HomeMy WebLinkAboutRES CC 2022 4139 2022 1005 RESOLUTION NO. 2022-4139 A RESOLUTION OF THE CITY COUNCIL OF MOORPARK, CALIFORNIA, APPROVING AND ADOPTING THE 2022 VENTURA COUNTY MULTI-JURISDICTIONAL HAZARD MITIGATION PLAN AS REQUIRED BY THE FEDERAL DISASTER MITIGATION ACT OF 2000 AND MAKING A DETERMINATION OF EXEMPTION PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT IN CONNECTION THEREWITH WHEREAS, the Federal Disaster Mitigation Act of 2000 requires local governments to identify risks posed by natural and human-caused disasters, and as a condition of mitigation grant assistance, requires coordinated mitigation planning and implementation efforts; and WHEREAS the City of Moorpark participated with the Ventura County Emergency Planning Council to update the Ventura County Multi-Hazard Mitigation Plan to advance mitigation planning and projects within the County; and WHEREAS, each city, local agency, special district member, and the public as listed in the Plan, has contributed to this planning update and under the direction of the Federal Disaster Mitigation Act of 2000; and WHEREAS, the Ventura County Board of Supervisors adopted the 2022 Ventura County Multi-Hazard Mitigation Plan at a regular meeting held on July 12, 2022; and WHEREAS, consistent with California Government Code Sections 8685.9 and 65302.6, the City Council has incorporated the 2022 Ventura County Multi-Hazard Mitigation Plan, including FEMA revisions, into the Safety Element of the City's General Plan as approved by separate Council resolution on October 5, 2022; and WHEREAS, the Moorpark Disaster Council on October 5, 2022, recommended City Council adoption of the 2022 Ventura County Multi-Hazard Mitigation Plan; and WHEREAS, the City Council of the City of Moorpark agrees to abide by the Disaster Mitigation Act of 2000 guidance and grant guidelines and this Multi-Hazard Mitigation Plan represents compliance with the same; and WHEREAS, the Community Development Director has found General Plan Amendment No. 2022-2 to qualify for a General Rule Exemption from environmental review, in accordance with Section 15061 (b)(3) of California Code of Regulations (CEQA Guidelines). Moorpark's Hazard Mitigation Action Plan Annex to the Ventura County 2022 MHMP would facilitate emergency equipment purchases, upgrades to existing public facilities, educational efforts, communication and landscape maintenance improvements; adoption of the 2022 Multi Hazard Mitigation Plan does not authorize or fund any specific action, and future actions undertaken to implement any portion of the Resolution No. 2022-4139 Page 2 Hazard Mitigation plan action items would be subject to individual review pursuant to CEQA Guidelines. It can be seen with certainty that there is no possibility that adoption of the 2022 Multi Hazard Mitigation Plan may have a significant effect on the environment. Therefore, no further environmental documentation is required. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. ENVIRONMENTAL DOCUMENTATION: The City Council, based on its own independent analysis and judgment, concurs with the Community Development Director's determination that the project is categorically exempt from the requirements of the CEQA pursuant to Section 15301 of the CEQA Guidelines. Moorpark's Mitigation Action Plan Annex to the 2022 Ventura County MHMP would facilitate emergency equipment purchases, upgrades to existing public facilities, educational efforts, communication and landscape maintenance improvements; adoption of the 2022 Multi- Jurisdictional Hazard Mitigation Plan does not authorize or fund any specific action, and future actions undertaken to implement any portion of the Hazard Mitigation plan action items would be subject to individual review pursuant to CEQA Guidelines. It can be seen with certainty that there is no possibility that adoption of the 2022 Multi-Jurisdictional Hazard Mitigation Plan may have a significant effect on the environment. Therefore, no further environmental documentation is required. SECTION 2. In accordance with the federal Disaster Mitigation Act of 2000, the City Council of the City of Moorpark approves and adopts the 2022 Ventura County Multi- Jurisdictional Hazard Mitigation Plan (Exhibit A) incorporated herein by reference, as a regional plan and a guidebook to a more disaster resistant community. SECTION 3. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
