MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: PJ Gagajena, Assistant City Manager DATE: 11/16/2022 Regular Meeting SUBJECT: Consider Resolution Adopting the Salary Plan for Hourly Employees and Rescinding Resolution No. 2022-4082 to Increase the Minimum Wage BACKGROUND/DISCUSSION In 2016, the California state legislature passed and the Governor signed Senate Bill 3, which established a schedule for raising the California minimum wage from $10.00/hour to $15.00/hour by January 1, 2022, for all employers with 26 or more employees. The State of California Labor Code Section 1182.12 states that once the minimum wage reaches $15.00/hour, the California Department of Finance (DOF) is required to determine on or before August 1 of each year if the minimum wage needs to be adjusted for inflation by the lesser of 3.5 percent or the rate of change. On July 27, 2022, the DOF calculated the Consumer Price Index rate of change to be 7.9 percent and determined the minimum wage will increase by 3.5 percent to $15.50/hour for all employers on January 1, 2023. The attached Salary Plan for Hourly Employees includes the revised hourly salary schedule to reflect the mandatory minimum wage increase to $15.50/hour effective the first full pay period commencing on or after January 1, 2023. FISCAL IMPACT The projected fiscal impact of increasing the minimum wage by $0.50 is approximately $23,000 based on current and anticipated staffing levels and programming for the year, including work performed during holidays. This is based on one Preschool Director, three Preschool Teachers, three Preschool Aides, two Camp Assistant Directors, 16 Camp Counselors, 10 Recreation Leaders, four Parks and Facilities Attendants, two Records Clerks, and one Clerical Aide. All five steps in each salary range are adjusted accordingly based on the minimum wage increase and accounted for in the overall fiscal impact. This increase in costs will largely be offset by increases in certain user fees for city services in Fiscal Years (FY) 2022/23 and 2023/24. Current Departmental staff vacancies and associated savings of nearly $25,000 will also cushion any impacts associated with this minimum wage increase in FY 2022/23. This includes vacancies Item: 10.D. 46 Honorable City Council 11/16/2022 Regular Meeting Page 2 for Parks and Facilities Attendants resulting in approximately $7,000 in savings, Recreation Leader resulting in approximately $3,000 in savings, and Parks and Facilities Supervisor resulting in approximately $14,500 in savings. Due to these offsetting measures, a budget amendment is not required. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. Attachment: Draft Salary Plan Resolution No. 2022-____ for Hourly Employees 47 RESOLUTION NO. 2022-____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ADOPTING THE SALARY PLAN FOR HOURLY EMPLOYEES, AND RESCINDING RESOLUTION NO. 2022-4082 TO INCREASE THE MINIMUM WAGE WHEREAS, the City Council at its regular meeting on November 16, 2022, considered and adopted an amended Salary Plan Resolution for Hourly Employees with a revised salary table for calendar year 2023 to increase the minimum wage. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The corresponding salaries for the ranges established in Section 1 of this resolution are attached hereto and incorporated herein as the “Hourly Employees Salary Schedules” Table. ATTACHMENT 48 Resolution No. 2022-____ Page 2 SECTION 3. Salary ranges from 1 to 12 are based on ranges with increases from $0.50 to $2.00 and step increases of two and one-half percent (2.5%) with a total of five (5) steps. The salary ranges from 13 to 16 are based on ranges with increases of $25.00 and $5.00 step increases with a total of five (5) steps. SECTION 4. Overtime: When in the best interest of the City, the City Manager or a department head or his/her designee may require an employee to work more hours than are typically scheduled. Overtime that can be anticipated or scheduled shall require the prior approval of the department head based on budget limits. No more than ten (10) hours of overtime may be worked in any one work week without prior written approval of the City Manager. Credit for overtime shall not begin until an employee has worked forty (40) hours for that work week. All overtime shall be computed in increments of one quarter (1/4) hour and shall be credited at one and one-half (1 ½) times the overtime worked. Calculation of overtime pay shall be based on an employee’s regular pay rate. Compensation for authorized overtime shall be included in the paycheck for the pay period. SECTION 5. Implementation of salary adjustments for positions noted in Section 1, herein, shall be limited by the performance evaluation system established by the City Manager. Employees shall be evaluated prior to their anniversary date, and approved salary adjustments shall be effective as of the first day of the pay period in which the anniversary date or revised anniversary date occurs. SECTION 6. This Salary Plan shall become effective with the first full pay period commencing on or after January 1, 2023. SECTION 7. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
