HomeMy WebLinkAboutRES CC 2022 4087 2022 0504RESOLUTION NO. 2022-4087 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, TERMINATING THE PROCLAMATION OF LOCAL EMERGENCY RELATED TO COVID-19, ALL EMERGENCY ORDERS IMPOSED THEREUNDER, AND TERMINATING RESOLUTION NO. 2020-3896 WHEREAS, in December 2019, an outbreak of coronavirus disease 2019 (COVID-19) caused by the 2019 novel coronavirus (SARS-CoV-2) began in Wuhan, Hubei Province China, and then spread throughout China and to numerous other countries and territories, including the United States; and WHEREAS, in March of 2020, in response to the spread of COVID-19 the President of the United States of America declared a national state of emergency, the Ventura County Public Health Officer declared a countywide health emergency, and the Governor for the State of California proclaimed a statewide state of emergency; and WHEREAS, on March 13, 2020, based upon the national, state, and county declarations of emergency in response to the spread of COVID-19, and following the notification of an outbreak and person-to-person transmission of COVID-19 in Ventura County, the Director of Emergency Services for the City of Moorpark determined pursuant to Moorpark Municipal Code Sections 2.48.060 and 2.48.090 that COVID-19 presented an actual and threatened condition of extreme peril to the safety of persons within the City, and he proclaimed the existence of a local emergency; and WHEREAS, on March 18, 2020, the City Council adopted Resolution No. 2020- 3896 Ratifying the Proclamation of the Director of Emergency Services Concerning the Existence of a Local Emergency; and WHEREAS, on April 8, 2020, the City Council adopted Resolution No. 2020-3897 cancelling all regular City Council, Board and Commission meetings and closing certain parks and recreational facilities; and WHEREAS, on April 8, 2020, the City Council adopted Resolution No. 2020-3898 to temporarily suspending certain noise prohibitions for designated food establishments; and WHEREAS, on June 3, 2020, the City Council adopted Resolution No. 2020-3911 authorizing acceptance of telephonic credit cards for certain transactions in the Community Development and Public Works Departments, for which a permanent City Council Policy change was adopted on February 16, 2022; and WHEREAS, on June 3, 2020, the City Council adopted Resolution No. 2020-3912 authorizing restaurants to conduct outdoor dining with the issuance of a Zoning Clearance and suspended conflicting provisions of the Moorpark Zoning Code. This Resolution was extended twice for one-year terms with Resolution No. 2020-3942 adopted on September 2, 2020, and Resolution No. 2021-4012 adopted on June 16, 2021; and Resolution No. 2022-4087 Page 2 WHEREAS, on June 17, 2020, the City Council adopted Resolution No. 2020-3932 establishing a conditional and short-term extension of emergency regulations related to residential and tenant evictions; and WHEREAS, on October 21, 2020, the City Council adopted Resolution No. 2020- 3952 authorizing a reduction in hourly rental fees for outdoor public facilities and suspending conflicting municipal law; and WHEREAS, throughout the COVID-19 pandemic, the City has balanced its response to the public health threat created by pandemic with the need for ongoing local government operations and collaborated with Ventura County, the State of California and the Federal Government, as appropriate, to obtain resources and sustainably align its services with the continuously evolving public health needs. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council hereby finds that the actual and threatened condition of extreme peril to the safety of persons within the City of Moorpark due to the spread of COVID-19 no longer exists. On this basis, the City Council hereby terminates the proclamation of local emergency ratified by Resolution No. 2020-3896, effective immediately. SECTION 2. All unexpired emergency orders issued by the Director of Disaster Services, and ratified by the City Council, based upon the now terminated proclamation of local emergency are likewise terminated, effective immediately. SECTION 3. Nothing contained herein shall constitute a waiver of any violation of a rule or regulation established by an emergency order that was in effect prior to the adoption of this Resolution. SECTION 4. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
