MINUTES OF THE CITY COUNCIL AND SUCCESSOR AGENCY OF THE REDEVELOPMENT AGENCY AND JOINTLY WITH THE DISASTER COUNCIL OF THE CITY OF MOORPARK Moorpark, California April 20, 2022 A Regular Meeting of the City Council of the City of Moorpark and the Successor Agency was held jointly with the Disaster Council on Wednesday, April 20, 2022, at 6:30 p.m. in the Council Chambers of said City located at 799 Moorpark Avenue, Moorpark, California. All items listed are heard and acted upon by the City Council unless otherwise noted. 1.CALL TO ORDER: Mayor Parvin called the meeting to order at 6:30 p.m. 2.PLEDGE OF ALLEGIANCE: Public Works Manager Shaun Kroes led the Pledge of Allegiance. 3.ROLL CALL: Present:Councilmembers Castro, Enegren, Groff, Pollock, and Mayor Parvin. Staff Present: Troy Brown, City Manager; Kevin Ennis, City Attorney; PJ Gagajena, Assistant City Manager and Interim City Treasurer/Finance Director; Jeremy Laurentowski, Parks and Recreation Director; Daniel Kim, City Engineer/Public Works Director; Carlene Saxton, Community Development Director; Leland Baxter, Parks & Facilities Supervisor; Shaun Kroes, Public Works Manager, Mack Douglass, Program Manager; Jessica Sandifer, Community Services Manager; Chris Thompson, Senior Information Systems Administrator; Captain Victor Fazio, Ventura County Sheriff's Office; and Ky Spangler, City Clerk. 4.PROCLAMATIONS AND COMMENDATIONS: A.Introduction of New City Employee, Charan Bhamber, Accountant II, in the Finance Department. Mayor Parvin introduced new City employee, Charan Bhamber, Accountant II in the Finance Department. B.Introduction of New City Employee, Donna Phipps, Account Technician II, in the Finance Department. Item: 10.D. 235 Minutes of the City Council/Successor Agency Moorpark Disaster Council Moorpark, California Page 2 April 20, 2022 Mayor Parvin introduced new City employee, Donna Phipps, Account Technician II, in the Finance Department. C. Proclamation Declaring April 30, 2022, as the City of Moorpark’s Observance of Arbor Day. Mayor Parvin presented a Proclamation to Leland Baxter, Parks & Facilities Supervisor, declaring April 30, 2022, as the City of Moorpark’s Observance of Arbor Day. 5. PUBLIC COMMENT: None. 6. REORDERING OF, AND ADDITIONS TO, THE AGENDA None. 7. ANNOUNCEMENTS, FUTURE AGENDA ITEMS, AND REPORTS ON MEETINGS/CONFERENCES ATTENDED BY COUNCILMEMBERS AND MAYOR: Councilmember Pollock reported on April 7 he attended meetings of the Southern California Association of Governments (SCAG) Energy and Environment Committee and Regional Council. Councilmember Pollock reported on April 11 he attended the League of California Cities Governance Committee meeting in Sacramento where consultant recommendations on structure and by-laws was received and incremental changes are being considered. Councilmember Pollock reported on April 14 he attended a meeting of the Hitch Ranch Ad Hoc Committee to finalize the project’s Disposition and Development Agreement. Councilmember Pollock reported on April 18 he attended a meeting of the SCAG Scholarship Committee where eleven $4,000 scholarships, including two students in Ventura County, were awarded. Councilmember Pollock reported on April 18 he attended SCAG the Regional Advanced Mitigation Planning Advisory Task Group (RAMP-ATG) which is developing the SoCal Greenprint to create regional advanced mitigation plan to deal with mitigating environmental issues before they become a project, such as transportation projects. 236 Minutes of the City Council/Successor Agency Moorpark Disaster Council Moorpark, California Page 3 April 20, 2022 Councilmember Pollock reported on April 19 he attended a meeting of the SCAG Legislative Committee to review bills moving through the legislature and will report on bills of consequence when applicable. Councilmember Enegren reported on April 13 he attended the Ventura County Transportation Commission’s offsite goal setting retreat in Ventura and where goals were developed, and the future of transportation, including zero emission buses, expanded bike lanes, and patterns of transportation changes due to COVID-19 were discussed. Councilmember Enegren reported on April 19 he participated in Career Day via Zoom with a fifth-grade class at Walnut Canyon Elementary School where he discussed process engineering and how products were made, provided a tour of the brewery, and talked about the projects the City Council works on. Councilmember Groff reported on April 13 he attended the Moorpark Chamber of Commerce Board of Directors meeting. Councilmember Groff reported on April 14 he attended a meeting of the Hitch Ranch Ad Hoc Committee. Councilmember Groff reported on April 19 he attended the ribbon cutting for Coaches Ice Cream. Mayor Parvin announced the Princeton Avenue Improvement Project has begun construction. This week, SoCal Gas is working to relocate their gas lines underneath the street, resulting in alternating traffic in one lane from 8:30 a.m. to 4:00 p.m., Monday through Friday. Mayor Parvin announced the City’s Emergency Management is working to schedule in-person CERT training beginning Monday, May 16, 2022. The training will be conducted in conjunction with the Ventura County Fire Department and is expected to last for approximately three hours per session, with one session per week for six weeks. If you are interested in attending this class, please confirm your interest and availability by emailing the City’s Emergency Services Manager directly at mdouglass@moorparkca.gov. Mayor Parvin announced the City's Economic Development Division encourages all Moorpark-based businesses to take the 2022 Business Climate Survey which seeks information on Moorpark's business community needs, current conditions, and business satisfaction. Businesses can take the survey by visiting moorparkca.gov/businessclimatesurvey22. The survey is set to close on April 28. 237 Minutes of the City Council/Successor Agency Moorpark Disaster Council Moorpark, California Page 4 April 20, 2022 Mayor Parvin announced the City Council is currently accepting applications for appointment to the Citizen Transportation Advisory Committee (CTAC) and the Ventura County Area Agency on Aging Advisory Council. If you want to learn more about these appointments, please visit the City’s website for information and the on-line applications at moorparkca.gov/serve. Mayor Parvin announced for the fourth year in a row, the City is participating in the National Mayor’s Challenge for Water Conservation. We continue to have below-normal rainfall for the season, and it is as important to reduce water use. The challenge is an easy way to learn about and be reminded of little things you can do that add up to big water savings. To participate, residents take an online pledge to save water by answering questions that highlight ways to conserve. Moorpark residents are great stewards of the environment. Please visit www.mywaterpledge.com to participate. Mayor Parvin announced Moorpark has a brand new On Demand Ridesharing Service that you can use to travel around town. You can schedule your trip using our new “MCT On Demand” App; by scheduling a trip online, or by calling the reservation phone number at (805) 465-5041. Trips can be scheduled as early as 15 minutes before your requested time of departure or as far out as seven days in advance. The service operates 6:00 a.m. to 6:00 p.m. Monday through Friday. Fare is $1.00 per passenger for the general public or 50 cents for seniors ages 65 or older or individuals with a disability. The City has over 100 stops where you can request our vehicles come and pick you up and drop you off. For more information about the service, including our “virtual stop map” and links to download the scheduling App, please visit moorparkca.gov/mctondemand. You can also call 805-517-6233 for additional information. Mayor Parvin reported on April 9 the Boys & Girls Club held their annual gala. Mayor Parvin reported on April 15 she met with a business representative interested in doing business in Moorpark. Mayor Parvin reported on April 19 she attended the ribbon cutting at Coaches Ice Cream. Mayor Parvin reported on April 20 she attended the Local Agency Formation Commission (LAFCo) meeting where they worked on the LAFCo budget for fiscal year 2022/23. 8.PUBLIC HEARINGS: None. 238 Minutes of the City Council/Successor Agency Moorpark Disaster Council Moorpark, California Page 5 April 20, 2022 9. PRESENTATION/ACTION/DISCUSSION: A. Receive Presentation on the City of Moorpark Capital Improvement Plan Project Status Report. Staff Recommendation: Receive presentation on the Capital Improvement Plan Project Status Report. Mr. Kroes gave the staff report and provided a PowerPoint presentation. Discussion and questions followed among Councilmembers and staff which focused on 1) timing of Council’s receipt and review of architectural designs for the new Library which is expected end of June or beginning of July following a community meeting; and 2) inquiry on the Los Angeles Avenue Undergrounding Project (C0033) shown on the six-month look ahead and confirmation that the is project anticipated to continue on the list as an existing CIP and funding sources are being explored. There were no speakers. CONSENSUS: It was a consensus of the City Council to receive and file the presentation on the Capital Improvement Plan Project Status Report. B. (DISASTER COUNCIL/CITY COUNCIL) Consider Resolution Approving the 2022 City of Moorpark Emergency Operations Plan Update and Rescinding Resolution No. 2014-3312. Staff Recommendation: 1) Disaster Council - Recommend approval of the 2022 City of Moorpark Emergency Operations Plan; and 2) City Council - Adopt Resolution No. 2022-4086, approving the 2022 City of Moorpark EOP, and rescinding Resolution No. 2014-3312, subject to EOP final language approval by the City Manager, and authorize the Mayor to sign a promulgation letter constituting the adoption of the EOP by the City of Moorpark. Mr. Douglass gave the staff report and provided a PowerPoint presentation. A discussion and questions among the Councilmembers and staff focused on: 1) to inquiry on how frequently emergency operations drills are planned it was noted the 2022/23 budget includes funding to train to the plan; and 2) to inquiry on how to keep safe in the event of nuclear issue, it was noted the City does not have a guiding document specific to nuclear disasters however, the EOP referenced the County’s 2011 Nuclear Response Plan and the state and federal maintain plans to deal with nuclear incidents. There were no speakers. 239 Minutes of the City Council/Successor Agency Moorpark Disaster Council Moorpark, California Page 6 April 20, 2022 MOTION: Disaster Council Chair Parvin moved and Disaster Council Member Pollock seconded a motion for the Disaster Council to recommend to the City Council approval of the 2022 City of Moorpark Emergency Operations Plan. The motion carried by unanimous roll call vote. MOTION: Mayor Parvin moved and Councilmember Pollock seconded a motion to adopt Resolution No. 2022-4086, approving the 2022 City of Moorpark EOP, and rescinding Resolution No. 2014-3312, subject to EOP final language approvals by the City Manager, and authorize the Mayor to sign promulgation letter constituting the adoption of the EOP by the City of Moorpark. The motion carried by unanimous roll call vote. 10. CONSENT CALENDAR: (ROLL CALL VOTE REQUIRED) MOTION: Councilmember Enegren moved and Councilmember Groff seconded a motion to approve the Consent Calendar. The motion carried by unanimous roll call vote. A. Consider Warrant Register for Fiscal Year 2021/22 – April 20, 2022. Staff Recommendation: Approve the warrant register. B. Consider Minutes of Regular City Council/Successor Agency Meeting of February 2, 2022. Staff Recommendation: Approve the minutes. C. Consider Waiver of City Purchasing Procedure Pursuant to Moorpark Municipal Code Section 3.04.120 and Consider Service Proposal with FirstNet for Mobile Device Cellular Services. Staff Recommendation: 1) Authorize staff to waive the purchasing procedures set forth in Section 3.04.120 of the Moorpark Municipal Code; and 2) Approve Service Proposal with FirstNet and authorize the City Manager to execute the service in the amount of $54,595.36, subject to final language approval by the City Manager. D. Consider Amendment No. 1 to Agreement with Budlong & Associates, Inc. for Additional Construction Administration Services for Replacement Gas Line and Heating, Ventilation, and Air Conditioning (HVAC) Unit Project at Arroyo Vista Recreation Center and Gym. Staff Recommendation: Approve Amendment No. 1 to Agreement with Budlong & Associates, Inc. and authorize the City Manager to sign the Agreement, subject to final language approval of the City Manager. E. Consider Authorizing City Clerk to Exonerate Bonds for Pacific Polymers, Inc. dba American Foam Experts for Roofing Repair Projects at Civic Center Campus. Staff Recommendation: Authorize the City Clerk to release the project bonds outlined in the report. 240 Minutes of the City Council/Successor Agency Moorpark Disaster Council Moorpark, California Page 7 April 20, 2022 11.ORDINANCES: (ROLL CALL VOTE REQUIRED) None. 12.CLOSED SESSION: Mr. Brown requested the City Council go into closed session for discussion of Item 12.B. only on the agenda. MOTION: Mayor Parvin moved and Councilmember Pollock seconded a motion to adjourn to closed session for discussion of Item 12.B. on the agenda. The motion carried by unanimous voice vote. The time was 7:09 p.m. B.PUBLIC EMPLOYEE PERFORMANCE EVALUATION Pursuant to Paragraph (1) of Subdivision (b) of Government Code Section 54957 Title: City Attorney Present in closed session were Councilmembers Castro, Enegren, Groff, Pollock and Mayor Parvin; Troy Brown, City Manager; and Kevin Ennis, City Attorney. The Council reconvened into open session at 7:43 p.m. Mr. Brown stated Item 12.B. was discussed and there was no action to report. 13.ADJOURNMENT: Mayor Parvin adjourned the meeting at 7:43 p.m. Janice S.
