Consider Ordinance Approving the First Amendment to the Development Agreement No. 2018-01 between the City of Moorpark and Daly Group, Inc. and Making a Determination of Exemption Pursuant to the California Environmental Quality Act in Connection Therewith. Staff Recommendation: 1) Open the public hearing, receive public testimony and close the public hearing; and 2) Introduce Ordinance No. , approving the First Amendment to Development Agreement No. 2018-01 for first reading, waive full reading, and place this ordinance on the agenda for October 19, 2022, for purposes of providing second reading and adoption of the ordinance. Planning Commission Recommendation: 1) Open the public hearing, receive public testimony and close the public hearing; and 2) Adopt Resolution No. 2022- , approving General Plan Amendment No. 2022-02, which includes the 2022 Ventura County Multi-Jurisdictional Hazard Mitigation Plan as part of the General Plan Safety Element. Hovnanian at Meridian Hills, LLC (Formerly West Pointe Homes and William Lyon Homes Inc.). Staff Recommendation: 1) Accept the Community Development Director's report and recommendation that, on the basis of substantial evidence, that Resmark Equity Partners, LLC and K. Hovnanian at Meridian Hills, LLC have complied in good faith with the terms and conditions of the Agreement; and 2) Deem the annual review process for this project complete with no further annual review necessary.
