SUBJECT: Consider the Exoneration of Cash Deposit for the Grading and Site
Improvements at 14350 White Sage Road (Fairfield Inn) – Moorpark
Hospitality, Inc.
BACKGROUND
On July 27, 2017, staff issued Grading Permit 262G for grading and site improvements
associated with the development of the Fairfield Inn at 14350 White Sage Road. As
part of permit issuance, a surety is required to ensure that the improvements, as shown
on Moorpark Drawing No. 15-ML-11028, are completed in accordance with the
approved plans and specifications. In lieu of a surety bond, the developer, Moorpark
Hospitality, Inc., provided a cash deposit with the City in the amount of $108,020.33.
DISCUSSION
The grading and site improvements were constructed and accepted by City staff on
June 5, 2020. On October 21, 2020, as part of the City’s acceptance and a warranty
period of one-year for the improvements, the City Council reduced the cash deposit to
10 percent to the amount of $10,802.03. The improvements have performed beyond
the one-year warranty period and staff recommends that the following cash deposit be
exonerated:

RESOLUTION NO. 2022-____
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, EXONERATING THE
CASH DEPOSIT FOR GRADING & IMPROVEMENTS
FOR 14350 WHITE SAGE ROAD, MOORPARK
HOSPITALITY, INC.
WHEREAS, the City Council adopted Resolution No. 2007-2583, approving
Commercial Planned Development Permit No. 2006-01 and Conditional Use Permit No.
2006-07 to allow for the construction and operation of a 112-room hotel on a 2.83-acre
parcel located at 14350 White Sage Road; and
WHEREAS, on July 20, 2017, a Cash Deposit for Grading & Improvements was
provided to the City by Moorpark Hospitality, Inc. in the amount of $108,020.33; and
WHEREAS, on October 21, 2020, the City Council accepted the grading and site
improvements at 14350 White Sage Road and reduced the cash deposit to $10,802.03
(10%); and
WHEREAS, City staff now recommends that the City Council fully exonerate the
Cash Deposit for Grading & Improvements for 14350 White Sage Road.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Moorpark hereby exonerates
Cash Deposit for Grading & Improvements for 14350 White Sage Road.
SECTION 2. The City Clerk shall certify to the adoption of this resolution
and shall cause a certified resolution to be filed in the book of original resolutions.
PASSED AND ADOPTED this 18th day of May, 2022.
