MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Mackenzie Douglass, Program Manager DATE: 10/05/2022 Regular Meeting SUBJECT: Consider Resolution Approving General Plan Amendment No. 2022-02 to Include the 2022 Ventura County Multi-Jurisdictional Hazard Mitigation Plan as Part of the General Plan Safety Element and a Determination of Exemption from the California Environmental Quality Act in Association Therewith BACKGROUND On September 21, 2016, the City Council adopted Resolution No. 2016-3541, directing the Planning Commission to study and provide a recommendation to the City Council on a General Plan Amendment to incorporate the 2015 Ventura County Multi-Jurisdictional Hazard Mitigation Plan (MHMP) into the Safety Element of the City’s General Plan. Subsequently, the Planning Commission recommended adoption of such an amendment, and the City Council duly adopted Resolution No. 2016-3556 approving General Plan Amendment No. 2016-02 on November 16, 2016. Since 2016, Ventura County has prepared an update to the 2015 Multi-Hazard Mitigation Plan, which was adopted by the County Board of Supervisors as the 2022 Multi- Jurisdictional Hazard Mitigation Plan on July 12, 2022. Both volumes of the Plan have been made available to the public via www.readyventuracounty.org and on the City’s Emergency Management Division webpage. In order to incorporate this updated 2022 MHMP into the General Plan’s Safety Element in place of the 2015 MHMP, City Council must adopt a new Resolution amending the General Plan. On September 27, 2022, the Planning Commission held a public hearing on proposed General Plan Amendment No. 2022-02. No members of the public spoke on the proposal. Subsequently, the Planning Commission adopted Resolution No. PC-2022-676, recommending approval of General Plan Amendment No. 2022-02. Item: 8.B. 65 Honorable City Council 10/05/2022 Regular Meeting Page 2 DISCUSSION This public hearing item is for the City Council to consider approval of General Plan Amendment No. 2022-02 to include the 2022 Ventura County MHMP as part of the General Plan’s Safety Element, and in so doing, replace the 2015 Venture County MHMP as part of the Safety Element. On July 12, 2022, the Ventura County Board of Supervisors adopted the 2022 MHMP (Attachment, Exhibit A), which covers all 10 cities within Ventura County, as well as County unincorporated areas. The plan has been prepared to address federal requirements under the Disaster Mitigation Act of 2000. In general, the Disaster Mitigation Act encourages close coordination between local, state and federal agencies in the area of disaster mitigation planning. The MHMP addresses hazards such as climate change, dam failures, drought, earthquakes, flood, landslides, levee failures, tsunami, wildfire, and severe storms. Volume 1 of the plan addresses area wide hazards for Ventura County, while Volume 2 contains jurisdiction specific annexes for all 10 Ventura County cities, California State Channel Islands, and 13 additional special districts. Similar to the development process for the City’s General Plan and Emergency Operations Plan, significant efforts were made to incorporate public input during the formulation of the 2022 MHMP. These efforts included an online survey and a series of public workshops, where draft versions of the Plan were presented for public discussion and comment. Responses from Moorpark residents noted particular public concern regarding hazards such as wildfire, earthquake, and severe storms/wind events. These concerns are reflected in mitigation action items outlined in the Moorpark jurisdiction- specific annex in Volume 2 of the 2022 MHMP. Section 8685.9 of the Government Code limits State assistance on eligible projects as part of the California Disaster Assistance Act to no more than 75% of total state eligible costs, unless the local jurisdiction has adopted a hazard mitigation plan in accordance with the federal Disaster Mitigation Act of 2000 as a part of the Safety Element of its General Plan. If adopted with the Safety Element, the Legislature may provide for a state share of local costs that exceeds the 75% limit on total state eligible costs. The draft City Council Resolution proposes to amend the General Plan by including the 2022 Ventura County MHMP update as part of the Safety Element. This action will cause the 2022 MHMP to supersede and replace the 2015 version of the MHMP within the Safety Element. 66 Honorable City Council 10/05/2022 Regular Meeting Page 3 Changes from 2015 Multi Hazard Mitigation Plan The 2022 MHMP identifies a total of 10 hazard mitigation action items that apply to the City of Moorpark, including four items that have been carried forward from the 2015 MHMP (Volume 2, page 4-14). At least one of the action items identified in the MHMP will become irrelevant when the City occupies the new City Hall facility. Other mitigation action plan items address local needs including the provision of adequate backup power for critical facilities, drainage infrastructure, and retrofitting of structures located in hazard areas. Action MPK-2 highlights the need to integrate the 2022 MHMP into the City’s General Plan Safety Element. The Moorpark jurisdiction-specific annex contained in Volume 2 of the 2022 MHMP identifies ten action items, which are as follows: o Action MPK-1: Where appropriate, support retrofitting, purchase, or relocation of structures located in hazard areas, prioritizing those that have experienced repetitive losses and/or are located in high- or medium-risk hazard areas. This item has been carried forward from the 2015 MHMP. o Action MPK-2: Integrate the hazard mitigation plan into other plans, ordinances and programs that dictate land use decisions in the community, including the City’s Emergency Operations Plan and General Plan. This item has been carried forward from the 2015 MHMP. o Action MPK-3: Actively participate in the plan (Multihazard Mitigation Plan) maintenance protocols outlined in Volume 1 of this hazard mitigation plan. o Action MPK-4: Continue to maintain good standing and compliance under the NFIP (National Flood Insurance Program) through implementation of floodplain management programs that, at a minimum, meet the NFIP requirements. o Action MPK-5: Identify and pursue strategies to increase adaptive capacity to climate change including but not limited to the following:  Climate Action Element of the General Plan Update.  Consider a goal or policy to establish Reach Building Codes with the General Plan Update.  Consider inclusion of a Climate Action Plan to follow the General Plan Update. o Action MPK-6: Purchase generators for critical facilities and infrastructure that lack adequate backup power. o Action MPK-7: Provide reliable back up power for the Police Service Facility. This item has been carried forward from the 2015 MHMP. o Action MPK-8: Develop a public outreach program that informs property owner located in the dam and levee failure inundation areas about voluntary flood insurance. This item has been carried forward from the 2015 MHMP. 67 Honorable City Council 10/05/2022 Regular Meeting Page 4 o Action MPK-9: Maintain vegetation management program that provides vegetation management service to elderly, disabled, or low-income property owners who lack the resources to remove flammable vegetation from around their homes. o Action MPK-10: Proceed with construction of a storm drain to address flooding issues at Millard St. and Sherman Ave. (CIP #504) ENVIRONMENTAL DETERMINATION The Community Development Director has reviewed this project and found it to qualify for a General Rule Exemption from environmental review, in accordance with Section 15061 (b)(3) of California Code of Regulations (CEQA Guidelines). Moorpark’s Hazard Mitigation Action Plan Annex to the Ventura County 2022 MHMP would facilitate emergency equipment purchases, upgrades to existing public facilities, educational efforts, communication and landscape maintenance improvements. Adoption of the 2022 Multi Hazard Mitigation Plan does not authorize or fund any specific action; future actions undertaken to implement any portion of the Hazard Mitigation Plan action items would be subject to individual review pursuant to CEQA Guidelines. Therefore, there is no possibility that adoption of the 2022 Multi Hazard Mitigation Plan may have a significant effect on the environment and no further environmental documentation is required. NOTICING Public Notice for this meeting was given consistent with Chapter 17.44.070 of the Zoning Ordinance as follows: • Publication. The notice of the public hearing was published in the Ventura County Star on September 23, 2022. FISCAL IMPACT There is no fiscal impact associated with this action, as adoption of the 2022 Multi- Jurisdictional Hazard Mitigation Plan does not authorize or fund any specific action. However, the adoption of a Multi-Jurisdictional Hazard Mitigation Plan is a requirement of many grant funding opportunities that the City may wish to pursue. Attachment: Draft Resolution The following documents are incorporated herein and are available for review on the City’s website: 2022 Ventura County Multi-Jurisdictional Hazard Mitigation Plan, Volume 1 (486 pages) 2022 Ventura County Multi-Jurisdictional Hazard Mitigation Plan, Volume 2 (676 pages) 69 RESOLUTION NO. 2022-____ A RESOLUTION OF THE CITY COUNCIL OF MOORPARK, CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT NO. 2022-02, TO INCORPORATE THE 2022 VENTURA COUNTY MULTI- JURISDICTIONAL HAZARD MITIGATION PLAN AS PART OF THE SAFETY ELEMENT OF THE MOORPARK GENERAL PLAN AND MAKING A DETERMINATION OF EXEMPTION PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT IN CONNECTION THEREWITH WHEREAS, on July 12, 2022, the Ventura County Board of Supervisors adopted an updated 2022 Ventura County Multi-Jurisdictional Hazard Mitigation Plan for all 10 cities in Ventura County, including the City of Moorpark, and unincorporated area, to address the requirements of the federal Disaster Mitigation Act of 2000; and WHEREAS at its meeting of September 27, 2022, the Planning Commission conducted a duly-noticed public hearing on General Plan Amendment No. 2022-02 to incorporate the 2022 Ventura County Multi-Jurisdictional Hazard Mitigation Plan into the Safety Element of the General Plan, received public testimony on the proposed amendment, and after receiving oral and written public testimony, closed the public hearing and adopted Resolution No. PC-2022-676 recommending to the City Council approval of General Plan Amendment No. 2022-02; and WHEREAS, at its meeting on October 5, 2022, the City Council conducted a duly noticed public hearing on General Plan Amendment No. 2022-02 to incorporate the 2022 Ventura County Multi-Jurisdictional Hazard Mitigation Plan into the Safety Element of the General Plan, received public testimony on the proposed amendment, and after receiving oral and written public testimony, closed the public hearing and reached a decision; and WHEREAS, the Community Development Director has found General Plan Amendment No. 2022-2 to qualify for a General Rule Exemption from environmental review, in accordance with Section 15061 (b)(3) of California Code of Regulations (CEQA Guidelines). ATTACHMENT 70 Resolution No. 2022-___ Page 2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. ENVIRONMENTAL DOCUMENTATION: The City Council, based on its own independent analysis and judgment, concurs with the Community Development Director’s determination that the project is categorically exempt from the requirements of the CEQA pursuant to Section 15301 of the CEQA Guidelines. Moorpark’s Mitigation Action Plan Annex to the 2022 Ventura County MHMP would facilitate emergency equipment purchases, upgrades to existing public facilities, educational efforts, communication and landscape maintenance improvements; adoption of the 2022 Multi- Jurisdictional Hazard Mitigation Plan does not authorize or fund any specific action, and future actions undertaken to implement any portion of the Hazard Mitigation Plan action items would be subject to individual review pursuant to CEQA Guidelines. It can be seen with certainty that there is no possibility that adoption of the 2022 Multi-Jurisdictional Hazard Mitigation Plan may have a significant effect on the environment. Therefore, no further environmental documentation is required. SECTION 2. APPROVAL OF GENERAL PLAN AMENDMENT: The City Council approves General Plan Amendment No. 2022-02 to incorporate by reference the 2022 Ventura County Multi-Jurisdictional Hazard Mitigation Plan (Exhibit A) in the Safety Element of the City’s General Plan, replacing the 2015 Multi-Hazard Mitigation Plan. SECTION 3. FILING OF RESOLUTION: The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
