5751 Condor Drive, Accepting a Dedication / Conveyance of Right-of-
Way in the Same Vicinity, and Making a Determination of Exemption
Pursuant to the California Environmental Quality Act in Connection
Therewith, on the Application of Condor Industrial Building LLC
SUPPLEMENTAL INFORMATION / UPDATED DRAFT RESOLUTION
Staff identified a need for minor revisions to the Draft Resolution following the publication
of the City Council Agenda.
The Draft Resolution has been revised to clarify the resolution title, the language in
Section 2 and Section 3, and the associated labeling of the Vacation and Dedication legal
descriptions and depictions attached to the resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, VACATING A PORTION OF AND
DEDICATING RIGHT-OF-WAY ADJACENT TO 5751 CONDOR
DRIVE, ACCEPTING A DEDICATION / CONVEYANCE OF RIGHT-
OF-WAY IN THE SAME VICINITY, AND MAKING A
DETERMINATION OF EXEMPTION PURSUANT TO THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT IN CONNECTION
THEREWITH, ON THE APPLICATION OF CONDOR INDUSTRIAL
BUILDING LLC
WHEREAS, consideration is being given to the proposed vacation of a portion of
Condor Drive for 5751 Condor Drive and dedication of portions from 5751 Condor Drive;
and
WHEREAS, Special Condition of Approval No. 26 of City Council Resolution No.
2020-3935 required the applicant to provide street dedication and/or easement
documents for consideration to the satisfaction of the City Engineer/Public Works
Director; and
WHEREAS, on March 18, 2022, Condor Industrial Building LLC submitted an
application requesting the vacation and dedication of right-of-way adjacent to 5751
Condor Drive to facilitate development associated with a previously-approved industrial
project; and
WHEREAS, on April 26, 2022, the Planning Commission of the City of Moorpark
adopted Resolution No. PC-2022-668 finding the proposed vacation and dedication of
right-of-way adjacent to 5751 Condor Drive to be in conformance with the Moorpark
General Plan, as required by Section 65402 of the Government Code of the State of
California; and
WHEREAS, on May 18, 2022, the City Council of the City of Moorpark adopted
Resolution No. 2022-4094 declaring its intention to vacate a portion of Condor Drive;
and
WHEREAS, said Resolution set June 15, 2022, at 6:30 p.m. as the date and time
of a public hearing before the City Council, to hear persons interested in or objecting to
the proposed street vacation, said date being at least 15 days subsequent to the date of
the aforesaid Resolution No. 2022-4094; and
WHEREAS, Notice of Public Hearing was duly published as required by Section
8322 of the Streets and Highways Code of the State of California and was published
and posted in the same manner prescribed for the publishing and posting of Resolutions
of the City Council of the City of Moorpark; and

WHEREAS, pursuant to Section 8323 of the Streets and Highways Code of the
State of California, three notices of this street vacation were posted conspicuously along
the line of said street to be vacated, setting forth the passage of the Resolution of
Intention and the time and place of the public hearing on the matter; and
WHEREAS, pursuant to Moorpark Municipal Code Section 17.44.070(A)(3)(a), a
fourth sign was posted along Princeton Avenue as required for the City of Moorpark
public hearing procedures at said property; and
WHEREAS, on June 15, 2022, the City Council held the aforesaid public hearing
and received and considered evidence with respect thereto.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. ENVIRONMENTAL DOCUMENTATION: The City Council, based
on its own independent analysis and judgment, concurs with the Community
Development Director’s determination that the project is categorically exempt from the
requirements of the CEQA pursuant to Section 15306 (Class 5: Minor Alterations in
Land Use Limitations) of the CEQA Guidelines. No further environmental
documentation is needed.
SECTION 2. The City Council hereby makes the following findings related to the
vacation of right-of-way:
A. This street vacation of a portion of the public right-of-way is made pursuant to
Chapter 3, Part 3, Division 9 (Sections 8320 through 8325) of the Streets and
Highways Code of the State of California.
B. The portion of right-of-way along Condor Drive for 5751 Condor Drive to be
vacated is described in Exhibit “‘A”’ of Attachment 1, attached hereto and
made a part hereof.
C. The portion of right-of-way along Condor Drive to be vacated, as described in
Exhibit “‘A”’ of Attachment 1 and depicted in Exhibit “‘B”’ of Attachment 1 is
unnecessary for present or prospective public use.
D. The vacation of the portion of right-of-way along Condor Drive for 5751
Condor Drive as more particularly described in Exhibit “A” of Attachment 1
and shown ondepicted in Exhibit “‘AB” of Attachment 1’, attached hereto and
made a part hereof, is hereby found to be in conformance with the Moorpark
General Plan.
E. Certain existing utilities are located within the aforesaid street segment to be
vacated.

F. It is the intent of the City to assist with the preparation of easement deeds, in
a form acceptable to the owners of those affected utilities, and assist with the
recordation of said easements for the purpose of preserving the rights of said
utility owners to operate and maintain said utilities in place.
SECTION 3. The City Council hereby makes the following findings related to the
dedication of right-of-way:
A. The portions of 5751 Condor Drive to be dedicated are described in Exhibit “A”
of Attachment 2 and depicted in in Exhibit “‘B” of Attachment 2’, attached
hereto and made a part hereof.
B. The right-of-way dedication to the City of Moorpark of portions of 5751 Condor
Drive more particularly described in Exhibit “A” of Attachment 2 and shown
depicted inin Exhibit “B” of Attachment 2‘B’, attached hereto and made a part
hereof, is hereby found to be in conformance with the Moorpark General Plan.
SECTION 4. The street segment to be vacated, as depicteddescribed in Exhibit
“A” of Attachment 1 and depicted in Exhibit “B” of Attachment 1 in (Exhibit ‘A’) is not
required for street purposes and is hereby vacated.
SECTION 5. The vacation of the portion of right-of-way along Condor Drive as
more particularly described in Exhibit “A” of Attachment 1 and depictedshown in Exhibit
“‘BA”’ of Attachment 1, attached hereto is not required for street purposes and is hereby
vacated.
SECTION 6. The Applicant shall cause all necessary easements to be dedicated
and recorded to preserve the rights of utility owners in the portion of right-of-way to be
vacated prior to recordation of this resolution effectuating the street vacation.
SECTION 7. The right-of-way dedication to the City of Moorpark of portions of
5751 Condor Drive more particularly described in Exhibit “A” of Attachment 2 and
shown ondepicted on Exhibit “‘B” of Attachment 2’, attached hereto is hereby adopted,
and appropriate instruments to effectuate that dedication along with a certificate of
acceptance are authorized to be executed by the City Manager.

SECTION 8. The City Clerk shall certify to the adoption of this resolution and
shall cause a certified resolution to be filed in the book of original resolutions.
