MINUTES OF THE CITY COUNCIL AND SUCCESSOR AGENCY OF THE REDEVELOPMENT AGENCY AND JOINTLY WITH THE DISASTER COUNCIL OF THE CITY OF MOORPARK Moorpark, California October 5, 2022 A Regular Meeting of the City Council of the City of Moorpark and the Successor Agency was held jointly with the Disaster Council on Wednesday, October 5, 2022, at 6:30 p.m. in the Council Chambers of said City located at 799 Moorpark Avenue, Moorpark, California. All items listed are heard and acted upon by the City Council unless otherwise noted. 1. CALL TO ORDER: Mayor Parvin called the meeting to order at 6:31 p.m. 2. PLEDGE OF ALLEGIANCE: Deputy Community Development Director Doug Spondello led the Pledge of Allegiance. 3. ROLL CALL: Present: Councilmembers Castro, Enegren, Groff, and Mayor Parvin. Absent: Councilmember Pollock. Staff Present: Troy Brown, City Manager; Kevin Ennis, City Attorney; PJ Gagajena, Assistant City Manager; Jeremy Laurentowski, Parks and Recreation Director; Daniel Kim, City Engineer/Public Works Director; Brian Chong, Assistant to the City Manager; Doug Spondello, Deputy Community Development Director; Mackenzie Douglass, Program Manager; Dan Schultz, Building Official, Charles Abbott Associates, Inc.; Captain Victor Fazio, Ventura County Sheriff's Office; and Ky Spangler, City Clerk. 4. PROCLAMATIONS AND COMMENDATIONS: A. Introduction of New City Employee, Jeannine Lugo, Administrative Specialist, in the Community Development Department. Mayor Parvin introduced new City employee Jeannine Lugo, Administrative Specialist in the Community Development Department. 5. PUBLIC COMMENT: None. ANNOUNCEMENTS, FUTURE AGENDA ITEMS, AND REPORTS ON MEETINGS/CONFERENCES ATTENDED BY COUNCILMEMBERS AND MAYOR: Councilmember Enegren reported on October 1 he attended the Country Days event. Councilmember Enegren reported on October 3 he attended the Transportation & Public Works standing committee meeting where speeding issues on Second Street were discussed. Councilmember Enegren reported on October 4 he attended the Candidates’ Forum hosted by the Moorpark Chamber of Commerce. Councilmember Castro reported on October 1 he attended the Country Days event, and thanked City staff, the Chamber of Commerce, and vendors who helped to make the children’s activities free. Councilmember Castro reported on October 3 he attended the Transportation & Public Works standing committee meeting and expressed appreciation for the data-based approach being used to analyze the issues and develop solutions. Councilmember Groff reported on October 4 he attended the Candidates’ Forum hosted by the League of Women Voters and Chamber of Commerce. Mayor Parvin announced an update regarding the General Plan Goals and Policies. Following a well-attended workshop on September 24th, we are providing additional time for the public to re view the Goals and Policies online and provide comments. Please visit moorparkgeneralplan.com to participate now through Sunday, October 9th to tell us what you think. Mayor Parvin announced you are never too old to learn something new or switch jobs. The Moorpark City Library has free online tools for job training, skill building, test preparation, and professional development from top-tier providers like LinkedIn Learning, Coursera, Skillshare, and more with Career Pathways. All you need is a library card and a computer or device with the internet. Go to moorparklibrary.org or visit the Library to learn more. Mayor Parvin extended an invitation to the Moorpark City Library on Saturday, October 8, at 5:00 p.m. for an interactive showing of The Nightmare Before Christmas (Rated PG). Attendees will receive a bag filled with themed props to help bring the movie to life. Space is limited, so please call the Library at (805) 517-6370 to register. 378 Minutes of the City Council/Successor Agency Moorpark Disaster Council Moorpark, California Page 3 October 5, 2022 Mayor Parvin announced Monster Mash Skate Night on Saturday, October 15, an evening of skating, music, contests, food booths, and fun. The event runs from 5:00 to 8:00 p.m. at Arroyo Vista Community Park and admission is free. Please remember kids must wear helmets, and skateboards are not allowed. For details, visit moorparkca.gov/skate or call (805) 517-6300. Mayor Parvin announced bingo has returned to the Moorpark Active Adult Center. The American Legion Post 502 hosts a weekly bingo game at the Active Adult Center for anyone 18 and older. Doors open every Thursday at 12:00 p.m. and bingo starts at 1:00 p.m. Join in the fun to win cash prizes. Please call the Active Adult Center with any questions at (805) 517-6261. Mayor Parvin reported on September 22 she participated in the American Legion Auxiliary Post 502 meeting. Mayor Parvin reported on September 24 she participated in the Rotary Club’s clean up on Tierra Rejada Road. Mayor Parvin reported on September 24 she performed the coin toss at the Moorpark College football game. Mayor Parvin reported on September 27 she participated in the Boys & Girls Club Board of Directors meeting. Mayor Parvin reported on September 29 she met with the board members of a homeowner’s association. Mayor Parvin reported on October 1 she participated in the Country Days Parade. Mayor Parvin reported on October 2 she participated in the Rotary Club’s Mammoth Run, and extended thanks to all of the community volunteers for both Country Days events. Mayor Parvin reported on October 5 she attended the Moorpark Chamber of Commerce Government Relations Committee meeting. 8. PUBLIC HEARINGS: A. Consider Ordinance Approving the First Amendment to the Development Agreement No. 2018-01 between the City of Moorpark and Daly Group, Inc. and Making a Determination of Exemptio n Pursuant to the California Environmental Quality Act in Connection Therewith. Staff Recommendation: 1) Open the public hearing, receive public te stimony and close the public hearing; and 2) Introduce Ordinance No. ___, approving the First Amendment to Development Agreement No. 2018-01 for first reading, waive full reading, and place this ordinance on the 379 Minutes of the City Council/Successor Agency Moorpark Disaster Council Moorpark, California Page 4 October 5, 2022 agenda for October 19, 2022, for purposes of providing second reading and adoption of the ordinance. (ROLL CALL VOTE REQUIRED) Mr. Brown noted staff recommends the item be continued to the October 19, 2022, Council meeting. CONSENSUS: It was the consensus of the City Council to continue the item to October 19, 2022. B. Consider Resolution Approving General Plan Amendment No. 2022-02 to Include the 2022 Ventura County Multi-Jurisdictional Hazard Mitigation Plan as Part of the General Plan Safety Element and a Determination of Exemption from the California Environmental Quality Act in Association Therewith. Planning Commission Recommendation: 1) Open the public hearing, receive public testimony and close the public hearing; and 2) Adopt Resolution No. 2022-4137, approving General Plan Amendment No. 2022-02, which includes the 2022 Ventura County Multi-Jurisdictional Hazard Mitigation Plan as part of the General Plan Safety Element.’(ROLL CALL VOTE REQUIRED) Mr. Douglass gave the staff report. Questions among City Council and staff followed including: 1) clarification that the Community Wildfire Protection Plan listed in Volume 2, pages 4-6 does not exist at a City level because the City relies upon Ventura County Fire for that plan; and 2) confirmation that the City now has its hazard mitigation information specific to Moorpark available on the City’s website. Mayor Parvin opened the public hearing at 6:47 p.m.; having no speakers, the public hearing was closed. MOTION: Mayor Parvin moved and Councilmember Groff seconded a motion to adopt Resolution No. 2022-4137, approving General Plan Amendment No. 2022- 02, which includes the 2022 Ventura County Multi -Jurisdictional Hazard Mitigation Plan as part of the General Plan Safety Element. The motion carried by roll call vote 4-0, Councilmember Pollock absent. C. Consider an Ordinance, Adopting by Reference the 2022 Editions of the California Building Code, Volumes 1 and 2, with Appendices C, I and J, the California Residential Code, with Appendix AH, the California Reference Standards Code, the California Electrical Code, the California Plumbing Code with Appendix H, the California Mechanical Code, the California Energy Code, the California Green Building Standards Code, the California Administrative Code, the 2021 Edition of the International Property Maintenance Code and the Twenty-First Edition of the Gypsum Association Fire Resistance Design Manual; Together with Amendments, 380 Minutes of the City Council/Successor Agency Moorpark Disaster Council Moorpark, California Page 5 October 5, 2022 Deletions and Penalties, and Amending Title 15 of the Moorpark Municipal Code; Making Findings that Amendments to the 2022 Editions of the California Building Code and California Residential Code are Reasonably Necessary Due to Local Climatic, Geological and Topographical Conditions; and Making a Determination of Exemption Under CEQA in Connection Therewith. Staff Recommendation: 1) Open the public hearing, receive public testimony, and close the public hearing; and 2) Introduce Ordinance No. 508 for first reading, waive full reading, and direct staff to schedule a public hearing for November 2, 2022, for purposes of providing second reading and adoption of the ordinance. (ROLL CALL VOTE REQUIRED) Mr. Spondello introduced Mr. Danny Schultz, Building Official, who gave the staff report. Questions among City Council and staff followed including clarification that the standards for pedestrian access gates for residential swimming pools, including opening in the direction of egress and having a locking device, has been in the Building Code for some time; existing pools are grandfathered under the current code and only require update upon sale or transfer of the property. Mayor Parvin opened the public hearing at 6:53 p.m.; having no speakers, the public hearing was closed. Mr. Ennis read the title of Ordinance No. 508. The motion carried by roll call vote 4-0, Councilmember Pollock absent. 9. PRESENTATION/ACTION/DISCUSSION: A. Provide Direction to Staff Regarding Addition of Cu stom Questions to the 2022 National Community Survey. Staff Recommendation: Provide direction to staff on any custom questions to be added to the 2022 National Community Survey. Mr. Gagajena gave the staff report. Council inquired when Measure P, the park maintenance assessment levied through property tax bills, expires. Council discussion included potential questions regarding access to quality mental health services, gathering additional information on areas of weakness relative to arts, cultural, and music activities and multi-cultural community events and the diversity of the offerings, the area of parks and recreation, what is more important in priority, and willingness to pay for amenities. There were no speakers. CONSENSUS: It was the consensus of the City Council to consider addition of a question in the area of mental health services, or a question relating to prioritizing recreational amenities and willingness to pay for such amenities. 10. CONSENT CALENDAR: (ROLL CALL VOTE REQUIRED) MOTION: Mayor/Disaster Council Chair Parvin moved and Councilmember/Disaster Council Member Enegren seconded a motion to approve the Consent Calendar. Consider Warrant Register for Fiscal Year 2022/23 - October 5, 2022. Staff Recommendation: Approve the warrant register. B. Consider Minutes of City Council/Parks & Recreation Joint Special Meeting of March 30, 2022. Staff Recommendation: Approve the minutes C. Consider Minutes of City Council/Successor Agency Regular Meeting of July 20, 2022.Staff Recommendation: Approve the minutes. D. Receive Final Report of Annual Development Agreement Review, Established in Connection with Meridian Hills Development Project, Tract 5187-1&2, Located on the West Side of Walnut Canyon Road, approximately 3,500 Feet North of Casey Road, on the Application of Resmark Equity Partners, LLC and K. Hovnanian at Meridian Hills, LLC (Formerly West Pointe Homes and William Lyon Homes Inc.). Staff Recommendation: 1) Accept the Community Developmen t Director’s report and recommendation that, on the basis of substantial evidence, that Resmark Equity Partners, LLC and K. Hovnanian at Meridian Hills, LLC have complied in good faith with the terms and conditi ons of the Agreement; and 2) Deem the annual review process for this project complete with no further annual review necessary. E. Consider Resolution of Annual Delegation of Investment Authority to the City Treasurer. Staff Recommendation: Adopt Resolution No. 2022-4138, delegating investment authority to the City Treasurer for a period of one year. (ROLL CALL VOTE REQUIRED) F. (DISASTER COUNCIL/CITY COUNCIL) Consider Resolution Adopting the 2022 Ventura County Multi-Jurisdictional Hazard Mitigation Plan and Making a Determination of Exemption from th e California Environmental Quality Act in Association Therewith. Staff Recommendation: 1) Disaster Council - Recommend City Council adopt a resolution adopting the 2022 Ventura County Multi-Jurisdictional Hazard Mitigation Plan. 2) City Council - Adopt Resolution No. 2022-4139, adopting the 2022 Ventura County Multi-Jurisdictional Hazard Mitigation Plan.
