are 65 members of diverse areas on the committee. Councilmember Pollock reported on January 18 he attended a meeting of the SCAG Legislative Committee which is are gearing up for year two of the legislative session and being engaged on the two year bills that will be coming back, and noted that Assemblymember Irwin will seek reelection and State Senator Stern will be running for Los Angeles City Council. Councilmember Castro indicated he had nothing to report at this meeting. Mayor Parvin announced the Moorpark City Council is accepting applications for appointment to two positions and one alternate to the Citizens Transportation Advisory Committee (CTAC). CTAC meets the four times per year in January, 76 Minutes of the City Council/Successor Agency Moorpark, California Page 3 January 19, 2022 April, June, and September on the second Tuesday of each month at 1:30 p.m. at the Government Center in Ventura. Mayor Parvin announced the Moorpark City Council is also accepting applications for appointment as a Commissioner to the Area Housing Authority of the County of Ventura. The appointment will be for a 19-month term through August 31, 2023, to complete the remainder of a four-year term, created due to an unscheduled vacancy. The Board of Commissioners is responsible for the Area Housing Authority’s policies, finances and operations and its primary mandate is to provide decent and affordable housing accommodations for very low income families, elderly, handicapped, and disabled individuals. Commissioners receive a $50.00 stipend from the Area Housing Authority for each Board meeting they attend up to a maximum of $200.00 per month. Commissioners are paid mileage to attend meetings. Mayor Parvin reported on January 6 she participated in the Clean Power Alliance board meeting via Zoom. Mayor Parvin reported on January 6 she participated in the installation ceremony for the Conejo Simi Moorpark Association of REALTORS® via Zoom. Mayor Parvin reported on January 7 she chaired the City Selection Committee meeting via Zoom where representatives for the Fox Canyon Groundwater Management Agency and the Local Agency Formation Commission were selected. Mayor Parvin reported on January 10 she met with representatives from Broad Reach Power to discuss a battery storage facility in Moorpark. Mayor Parvin reported on January 12 she attended the Simi Valley Police Chief’s luncheon. Mayor Parvin reported she participated in discussion regarding 5G facilities with Moorpark residents and staff via Zoom. Mayor Parvin reported on January 13 she participated in a Ventura Council of Governments (VCOG) meeting via Zoom. 77 Minutes of the City Council/Successor Agency Moorpark, California Page 4 January 19, 2022 8. PUBLIC HEARINGS: None. 9. PRESENTATION/ACTION/DISCUSSION: A. Consider Draft 2021-2029 General Plan Housing Element and Authorize Staff to Forward the Draft to the California Department of Housing and Community Development for Review and Comment. Staff Recommendation: Consider the Draft 2021-2029 General Plan Housing Element (Housing Element) and authorize staff to forward the Draft to HCD for review and comment. Mr. Spondello introduced the staff report and noted staff has a list of minor grammatical and spelling errors as well as a reference to the City of San Dimas which will be corrected by staff. Mr. Mark Hoffmann and Mr. Woodie Tescher with Placeworks Inc. were also in attendance. Mr. Hoffman provided a PowerPoint presentation to present the draft housing element covering areas including a background of a Housing Element, Regional Housing Needs Assessment, outreach and engagement, housing goals, and next steps. A discussion and questions among the Councilmembers, staff and the consultant focused on: 1) where density will need to be added to land uses to achieve the Regional Housing Needs Assessment (RHNA) numbers which Mr. Spondello noted none are needed at this time; 2) keeping the Census data consistent in the Housing Element and incorporating the 2020 Census data as it becomes available to ensure the City’s data is accurately reflected in the 2020 Census and using current, available statistics of our County, local school district and colleges; 3) the Housing Element is being responsive to local conditions and needs of the community; 4) in the elements in table 4-32, encompassing programs 1, 5, and 14, are thoughtful with regard to addressing affordability and density. In Program 22, specific to childcare, will be subsumed by a broader goal as these are needs that arise under different circumstances; 5) in tables 4-23 and 4-33 be mindful about access to parking when concentrated density is built; 6) the Housing Element will implement the RHNA over the next eight-year period and projects anticipated growth, and the Land Use Element will look future development, and will work with the Housing Element to set the densities over a longer horizon; 7) looking into housing rehabilitation and grant programs to help with rehabilitation efforts. Linda Braunschweiger, CEO for the Housing Trust Fund Ventura County and the Housing Land Trust Fund Ventura County and the Vice Chair of House Farm Workers group, spoke noting they have submitted comments multiple times in the past to the City, and about the Housing Trust Fund Ventura County, an independent 501c(3), which provides funding for 78 Minutes of the City Council/Successor Agency Moorpark, California Page 5 January 19, 2022 affordable housing and housing trust funds. She requested the language in the Housing Element be clarified so that the it is clear a Housing Trust Fund exists. MOTION: Mayor Parvin moved and Councilmember Pollock seconded a motion to consider the Draft 2021-2029 General Plan Housing Element (Housing Element) and authorized staff to forward the Draft to HCD for review and comment The motion carried by unanimous roll call vote. 10. CONSENT CALENDAR MOTION: Councilmember Pollock moved and Councilmember Groff seconded a motion to approve the Consent Calendar. The motion carried by unanimous roll call vote. A. Consider Warrant Register for Fiscal Year 2021/22 – January 19, 2022. Staff Recommendation: Approve the warrant register. B. Consider Minutes of Regular City Council/Successor Agency Meeting of November 17, 2021. Staff Recommendation: Approve the minutes. C. Consider Minutes of Regular City Council/Successor Agency Meeting of December 1, 2021. Staff Recommendation: Approve the minutes. D. Consider Annual Comprehensive Financial Report (ACFR) and Other Audit Reports for Fiscal Year Ended (FYE) June 30, 2021. Staff Recommendation: Accept the Annual Comprehensive Financial Report (ACFR), Independent Auditor’s Report on Internal Control Over Financial Reporting and on Compliance and Other Matters Based on an Audit of Financial Statements Performed in Accordance with Government Auditing Standards, Independent Accountant’s Report on Agreed-Upon Procedures Applied to Appropriations Limit Worksheets, Independent Auditor’s memo regarding significant audit findings and other matters, and Housing Successor Fund Financial Statements for the FYE June 30, 2021, and receive and file this report. (ROLL CALL VOTE REQUIRED) E. Consider Resolution Amending the Authorization of Investment of City Monies in the Local Agency Investment Fund and Rescinding Resolution No. 2021- 4026. Staff Recommendation: Adopt Resolution No. 2022-4063 Amending the Authorization of Investment of City Monies in the Local Agency Investment Fund and Rescinding Resolution No. 2021-4026. (ROLL CALL VOTE REQUIRED) F. Consider Resolutions to Initiate Proceedings Related to the Citywide Landscape and Lighting Maintenance Assessment Districts and the Parks and Recreation Maintenance Improvement District for Fiscal Year 2022/23. Consider Amendments to Agreements with Venco Western, Inc. for Landscape Maintenance Services for Parks, and Citywide Zones, Zones of Benefit 1-11, 14, 16, 18, and 21 and Miscellaneous City Properties, and Resolution Amending the Budget for Fiscal Year (FY) 2021/22 Appropriating $91,977.02 from Various Funds to Fund the Landscape Maintenance Services. Staff Recommendation: 1) Approve Amendment No. 6 to Agreement with Venco Western, Inc. for landscape maintenance services for parks, increasing the compensation for services by $51,167.10, for a total contract value of $1,848,203.35, and authorize the City Manager to sign the Amendment, subject to fina l language approval of the City Manager; 2) Approve Amendment No. 6 to Agreement with Venco Western, Inc. for landscape maintenance services for Citywide Zones, Zones of Benefit 1-11, 14, 16, 18, and 21 and Miscellaneous City Properties, increasing the compensation for services by $40,809.92, for a total contract value of $1,315,327.34, and authorize the City Manager to sign the Amendment, subject to final language approval of the City Manager; and 3) Adopt Resolution No. 2022-4066 amending the Fiscal Year 21/22 Budget to fund additional costs of landscape maintenance services for Parks and for Citywide Zones, Zones of Benefit 1-11 and 14, and Miscellaneous City Properties. (ROLL CALL VOTE REQUIRED) H. Consider Award of Agreement to BPG CA, LLC DBA JW Professional Services for Janitorial Services at Various City Facilities and Parks and Resolution Amending the Fiscal Year 2021/22 Budget by Allocating $13,000 from the General Fund (1000) to Fund Janitorial Services at City Hall, Active Adult Center, and Community Center. Staff Recommendation: 1) Award an Agreement to BPG CA, LLC dba JW Professional Services for janitorial services at various City facilities and parks in the amount of $120,806 for the current pro-rated contract term, with one optional one-year extension for an annual contract value of $227,261 for a total contract value over 17 months of $348,067 and authorize the City Manager to execute the Agreement, subject to final language approval of the City Manager; and 2) Adopt Resolution No. 2022-4067, amending the Fiscal Year 21/22 budget by allocating $13,620 from the General Fund (1000) to fund janitorial services at the Active Adult Center, City Hall, and Community Center.
