City Clerk to file the Notice of Completion with the Ventura County Recorder’s
Office; and 2) Authorize the City Clerk to release the Faithful Performance and
Material Suppliers and Laborers Bond, Bond No. RCB0031252, one year after the

SUBJECT: Consider the Notice of Completion for the 2021 Sidewalk
Rehabilitation Project (CIP Project No. M0050) Specification No. MPK
21-01 and Authorization for Release of Project Bonds in Accordance
with the Contract Provisions
BACKGROUND
On April 29, 2020, the City Council authorized staff to allocate remaining funds
associated with the Tax Allocation Bond issued in 2006 to undertake Capital
Improvement Projects that benefit the former Redevelopment Agency Project Area.
One of the approved and appropriated project allocations was in the amount of
$273,324 for sidewalk rehabilitation within the RDA Project Area. On September 1,
2021, the City Council awarded a construction contract to F.S. Contractors, Inc. in the
amount of $220,001.00, plus a 10% project contingency amount of $22,000.10, for a
total contract amount of $242,001.10.
The Plans and Specifications for the 2021 Sidewalk Rehabilitation Project originally
proposed 14,000 square feet of sidewalk replacement. Because the total contract
award amount, including the 10% contingency amount, is less than the appropriated
project allocations, staff determined that additional sidewalk replacement can be
performed. On November 1, 2021, the City Council approved Amendment No. 1 to the
construction contract for a total amount of $272,270.90 to increase the total quantity of
sidewalk replacement.
Staff issued a Notice to Proceed with an effective start date of November 1, 2021. The
project was originally scheduled to be completed on January 3, 2022. However, the
project encountered several weather-related delays, and the completion date was
pushed to February 28, 2022.

DISCUSSION
Final inspection for the project is complete and the work performed by F.S. Contractors
Inc. is satisfactory. It is staff’s determination that F.S. Contractors, Inc. has executed
100% of the construction contract and that it is now appropriate for the City Council to
accept the 2021 Sidewalk Rehabilitation Project as complete. In summary, the project
replaced 19,863 square feet of sidewalk within the former Redevelopment Agency
Project Area, including approximately 4,000 square feet along High Street.
As part of this project completion and acceptance, the City Clerk will file a Notice of
Completion with the County Recorder’s Office. If no Stop Work Notices are received
from the sub-contractor(s) and/or materials supplier(s), the retainage will be released
thirty-five (35) days after the date of recordation of the Notice of Completion.
Additionally, in accordance with the contract documents, the Faithful Performance and
Material Suppliers and Laborers Bond, Bond No. RCB0031252 in the amount of
$242,001.10, will be released by the City Clerk’s Office one year after the date of
recordation of the Notice of Completion.
The actual construction cost, based on final quantities and field measurements, is
$262,851.91. The following is a summary of project expenditures.

STAFF RECOMMENDATION
1. Accept completion of the 2021 Sidewalk Rehabilitation Project, (CIP Project No.
M0050) Specification No. MPK 21-01, and authorize the City Clerk to file the
Notice of Completion with the Ventura County Recorder’s Office; and
2. Authorize the City Clerk to release the Faithful Performance and Material
Suppliers and Laborers Bond, Bond No. RCB0031252, one year after the date of
recordation of the Notice of Completion.
