SUBJECT: Resolution Initiating Proceedings for the Annual Assessments
for the "Moorpark Lighting Maintenance Assessment District No.
AD-84-2"; and Ordering Preparation of the Engineer' s Report
The primary activity of the process for determining annual assessments for
the Lighting and Landscape Maintenance District (AD-48-2) is preparation
of the Engineer' s Reports. This report evaluates the benefits received by
various classes of properties as to their relative benefits and spreads
the costs based upon the approved method of distribution. The estimated
annual maintenance costs and requisite maintenance program are also part
of the report.
After submission of the Engineer' s Report, the City Council conducts a
public hearing in June to consider protests, comments concerning the
costs, method of spread and other pertinent matters. The Engineer' s
Report must be approved and the assessments levied prior to July 1. Under
recently enacted legislation (Streets and Highways Code Section 22640),
this date may be extended to no later than the third Monday in August if
authorized by the County Auditor. At this time, Staff does not foresee a
problem with meeting the July 1 date.
A copy of the Engineer' s Report for the current year has been previously
provided to the Council . This explains the method of spread and related
matters. Any major change to the current method of spread will result in
additional costs. Such was the case in 1986-87, when the Council opted to
modify the method of spread for street lighting to include a lower
assessment for lots fronting on a street without street. lights. The cost
for preparation of the Engineer' s Report has been included in the adopted
Budget. The purpose of the proposed Resolution is to formally authorize
initiation of the process and to direct the City Manager to secure the
services of a qualified engineer to prepare the necessary Engineer' s
Report. The cost to prepare the Engineer' s Report. for 1988-89 was $4,725.

The adopted budget and Engineer' s Report includes $5,000 for preparation
of the Report for 1989-90.
STAFF RECOMMENDATION:
1. Adopt Resolution No. 89- Initiating Proceedings for AD-84-2
and Ordering Preparation of Engineer' s Report.
2. Authorize the City Manager to secure the services of a
qualified engineer to rpepare the Engineer' s Report for the
Lighting and Landscaping Maintenance Assessment District
(AD-84-2) at a cost not to exceed $5,000. Any cost above
$5,000 will require prior approval of the City Council .

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, INITIATING PROCEEDINGS
FOR THE ANNUAL ASSESSMENTS FOR THE "MOORPARK
LIGHTING MAINTENANCE ASSESSMENT DISTRICT NO.
AD-84-2" FOR THE FISCAL YEAR COMMENCING JULY 1,
1989, AND ENDING JUNE 30, 1990, AND ORDERING
THE ENGINEER TO PREPARE AND FILE A REPORT IN
ACCORDANCE THEREWITH
WHEREAS, pursuant to the provisions of the "Landscaping and Lighting
Act of 1972", being Division 15, Part 2 of the Streets and Highways Code
of the State of California, the City Council of the City of Moorpark, by
its Resolution No. 84-88, adopted May 16, 1984, ordered the formation of
the "Moorpark Lighting Maintenance Assessment District No. AD-84-2";
confirmed and levied the assessments approved thereunder for the fiscal
year commencing July 1, 1984 and ending June 30, 1985; and has confirmed
and levied the assessments approved thereunder for each subsequent fiscal
year.
WHEREAS, the City Council of the City of Moorpark proposes to extend
the improvements specified in said district for the fiscal year commencing
July 1, 1989 and ending June 30, 1990, pursuant to the "Landscaping and
Lighting Act of 1972", being Division 15, Part 2 of the Streets and
Highways Code of the State of California;
NOW, THEREFORE, the City Council of the City of Moorpark,
California, does hereby resolve, determine and order as follows:
SECTION 1: Pursuant to Section 22585, et seq. , of the Streets and
Highways Code (the "Landscaping and Lighting Act of 1972"), it is hereby
proposed to extend the annual assessments levied under "Moorpark Lighting
and Landscaping Maintenance Assessment District No. AD-84-2" of the City
of Moorpark so as to continue for the fiscal year commencing with July 1,
1989 and ending June 30, 1990, to provide electric current or energy for
public lighting facilities, and for operation and maintenance of said
public lighting within the City, to provide for installation or
maintenance of landscaping and the construction or maintenance of curb,
gutter or sidewalk structures and facilities, to install or construct
facilities which are appurtenant to any of the foregoing, for the
maintenance or servicing, or both, of any of the foregoing, and to provide
incidental expenses in connection therewith.
SECTION 2: The assessments proposed to be levied and collected
shall be used for furnishing electric current or energy, as or other
illuminating agent for street lights and traffic safety lights, for the
usual maintenance and operation of said street lights and traffic safety
lights, and for other improvements as specified in Section 1 hereinabove.
SECTION 3: To ensure that the costs and expenses of maintaining,
operating and servicing the street and traffic safety, and the
improvements as specified hereinabove, are borne by the owners of the
property to be benefitted thereby, this Council resolves that the proposed

landscape maintenance assessment district consist of all property within
the City.
SECTION 4: The distinctive designation for the assessment district
to be continued pursuant to this resolution shall be "Moorpark Lighting
and Landscaping Maintenance Assessment District No. AD-84-2".
SECTION 5: The City Manager is directed to cause to be prepared an
Engineer' s Report, in accordance with Article 4, Chapter 1, Part 2,
Division 15 of said Streets and Highways Code; and that upon completion,
the report shall be filed with the City Clerk, who shall then submit the
same to the City Council for its consideration, pursuant to Section 22586
of said Streets and Highways Code.
SECTION 6: The City Clerk shall certify to the adoption of this
resolution.
