SUBJECT: Consider Resolution Declaring 1063-1123 Walnut Canyon Road (APNs
511-0-030-300, -290, -280, -270, -260, -250) and 1293-1331 Walnut
Canyon Road (APNs 511-0-040-140, -130, -120) Surplus Property
BACKGROUND
The Redevelopment Agency of the City of Moorpark (Redevelopment Agency) acquired
the properties at 1063-1123 Walnut Canyon Road and 1293-1331 Walnut Canyon Road
(Property) over the course of several years between 2007 and 2009 in order to aggregate
a site for provision of affordable housing. The cost to acquire the nine (9) sites and
demolish the structures that existed at the time totaled $3,686,882.
In 2012, the Redevelopment Agency was dissolved and the City elected to become the
Housing Successor Agency to the Redevelopment Agency of the City of Moorpark
(Housing Successor Agency). The Housing Successor Agency is tasked with disposing
of the former Successor Agency housing assets. The Housing Asset Transfer (HAT) list
was approved by the Department of Finance on August 27, 2012. Once the HAT was
approved, all Housing properties were transferred to the City of Moorpark Under
Redevelopment Agency dissolution law, the former housing assets need to be either
developed or sold prior to August 27, 2022. The City of Moorpark has hired the Kosmont
Companies to assist with marketing the site and finding a suitable development partner.
DISCUSSION
The recent enactment of AB 1486 made some changes to the laws that govern surplus
government property. The changes now require all properties owned by a City or
Successor Agency to go through a surplus property process, subject to some exemptions.
Since the properties at 1063-1123 Walnut Canyon Road and 1293-1331 Walnut Canyon
Road are owned by the City in their role as Housing Successor, and there are no active
Exclusive Negotiating Agreements in place, the surplus property laws apply to these
parcels. Staff does have a developer interested in the site, however, in consultation with
the California Department of Housing and Community Development (HCD), it has been
determined that, although the intent of the future sale of the Property is still to provide

some affordable housing on the Property, HCD has opined that the Surplus Land Act
needs to be followed first.
The surplus property process requires the City Council to declare the property as surplus
or surplus exempt property. Once the declaration has been made, staff needs to prepare
a “Notice of Availability” and send it to HCD and all interested housing sponsors who have
submitted a request for notice to HCD. Interested parties have sixty (60) days from the
date of the notice to respond to the City, and the City has ninety (90) days to negotiate a
sale of the property. If the property negotiations do not result in a sale with a housing
sponsor, the City is then free to sell the property to other interested parties.
Therefore, staff has determined that there is no further municipal use for 1063-1123
Walnut Canyon Road and 1293-1331 Walnut Canyon Road and is recommending that
the City Council declare the property as surplus. The Resolution further directs that
pursuant to Section 33334.16 of the Health and Safety Code proceeds from the sale of
affordable housing properties are to be deposited in the Housing Successor Agency Fund
(2123).
FISCAL IMPACT
There is no fiscal impact from declaring the property as surplus.
COUNCIL GOAL COMPLIANCE
This action is consistent with City Council Goal 1, Objective 1.5: “Dispose of applicable
former Moorpark Redevelopment Agency owned properties.”

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, DECLARING 1063-1123
WALNUT CANYON ROAD (APNS 511-0-030-300, -290, -
280, -270, -260, -250) AND 1293-1331 WALNUT CANYON
ROAD (APNS 511-0-040-140, -130, -120) TO BE SURPLUS
PROPERTY IN ACCORDANCE WITH GOVERNMENT
CODE SECTION 54220 ET SEQ.
WHEREAS, between 2007 and 2009, the Redevelopment Agency of the City of
Moorpark purchased the properties at 1063-1123 Walnut Canyon Road and 1293-1331
Walnut Canyon Road (Property) for affordable housing purposes; and
WHEREAS, on February 1, 2012, the Redevelopment Agency of the City of
Moorpark was dissolved, and the City of Moorpark elected to become the Successor
Housing Agency to the Redevelopment Agency of the City of Moorpark (“Housing
Successor”); and
WHEREAS, on August 27, 2012, the City of Moorpark’s Housing Asset Transfer
were approved by the State Department of Finance (DOF); and
WHEREAS, under the Surplus Land Act, Government Code Section 54220 -
54234, surplus property is defined as “land owned in fee simple by any local agency for
which the local agency’s governing body takes formal action in a regular public meeting
declaring that the land is surplus and is not necessary for the agency’s use”; and
WHEREAS, the property has been determined that there is no further need for the
property for municipal uses; and
WHEREAS, pursuant to Section 33334.16 of the Health and Safety Code,
proceeds from the sale of affordable housing properties are to be deposited in the
applicable affordable housing fund.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Finds that the Property at 1063-1123 Walnut Canyon Road and
1293-1331 Walnut Canyon Road is surplus property and that there is no other municipal
use for the property.
SECTION 2. Directing Staff to dispose of the property in accordance with
Government Code Section 54220 et seq.
SECTION 3. Directing staff to deposit any proceeds of the sale of the property to
the Housing Successor Fund (2123); and

SECTION 4. The City Clerk shall certify to the adoption of this resolution and shall
cause a certified resolution to be filed in the book of original resolutions.
