MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Jessica Sandifer, Community Services Manager DATE: 11/16/2022 Regular Meeting SUBJECT: Consider Resolution Authorizing Submittal of Building Forward Library Infrastructure Grant Application and Other Grant Related Actions BACKGROUND City staff have been working on the design and construction of the new Moorpark City Library for several years. Currently, the architect is working on design development drawings for the library. It is anticipated that the project will go for Planning Commission and City Council approval in Spring of 2023 and be under construction in Fall of 2023. In February 2022, staff was made aware of an upcoming grant opportunity for the Library Project. The California State Budget Act of 2021 (SB 129) allocated $439 million in one- time funds to the California State Library to address life-safety and critical maintenance needs of public library facilities throughout California, prioritized for high poverty areas of the state. The Building Forward Grant Program is the single largest investment in California’s public libraries in over 20 years. DISCUSSION The Building Forward Grant Program was intended as a grant program for libraries with significant infrastructure repair needs, and generally is not intended for new Libraries. However, there was a carve out in the grant program that allowed for expenditure of grant funds on new library buildings, so long as the applicant could show that it was more cost effective to build a new building, rather than renovate the existing facility. Staff worked with the Library Architect on evaluating the costs to renovate the existing facility versus building the same square footage brand new. Due to the fact that the library had been remodeled over the years under three different building codes, and the recently discovered liquefaction issues on the library property, staff was able to show that the cost to build the equivalent square footage brand new was less expensive than renovating the existing building. 69 Honorable City Council 11/16/2022 Regular Meeting Page 2 In March 2022, staff applied for the Building Forward Library Grant. The grant application only applied for the amount of funding that would be required to build a new library of the same square footage. The Building Forward Grant does not authorize the expenditure of grant funding on the expanded square footage of the library. The grant also has a 50% matching requirement. In consideration of these parameters, staff applied for a grant in the amount of $4.6 million, with a local funds match of $4.6 million (total project cost of $9.2 million to replace the 7,700 square foot size of the current facility). In September 2022, staff was notified that we had been awarded the grant funding. At the time of grant application, an authorizing resolution was not required by the grant application. The application indicated that a resolution could be adopted once a grant award was made. At this point, it is appropriate to adopt the authorizing resolution, which states that the grant application is authorized, accept the grant award, and designate the City Manager as the authorized signatory for all grant related paperwork. Once all the grant award paperwork is received the California State Library will send the City half of the grant amount, or $2.3 million. Staff will return with a future budget amendment to set up the grant revenue and expenditure accounts once all grant award materials are submitted and approved by the California State Library. FISCAL IMPACT There is no fiscal impact from this action, however, the acceptance of this $4.6 million grant will commit the City to future match of $4.6 million., These funds which will go toward construction of the new library will be formally considered by Council in a future action item. COUNCIL GOAL COMPLIANCE This action is consistent with City Council Strategy 3, Objective 3.11 “Complete construction plans for the City’s new Library.” STAFF RECOMMENDATION (ROLL CALL VOTE REQUIRED) Adopt Resolution No. 2022-____ authorizing submittal of the Building Forward Library Infrastructure Grant and authorize the City Manager to sign all grant related paperwork. Attachment: Draft Resolution No. 2022-____ 70 RESOLUTION NO. 2022-____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AUTHORIZING THE GRANT APPLICATION, ACCEPTANCE, AND EXECUTION OF THE GRANT FUNDS FROM THE STATE OF CALIFORNIA BUDGET ACT OF 2021 (SB 129) ALSO KNOWN AS THE BUILDING FORWARD, LIBRARY INFRASTRUCTURE GRANT WHEREAS, the Legislature and Governor of the State of California have provided funds for the program shown above; and WHEREAS, the California State Library has been delegated the responsibility for the administration of this grant program, establishing necessary procedures; and WHEREAS, said procedures established by the California State Library require a resolution certifying the approval by the potential grantee’s governing board either before submission of said application(s) to the State or prior to execution of the grant agreement; and WHEREAS, the City of Moorpark will enter into an agreement with the State of California to carry out the project; and WHEREAS, the Building Forward, Library Infrastructure Grant requires matching fund contribution. WHEREAS, the City of Moorpark intends to implement the New Library Project; and WHEREAS, the City of Moorpark has the legal authority and is authorized to enter into a funding agreement with the State of California; and WHEREAS, the City of Moorpark applied for grant funding from the California State Library for the New Library Project in March 2022; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That pursuant and subject to all of the terms and provisions of the California Budget Act of 2021, the application for funding with the California State Library that was submitted in March 2022 by the City of Moorpark City Manager, or designee, is hereby authorized and the City Manager was authorized to take such other actions necessary or appropriate to obtain grant funding. SECTION 2. The City of Moorpark City Manager, or designee, is hereby authorized and directed to execute the funding agreement with the California State Library and any amendments thereto. The City of Moorpark City Manager, or designee is hereby authorized and directed to submit any required documents, funding requests, and reports required to obtain grant funding. SECTION 4. That the Library project will comply with any laws and regulations including, but not limited to, the California Environmental Quality Act (CEQA), legal requirements for building codes, health and safety codes, the California Labor Code, disabled access laws, and that prior to commencement of the project, all applicable permits and environmental approvals will have been obtained. SECTION 5. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
