HomeMy WebLinkAboutAGENDA REPORT 1985 0518 CC SPC ITEM 52A Jitt-st_ e9 —a- RESOLUTION NO. 85- /f A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, INITIATING PROCEEDINGS FOR THE ANNUAL ASSESSMENTS FOR THE "MOORPARK LIGHTING MAINTENANCE ASSESSMENT DISTRICT NO. AD-84-2" FOR THE FISCAL YEAR COMMENCING JULY 1 , 1985 AND ENDING JUNE 30 , 1986 ; CONSOLIDATING CERTAIN ASSESSMENT DISTRICTS AND PORTIONS OF ASSESSMENT DISTRICTS WITH SAID "MOORPARK LIGHTING MAINTENANCE ASSESSMENT DISTRICT NO. AD-84-2" ; AND ORDERING THE ENGINEER TO PREPARE AND FILE A REPORT IN ACCORDANCE THEREWITH. WHEREAS, pursuant to the provisions of the "Landscaping and Lighting Act of 1972" , being Division 15, Part 2 of the Streets and Highways Code of the State of California, the City Council of the City of Moorpark, by its Resolution No. 84-88, adopted May 16, 1984, ordered formed the"Moorpark Lighting Maintenance Assessment District No. AD-84-2" , and confirmed and levied the assessments approved thereby for the fiscal year commencing July 1 , 1984 and ending June 30, 1985; and WHEREAS, the City Council of the City of Moorpark, California, proposes to make changes to said district, consolidate certain assessment districts and portions of assessment districts with said district, and to extend the improvement specified in said district for the fiscal year commencing July 1 , 1985 and ending June 30, 1986, pursuant to the "Landscaping and Lighting Act of 1972" , being Division 15, Part 2 of the Streets and Highways Code of the State of California; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1 . Pursuant to Section 22585, et seq. of the Streets and Highways Code (the "Landscaping and Lighting Act of 1972") , it is hereby proposed to make certain changes to "Moorpark Lighting Maintenance Assessment District No. AD-84-2" of the City of Moorpark so as to continue , for the fiscal year commencing with July 1, 1985 and ending June 30, 1985, to provide electric current or energy for public lighting facilities, and for operation and main- tenance of said public lighting within the City, to provide for installation or maintenance of landscaping and the construction or maintenance of curb, gutter or sidewalk structures and facilities, to install or construct facilities which are appurtenant to any of the foregoing, for the maintenance or servicing, or both, of any of the foregoing, and to provide incidental expenses in connection therewith. -1- SECTION 2 . The assessments proposed to be levied and collected shall be used for furnishing electric current or energy, gas or other illuminating agent for street lights and traffic safety lights , for the usual maintenance and operation of said street lights and traffic safety lights , and for other improvements as specified in Section 1 hereinabove. SECTION 3 . To ensure that the costs and expenses of main- taining, operating and servicing the street and traffic safety, and the improvements as specified hereinabove, are borne by the owners of the property to be benefited thereby, this Council resolves that the proposed landscape maintenance assessment district consist of all property within the City. SECTION 4. Said landscape maintenance assessment district shall specifically include the following: (a) The street medians along Tierra Rejada Road and the parkway landscaping along Los Angeles Avenue and Tierra Rejada Road heretofore included within "Moorpark Landscape Maintenance Assessment District No. AD-83-1" , which was formed and confirmed by this City Council by Resolution No. 83-44, adopted October 3, 1983 ; (b) All of the improvement areas included within "City of Moorpark Landscaping and Lighting Maintenance District No. AD-84-1" , formed and confirmed by this City Council by Resolution No. 84-69, adopted February 15, 1984; (c) All of the improvement areas included within "Tierra Rejada Road - Landscape Maintenance District" , formed by the County of Ventura on August 14, 1979 in accordance with the "Landscaping and Lighting Act of 1972" , and said assessment districts and portions of assessment districts as described and referred to in this section shall be and the same are hereby ordered consolidated with said "Moorpark Lighting Maintenance Assessment District No. AD-84-2". SECTION 5. The distinctive designation for the assessment district to be continued pursuant to this Resolution shall remain "Moorpark Lighting Maintenance Assessment District No. AD-84-2" . SECTION 6. The City Manager is directed to cause to be prepared an Engineer' s Report, in accordance with Article 4, Chapter 1, Part 2, Division 15 of the said Streets and Highways Code; and that upon completion, the report shall be filed with the City Clerk, who shall then submit the same to the City Council for its consid- eration, pursuant to Section 22586 of said Street and Highways Code. -2- SECTION 7 .
