SUBJECT: RESOLUTION FOR INITIATING PROCEEDINGS AND PREPARATION
OF ENGINEER'S REPORT FOR ANNUAL ASSESSMENTS FOR THE
LIGHTING AND LANDSCAPING MAINTENANCE DISTRICT (AD
84-2) -
The primary activity of the process for determining annual assessments
for the Lighting and Landscape Maintenance District (AD-48-2) is
preparation of the Engineer' s Reports. This report evaluates the
benefits received by various classes of properties as to their relative
benefits and spreads the costs based upon the approved method of
distribution. The estimated annual maintenance costs and requisite
maintenance program are also part of the report.
After submission of the Engineer' s Report, the City Council conducts a
public hearing in June to consider protests, comments concerning the
costs, method of spread and other pertinent matters. The Engineer' s
Report must be approved and the assessments levied prior to July 1.
Attached is a copy of the Engineer' s Report for the current year. This
explains the method of spread and related matters. Any major change to
the current method of spread will result in additional costs. Such was
the case in 1986/87, when the Council opted to modify the method of
spread for street lighting to include a lower assessment for lots
fronting on a street without street lights. The cost for preparation
of the reports has been included in the adopted Budget.

RECOMMENDED ACTION:
1. Adopt Resolution No. 88-/56— Initiating Proceedings for AD-84-2
and Ordering Preparation of Engineer' s Report.
2. Authorize the City Engineer to prepare the Engineer' s Report for
the Lighting and Landscaping Maintenance Assessment District
(AD-84-2), pursuant to the proposals submitted at a cost not to
exceed $4,725 without City Manager approval to a maximum amount
of $5,000. Any cost above $5,000 will require prior approval of
the City Council .

I . City Engineer will meet with the City to accomplish the
following :
1 . Meet with the City and establish guidelines for
land uses, i.e. , mixed uses (residential and
commercial) .

their accompanying values.

II . City Engineer will provide the following:

consideration some efficiencies of work effort in

efficiencies as a single event and is divided equally
between the 2 districts.
The Scope of Services will include an initial spread to
be used by the City and City Engineer as a working copy
to establish the preliminary spread and Engineer' s
Report to be submitted to the City Council for the
first hearing. The services do not include revision to
the method of spread except for refinements to the
formulas as stated in I .2 or New Special Zones.

reflect existing land uses. Field verification
will be limited to two man-days unless additional
appropriations are authorized by the City.

including additional items provided by City per
#7 on Page 2 . One envelope per assessor parcel
number for both assessment districts will be used.

h. Ten copies of final Engineer' s Report
i. One copy of final spread to the County Assessor.
j . Provide a magnetic tape of final spread to the
County Assessor.
k. The City Engineer will participatc in all public
hearings.
III . The City will provide the following:
1 . City will provide budget data for 88-89 fiscal
year with a breakdown of complete budget for each
special zone as appropriate.
* 2 . Printout from County with fallouts of latest
equalized Assessor' s Roll .
* 3 . Assessor maps, with special zones identified, from
the latest equalized Assessor' s Roll .
4 . A current parks inventory map of the City
including a list of any revisions from the 1987/88
inventory map.
5 . A list of any additional or revised multiple-
family dwellings by street address or Assessor' s
Parcel Number indicating the number of dwelling
units per parcel .
6 . Window envelopes, with City return address . City
Engineer will deliver to the City inserted
envelopes, (one for each assessor parcel for both
assessment districts) .
7 . Notices, Resolutions and Cover letters - for
inclusion in envelopes.
* At City' s option, these items can be secured by City
Engineer at direct cost of said items.

Landscaping and Lighting Act of 1972
For Fiscal Year 1987-1988
PREFACE
This report is prepared pursuant to City Council action
taken at their regular meeting of March 4, 1987 to extend
this District for the fiscal year commencing July 1, 1987
and ending June 30 , 1988 in compliance with the requirements
of Article 4, Chapter 1, "Landscaping and Lighting Act of
1972" , being Part 2 of Division 15 of the California Streets
and Highways Code.
This District will provide electrical energy for public
lighting facilities and for operation and maintenance of
public lighting within the City. In addition, the District
will provide for installation and/or maintenance of public
landscaping within the public right-of-way.
DESCRIPTION OF .MAINTENANCE AND IMPROVEMENTS
This Report covers the period of July 1, 1987 through June
30 , 1988. An updated report is prepared each year to
reflect updated annual costs and changes in parcelization.
The improvements to be maintained in this District include
all City-owned and Southern California Edison (S.C.E. ) -owned
street lights as well as all medians and street trees within
public rights-of-way within the boundaries of the City.
Lighting maintenance shall include but not be limited to
energy costs, removal, repair, replacement or relocation of
light standards, poles, bulbs, fixtures and all
appurtenances. Servicing of S.C.E. owned lights as defined
in Section 22538 of the Streets and Highways Code shall be
furnished by the Southern California Edison Company or its

successors or this servicing shall be as authorized by the

Public Utilities Commission, State of California.
Maintenance of City-owned lighting improvements shall be
furnished by the City.
Landscape maintenance shall include, but not be limited to,
watering, fertilizing, mowing, weed control, shrubbery, tree
removal and pruning, removal and replacement of dead growth,
maintenance of irrigation facilities and other necessary
work.
In addition, the cost to maintain improved areas within an
easement will be borne by owners within that project. These
easement areas are:
1 . Tract No. 2851
Landscape charge to maintain a venzura CounLy
Flood Control Easement and portions of the
interior tract entry areas. The obligation upon
= these 74 properties is pursuant to a condition of
development.
2 . Tract No. 2865
A charge to construct a center median in Tierra
Rejada Road. This obligation (one-quarter of
total costs for four years) is placed upon the 622
parcels within the tract.
3 . Tract No. 3032
Landscape charge to maintain an entry monument at
Buttercreek Road and Los Angeles Avenue. This
cost to be spread to the 265 properties within the
tract.
4 . Tract No. 3274
Landscape charge to maintain landscape areas along
Williams Ranch Road parkway adjacent to Peach Hill
drain channel and Edison entries within PC-3 .
This cost will be borne by the 220 parcels within
the . tract.
ASSESSMENT ROLL
All parcels of real property affected are listed on the
"Assessment Roll" Exhibit A, which will be on file in City

Hall with the City Clerk, and is made a part hereof by
reference. These parcels are more particularly described in
maps prepared in accordance with Section 327 of the Revenue
and Taxation Code and are on file in the office of the
Ventura County Assessor in the County Government Center
Administration Building, 800 So. Victoria Avenue, Ventura,
California and which are also made a part hereof by
reference.
METHOD AND FORMULA OF COST SPREAD
The Landscaping and Lighting Act of 1972 , in Section 22573 ,
states that "The net amount to be assessed upon the lands
within an assessment district may be apportioned by any
foriuula or method which fairly distributes the new amount
among all assessable lots or 1..)d.Lu i6 in proportion to tl1A
estimated benefits to be received by each such lot or parcel
from the improvements . "

The primary benefits of street lighting are for the
convenience, safety and protection of people and, to a
= lesser extent, the security or protection of property,
property improvements and goods. The intensity or degree of
illumination provided can have a bearing on both.
People Related Benefits (People Use)
1. Reduction in night accidents and attendant human misery
and decrease in personal and property loss.
2 . Less vulnerability to criminal assault at nights .
3 . Promotion of business during night time hours.
4 . Increased night time safety on roads and highways.
5 . Inspiration for community spirit and growth.
Security of Property Protection (Security Benefit)
1. Reduction in vandalism and other criminal acts, and
damage to improvements.
2 . Reduction in burglaries.

Intensity
Intensity or degree of illumination provided on streets
varies with the type of street, date of installation and the
use of the property adjacent thereto.
Based on land use information according to the City Land Use
Map, a value of one (1) unit has been assigned to the single
family home - Level 1. Single family home - Level 1 are
those homes located along streets that have street lighting.
Level 2 are those homes located on streets without street
lighting.
The basic unit for single family (Level 1) homes consists of
• • a value of one 1/2 for people use, 1/4 for intensity and 1/4
for security benefit. Parcels in other land use categories
were then rated by comparison with biie Lasic unit. CSee

Landscaping
The landscapinc element of the spread formula recognizes
that all properties within the City benefit from the
maintenance of the landscaping within public rights-of-way
and easements. The benefits are shared equally by all land
uses within the City and includes such benefits as aesthetic
enjoyment, creation of a pleasant living and working
environment, an increase in general property values,
improved safety resulting from a regular tree trimming
program and improved street sweeping capabilities resulting
from trimming trees which may otherwise interfere with
street sweeping operations. Because of the general benefit
received, the cost is spread equally along each parcel in
the City. 'This amount is shown in the appendix.
COST ESTIMATES
The estimated costs of operating the District are shown in
Appendix "D" of this Report.
The costs attributed to landscaping and the costs attributed
to lighting will be separately apportioned, according to the
formula, and . added together to constitute the total
assessment for each parcel .
In conclusion, it is our opinion that the assessments within
Lighting Maintenance Assessment District No. AD-84-2 are
apportioned by a formula that fairly distributes the net
• cost in accordance with the benefits that are received.

Landscape Formula
The landscaping element of the spread_ formula is calculated
in accordance with the method described in a proceeding
portion of this report, as follows :
Total Annual Cost = $ 9 .28 per parcel.
NOTES : 1 . In a~riiti.on to the above landscape charge, 74
parcels within Tract No. 2851 in the City are
assessed an additional landscape cost for a
Ventura County Flood Control Easement and
portions of the interior tract entry areas.
The additional cost per parcel is $42 .24 .
The obligation upon tbese properties is
pursuant to a condition of development.
2 . In addition to the above landscape charge,
622 parcels comprising Tract No. 2865 in the
City are assessed an additional landscape
cost (one-quarter of total cost for four (4)
years) for the construction of a center
. .median in Tierra Rejada Road. The additional
annual cost per parcel is $91.79 . This
improvement was directed by the City Council
in order that a median be built in Tierra
Rejada Road through Tract No. 2865 consistent
with adjacent tracts.
3 . In addition to the above landscape charge,
265 parcels within Tract No. 3032 are
assessed an additional landscape charge for
the maintenance of an entry monument at
Buttercreek Road and Los Angeles Avenue. The
additional cost per parcel is $2 .42 .
4 . . In addition to the above landscape charge,
220 properties within Tract No. 3274 are
assessed an additional landscape charge for
the maintenance of parkway areas along
Williams Ranch Road and Edison entries within
PC-3 . The additional cost per parcel is
$7 .23 .

Appendix "F" , the Assessment Roll, shows the assessment upon
each lot or parcel (approximately 7745 parcels or lots)
within this District and is on file in the Office of the
City Clerk and County Assessor. The Ventura County
Assessor' s Office no longer lists public utility easements
on their Assessors Roll .

RESOLUTION NO. 87- 396
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
' MOORPARK, CALIFORNIA, MAKING CERTAIN CHANGES TO
THE "MOORPARK LIGHTING AND LANDSCAPING
MAINTENANCE ASSESSMENT DISTRICT NO. AD-84-2 ";
AND CONFIRMING THE ASSESSMENT FOR SAID DISTRICT
FOR THE FISCAL YEAR COMMENCING JULY 1, 1987 AND
ENDING JUNE 30, 1988.
WHEREAS, the City Council of the City of Moorpark, by Resolution No.
87-384, adopted May 13, 1987, declared its intention to make certain changes to
the "Moorpark Lighting and Landscaping Maintenance Assessment District No.
AD-84-2" , and to order the extension of the annual assessments for said
district for the fiscal year commencing July 1 , 19R7 and endi no June 30. 1988;
and
WHEREAS, said "Moorpark Lighting and Landscaping Maintenance Assessment
District No. AD-84-2" consists of a single city-wide zone to provide electric
current or energy for public lighting within the City, to provide for
installation or maintenance landscaping and the construction or maintenance of
curb, gutter, or sidewalk strucrures and facilities, to install or construct
facilies which are appurtenant to any of the foregoing, for the maintenance or
servicing or both, of any of the foregoing and to provide incidental expenses
in connection therewith; and
WHEREAS, on June 3, 1987 the City Council held a public hearing to
determine whether said changes to said district should be made, and whether the
annual assessments should be ordered and confirmed for the fiscal year
commencing July 1, 1987 and ending June 30, 1988; and
WHEREAS, at said hearing -0- written protests to proposed changes to,
and to the annual assessments proposed to be levied for, said Assessment
District No. AD-84-2 were received by the City Council; and
WHEREAS, the City Council overruled any and all protests; and
WHEREAS, The City Council determined that it had authority to proceed
with the changes to and extension of annual assessments for the fiscal year
commencing July 1, 1987 and ending June 30, 1988;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA,
DOES RESOLVE AS FOLLOWS:
SECTION 1. The report of the Engineer, as filed on May 13, 1987 is
hereby approved and adopted, and the improvements, changes to, and extension of
the annual assessments in the Assessment District, in accordance with said
report and in accordance with Resolution No. 87-384, and an assessment in
accordance with said report-, is hereby levied for the fiscal year 1987/88.
SECTION 2. The City Clerk shall cause the diagram and assessment, or a
certified copy thereof, to be filed with the County Auditor.
SECTION 3. The City Clerk shall certify to the adoption of this
resolution.
