MOORPARK CITY COUNCIL MOORPARK DISASTER COUNCIL AGENDA REPORT TO: Honorable City Council and Disaster Council FROM: Mackenzie Douglass, Program Manager DATE: 10/05/2022 Regular Meeting SUBJECT: Consider Resolution Adopting the 2022 Ventura County Multi- Jurisdictional Hazard Mitigation Plan and Making a Determination of Exemption from the California Environmental Quality Act in Association Therewith BACKGROUND & DISCUSSION On July 12, 2022, the Ventura County Board of Supervisors adopted the Ventura County 2022 Multi-Jurisdictional Hazard Mitigation Plan (MHMP), (Attachment). The 2022 MHMP is the product of nearly two years of staff and public participation in a multi- jurisdictional effort lead by the Ventura County Sheriff’s Office of Emergency Services (Sheriff’s OES). The MHMP addresses hazards such as climate change, dam failures, drought, earthquakes, flood, landslides, levee failures, tsunami, wildfire, and severe storms. Volume 1 of the Plan addresses area wide hazards for Ventura County, while Volume 2 contains jurisdiction specific annexes for all 10 Ventura County cities, California State Channel Islands, and 13 additional special districts. The previous (2015) version of the MHMP was adopted by the City of Moorpark on November 16, 2016 (Resolution No. 2016-3559), in order to comply with the requirements of the Disaster Mitigation Act of 2000 (Act). In general, the Disaster Mitigation Act encourages close coordination between local, state and federal agencies in the area of disaster mitigation planning. The Act also requires local governments to reduce risks from natural hazards through mitigation planning and activities carried out prior to the occurrence of natural disasters. The goal is to identify policies and actions that can be implemented over the long term to reduce risk and future losses. If a local agency's MHMP is not in compliance with the Act, the local agency may not be eligible for various disaster grants and community assistance Item: 10.F. 138 Honorable City Council and Disaster Council 10/05/2022 Regular Meeting Page 2 from the State and the Federal Emergency Management Agency (FEMA). This MHMP differs from the Emergency Operations Plan (EOP), recently amended by the City Council, in that this MHMP prescribes mitigation actions to take place prior to a disaster or emergency while the EOP references guidelines to be observed during the activation of the Emergency Operations Center in response to an actual disaster or emergency. The City’s Planning Commission met on September 27, 2022, and voted to recommend to City Council the inclusion of the Ventura County MHMP in the Safety Element of the City's General Plan, replacing the 2015 Ventura County MHMP in that capacity. In addition to this agenda report recommending City Council/Disaster Council approval and adoption of the 2022 Ventura County MHMP, a related public hearing agenda item is scheduled for the Council’s regular meeting on October 5, 2022, to act on the Planning Commission’s recommendation to incorporate the 2022 Ventura County MHMP into the City’s General Plan Safety Element. The proposed General Plan amendment is separate but related approval action that is required to ensure that the City has full access to available disaster assistance funding consistent with California Government Code Section 8685.9, which sets a 75% limit of total state eligible costs on the state share for any eligible project unless the city has adopted a local hazard mitigation plan in accordance with the federal Disaster Mitigation Act of 2000 as part of the safety element of its general plan. Additionally, Government Code Section 65302.6 provides that a city may adopt with its general plan safety element a local hazard mitigation plan as specified in the federal Disaster Mitigation Act of 2000. Should City Council approve General Plan Amendment No. 2022-02, the State Legislature may provide for a state share of local disaster assistance costs that exceeds 75% of total state eligible costs. Section 2.48.040 of Chapter 2.48, Emergency Preparedness, of the City Municipal Code provides that the Moorpark Disaster Council shall consist of members of the City Council. Section 2.48.050 requires the Disaster Council to develop and recommend for adoption by the City Council emergency and mutual aid plans and agreements and such ordinances, resolutions, rules and regulations as are necessary to implement such plans and agreements. A joint meeting has been called to provide for Disaster Council recommendation of approval prior to City Council adoption of a resolution approving the 2022 Ventura County MHMP. FISCAL IMPACT There is no fiscal impact associated with this action as adoption of the 2022 Multi- Jurisdictional Hazard Mitigation Plan does not authorize or fund any specific action. However, the adoption of a Multi-Jurisdictional Hazard Mitigation Plan is a requirement of many grant funding opportunities that the City may wish to pursue. 139 Honorable City Council and Disaster Council 10/05/2022 Regular Meeting Page 3 ENVIRONMENTAL DETERMINATION The Community Development Director has reviewed this project and found it to qualify for a General Rule Exemption from environmental review, in accordance with Section 15061 (b)(3) of California Code of Regulations (CEQA Guidelines). Moorpark’s Hazard Mitigation Action Plan Annex to the Ventura County 2022 MHMP would facilitate emergency equipment purchases, upgrades to existing public facilities, educational efforts, communication and landscape maintenance improvements. Adoption of the 2022 Multi-Jurisdictional Hazard Mitigation Plan does not authorize or fund any specific action; future actions undertaken to implement any portion of the Hazard Mitigation plan action items would be subject to individual review pursuant to CEQA Guidelines. Therefore, there is no possibility that adoption of the 2022 Multi-Jurisdictional Hazard Mitigation Plan may have a significant effect on the environment and no further environmental documentation is required. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. Attachment: Draft Resolution The following documents are incorporated herein and are available for review on the City’s website: 2022 Ventura County Multi-Jurisdictional Hazard Mitigation Plan, Volume 1 (486 pages) 2022 Ventura County Multi-Jurisdictional Hazard Mitigation Plan, Volume 2 (676 pages) 140 RESOLUTION NO. 2022-____ A RESOLUTION OF THE CITY COUNCIL OF MOORPARK, CALIFORNIA, APPROVING AND ADOPTING THE 2022 VENTURA COUNTY MULTI-JURISDICTIONAL HAZARD MITIGATION PLAN AS REQUIRED BY THE FEDERAL DISASTER MITIGATION ACT OF 2000 AND MAKING A DETERMINATION OF EXEMPTION PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT IN CONNECTION THEREWITH WHEREAS, the Federal Disaster Mitigation Act of 2000 requires local governments to identify risks posed by natural and human-caused disasters, and as a condition of mitigation grant assistance, requires coordinated mitigation planning and implementation efforts; and WHEREAS the City of Moorpark participated with the Ventura County Emergency Planning Council to update the Ventura County Multi-Hazard Mitigation Plan to advance mitigation planning and projects within the County; and WHEREAS, each city, local agency, special district member, and the public as listed in the Plan, has contributed to this planning update and under the direction of the Federal Disaster Mitigation Act of 2000; and WHEREAS, the Ventura County Board of Supervisors adopted the 2022 Ventura County Multi-Hazard Mitigation Plan at a regular meeting held on July 12, 2022; and WHEREAS, consistent with California Government Code Sections 8685.9 and 65302.6, the City Council has incorporated the 2022 Ventura County Multi-Hazard Mitigation Plan, including FEMA revisions, into the Safety Element of the City's General Plan as approved by separate Council resolution on October 5, 2022; and WHEREAS, the Moorpark Disaster Council on October 5, 2022, recommended City Council adoption of the 2022 Ventura County Multi-Hazard Mitigation Plan; and WHEREAS, the City Council of the City of Moorpark agrees to abide by the Disaster Mitigation Act of 2000 guidance and grant guidelines and this Multi-Hazard Mitigation Plan represents compliance with the same; and WHEREAS, the Community Development Director has found General Plan Amendment No. 2022-2 to qualify for a General Rule Exemption from environmental review, in accordance with Section 15061 (b)(3) of California Code of Regulations (CEQA Guidelines). It can be seen with certainty that there is no possibility that adoption of the 2022 Multi Hazard Mitigation Plan may have a significant effect on the environment. Therefore, no further environmental documentation is required. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. ENVIRONMENTAL DOCUMENTATION: The City Council, based on its own independent analysis and judgment, concurs with the Community Development Director’s determination that the project is categorically exempt from the requirements of the CEQA pursuant to Section 15301 of the CEQA Guidelines. Moorpark’s Mitigation Action Plan Annex to the 2022 Ventura County MHMP would facilitate emergency equipment purchases, upgrades to existing public facilities, educational efforts, communication and landscape maintenance improvements; adoption of the 2022 Multi- Jurisdictional Hazard Mitigation Plan does not authorize or fund any specific action, and future actions undertaken to implement any portion of the Hazard Mitigation plan action items would be subject to individual review pursuant to CEQA Guidelines. It can be seen with certainty that there is no possibility that adoption of the 2022 Multi-Jurisdictional Hazard Mitigation Plan may have a significant effect on the environment. Therefore, no further environmental documentation is required. SECTION 2. In accordance with the federal Disaster Mitigation Act of 2000, the City Council of the City of Moorpark approves and adopts the 2022 Ventura County Multi- Jurisdictional Hazard Mitigation Plan (Exhibit A) incorporated herein by reference, as a regional plan and a guidebook to a more disaster resistant community. SECTION 3. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
