SUBJECT: Consider Resolution Terminating the Proclamation of a Local
Emergency Related to Coronavirus (COVID-19) in the City of
Moorpark
BACKGROUND
On March 18, 2020, the City Council adopted a resolution ratifying the Proclamation of
the Director of Disaster Services concerning the existence of a local emergency
(Resolution No. 2020-3896). The local emergency was required for both public safety
and to engage assistance from county, state, and federal resources. While it is evident
that health risks from Coronavirus disease 2019 (COVID-19) continue and some
protective measures against that risk will need to remain in place, the actual and
threatened condition of extreme peril to the safety of persons within the City of
Moorpark due to spread of COVID-19 no longer exists and there is no need to further
extend the state of local emergency.
DISCUSSION
An outbreak of COVID-19 caused by the novel coronavirus (SARS-CoV-2) began in
Wuhan, Hubei Province, China in December 2019, and has now spread throughout the
world. On March 12, 2020, the Public Health Officer of Ventura County declared a
public health emergency throughout the County of Ventura. On March 4, 2020, the
Governor of California proclaimed that a state of emergency existed in California after
making determinations that: 1) The conditions caused by COVID-19 are likely to require
the combined forces of a mutual aid region or regions to appropriately respond; and
2) Local authority is inadequate to cope with the threat posed by COVID-19.
On March 6, 2020, the Ventura County Department of Public Health reported one
presumptive positive case of COVID-19 in Ventura County. On March 11, 2020, the
Ventura County Department of Public Health reported a second presumptive positive
case of COVID-19 then on March 12, 2020, declared a local health emergency in
Ventura County upon confirming evidence of community-acquired transmission in a
neighboring county. On March 13, 2020, the President of the United States of America

declared a national state of emergency in response to the spread of COVID-19 within
the United States. On March 13, 2020, the City Manager declared a Local Emergency.
The declaration was based upon the Ventura County Department of Public Health
confirming evidence of community-acquired transmission in an adjacent county and
Ventura County and the President of the United States declaring a national state of
emergency.
On March 18, 2020, the City Council adopted a resolution ratifying the declaration of
local emergency (Resolution No. 2020-3896). In addition, the City Council also adopted
resolutions:
• Cancelling all Regular City Council, Board and Commission meetings and
Closing Certain City Parks and Recreation Facilities – Resolution No. 2020-3897
(April 8, 2020)
• Suspending Certain Noise Prohibitions for Designated Food Establishments –
Resolution No. 2020-3898 (April 8, 2020)
• Authorizing Acceptance of Telephonic Credit Cards for Certain Transactions in
the Community Development and Public Works Departments – Resolution No.
2020-3911 (June 3, 2020)
• Authorizing Restaurants to Conduct *Outdoor Dining with Issuance of a Zone
Clearance and Suspending Conflicting Provisions of the Moorpark Zoning
Code – Resolution No. 2020-3912 (June 3, 2020). Extended with Resolution No.
2020-3942 (September 2, 2020) and Resolution No. 2021-4012 (June 16, 2021)
• Extending Emergency Regulations Related to Residential and Tenant Evictions –
Resolution No. 2020-3932 (June 17, 2020)
• Authorizing Reduction Hourly Rental Fees for Outdoor Public Facilities and
Suspending Conflicting Municipal Law – Resolution No. 2020-3952 (October 21,
2020)
*Moving forward, outdoor dining, placed within the public right-of-way, can be achieved by
businesses requesting an encroachment permit through the Public Works Department. Outdoor
dining locations located fully on private property may be retained through a Permit Adjustment
administered through the Community Development department.
For the past two years, the City has balanced the pandemic response with ongoing local
government operations. The City has executed numerous local emergency orders,
periodically shifted to virtual City Council and advisory body meetings, collaborated with
Ventura County to bring vaccine and testing resources to Moorpark, consistently
reported to the City Council on the state of the pandemic in Moorpark, and engaged
staff in their capacity as Disaster Service Workers, among many other activities.

Consistent with state and federal mandates, the City scaled emergency response to
continuously evolving public health needs. The local emergency was required for public
safety to support rapid decision-making in response to a rapidly evolving emergency
situation, and to engage assistance from county, state, and federal resources. All
Emergency Orders that depend on the local emergency will also be terminated by this
action.
Health risks from COVID-19 continue, as evidenced by the emergence of new variants
and continued reliance on health systems. However, at this point in the COVID-19
response, with vaccines, boosters, and testing widely available to the public and
treatment options expanding, staff recommends the City Council end the state of
declared local emergency, and all temporary changes put in place to in response to the
COVID-19 pandemic.
FISCAL IMPACT
There is no fiscal impact associated with adoption of the resolution.
COUNCIL GOAL COMPLIANCE
This action does not support a current strategic directive.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, TERMINATING THE
PROCLAMATION OF LOCAL EMERGENCY RELATED TO
COVID-19, ALL EMERGENCY ORDERS IMPOSED
THEREUNDER, AND TERMINATING RESOLUTION
NO. 2020-3896
WHEREAS, in December 2019, an outbreak of coronavirus disease 2019
(COVID-19) caused by the 2019 novel coronavirus (SARS-CoV-2) began in Wuhan,
Hubei Province China, and then spread throughout China and to numerous other
countries and territories, including the United States; and
WHEREAS, in March of 2020, in response to the spread of COVID-19 the
President of the United States of America declared a national state of emergency, the
Ventura County Public Health Officer declared a countywide health emergency, and the
Governor for the State of California proclaimed a statewide state of emergency; and
WHEREAS, on March 13, 2020, based upon the national, state, and county
declarations of emergency in response to the spread of COVID-19, and following the
notification of an outbreak and person-to-person transmission of COVID-19 in Ventura
County, the Director of Emergency Services for the City of Moorpark determined pursuant
to Moorpark Municipal Code Sections 2.48.060 and 2.48.090 that COVID-19 presented
an actual and threatened condition of extreme peril to the safety of persons within the
City, and he proclaimed the existence of a local emergency; and
WHEREAS, on March 18, 2020, the City Council adopted Resolution No. 2020-
3896 Ratifying the Proclamation of the Director of Emergency Services Concerning the
Existence of a Local Emergency; and
WHEREAS, on April 8, 2020, the City Council adopted Resolution No. 2020-3897
cancelling all regular City Council, Board and Commission meetings and closing certain
parks and recreational facilities; and
WHEREAS, on April 8, 2020, the City Council adopted Resolution No. 2020-3898
to temporarily suspending certain noise prohibitions for designated food establishments;
and
WHEREAS, on June 3, 2020, the City Council adopted Resolution No. 2020-3911
authorizing acceptance of telephonic credit cards for certain transactions in the
Community Development and Public Works Departments, for which a permanent City
Council Policy change was adopted on February 16, 2022; and
WHEREAS, on June 3, 2020, the City Council adopted Resolution No. 2020-3912
authorizing restaurants to conduct outdoor dining with the issuance of a Zoning Clearance
and suspended conflicting provisions of the Moorpark Zoning Code. This Resolution was
extended twice for one-year terms with Resolution No. 2020-3942 adopted on
September 2, 2020, and Resolution No. 2021-4012 adopted on June 16, 2021; and

WHEREAS, on June 17, 2020, the City Council adopted Resolution No. 2020-3932
establishing a conditional and short-term extension of emergency regulations related to
residential and tenant evictions; and
WHEREAS, on October 21, 2020, the City Council adopted Resolution No. 2020-
3952 authorizing a reduction in hourly rental fees for outdoor public facilities and
suspending conflicting municipal law; and
WHEREAS, throughout the COVID-19 pandemic, the City has balanced its
response to the public health threat created by pandemic with the need for ongoing local
government operations and collaborated with Ventura County, the State of California and
the Federal Government, as appropriate, to obtain resources and sustainably align its
services with the continuously evolving public health needs.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council hereby finds that the actual and threatened
condition of extreme peril to the safety of persons within the City of Moorpark due to the
spread of COVID-19 no longer exists. On this basis, the City Council hereby terminates
the proclamation of local emergency ratified by Resolution No. 2020-3896, effective
immediately.
SECTION 2. All unexpired emergency orders issued by the Director of Disaster
Services, and ratified by the City Council, based upon the now terminated proclamation
of local emergency are likewise terminated, effective immediately.
SECTION 3. Nothing contained herein shall constitute a waiver of any violation
of a rule or regulation established by an emergency order that was in effect prior to the
adoption of this Resolution.
SECTION 4. The City Clerk shall certify to the adoption of this resolution and
shall cause a certified resolution to be filed in the book of original resolutions.
