HARE Chief of Police City Treasurer MEMORANDUM TO: The Honorable City Council 141; FROM Susan Cauldwell , Administrative Assistan < DATE: June 15, 1989 SUBJECT: AD-85-1 (Public Hearing) The Parks Maintenance Assessment District (AD-85-1) was formed in June 1985. Assessments in this district have not been levied since FY86--87. In accordance with Resolution 89-534, an Engineer' s Report for this district has been prepared. Two actions are needed if the Council decides to fund the Parks Maintenance Assessment District. At its meeting on June 7, the City Council approved the Engineer' s Report (copy enclosed). The report describes the parks to be maintained in AD--85- 1 as well as the method of assessment. The maintenance to be provided by this district includes the City' s six parks and the Community Center. The proposed annual assessment for a single family level 1 home is $30.22. The total projected budget for this district is $263,911. Additional detailed budget information is enclosed. The purpose of the public hearing is to hear objections to the proposed work or extent of the assessment district. This report is an update of an existing City-wide Assessment District. The purpose for the district is to provide operating funds for the continued maintenance and improvement of existing and planned City operated public parks. SECTION 2 DESCRIPTION OF THE IMPROVEMENTS TO BE MAINTAINED The following City Parks are to maintained under this District effective July 1, 1989: CAMPUS PARK PAUL GRIFFIN SR. PARK COMMUNITY CENTER MONTE VISTA NATURE PARK GLENNWOOD PARK PEACH HILL PARK NORTH VILLAGE PARK In addition, the City also owns additional unimproved acreage for park purposes designated on the attached boundary map as locations 2 and 6. Only minimal cost for weed control, if any, is anticipated for these two locations in fiscal year 1989-1990. The maintenance and improvement of all the above mentioned parks shall include but not be limited to the following: 1. Mowing and edging of all turf areas. 2. Litter pickup. 1 3 . Weeding as required with an emphasis on a monthly timetable. 4. Irrigation as required. 5. Fertilizing of all vegetation as each species requires. 6. Pruning so as to not inhibit the natural growth characteristics of the plant. 7. Cleaning existing facilities to be clean and free of all debris. Minor repairs shall as needed. 8. Vector control at the first indication of existence. 9. Maintaining lights, playground equipment, playcourts and public restrooms. 10. Installing park or recreational improvements, including but not limited to drainage, sidewalks, land preparation and the maintenance and servicing of said improvements. SECTION 3 ASSESSMENT ROLL All parcels of real property affected are listed on the "Assessment Roll" , Exhibit A, which will be on file in City Hall with the City Clerk, and is made a part hereof by reference. These parcels are more particularly described in maps prepared in accordance with Section 327 of the Revenue arid Taxation Code which are on file in the office of the Ventura County Assessor in the County Government Center Administration Building, 800 S. Victoria Avenue, Ventura, California and which are also made a part hereof by reference. SECTION 4 ESTIMATE OF COST The estimated costs of operating the proposed District are shown in Appendix "B" of this Report. SECTION 5 METHOD OF ASSESSMENT The Landscaping and Lighting Act of 1972, in Section 22573 , states that "The net amount to be assessed upon the lands within an assessment district may be apportioned by any formula or method which fairly distributes the new amount among all assessable lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the improvements. " 2 The method and formula of benefit spread recognizes that every property within the City of Moorpark benefits from public parks and recreation facilities. The method of spreading maintenance costs is based upon the "people use" attributed to each land use within the City. This method was chosen because the benefit received by having park facilities is directly proportionate to the number of people generated by each land use. Recognizing that residential land uses within the City derive a higher degree of benefit than non-residential land uses, the formula was subdivided into two main groups, with residential land uses contributing in 75% of the assessment and non-residential uses being assessed for the remaining 25% of the maintenance costs. The benefits to residential land uses are clear. The residents of the City utilize the parks during their leisure hours. The non- residential property benefits include such items as offering employees the opportunity to utilize the parks during lunch time and after hours, as well as providing an aesthetic environment which attracts potential employees into the area. The "people use" factors utilized in the assessment district spread formula are shown in Appendix "A". In conclusion, it is our opinion that the assessments within Parks Maintenance Assessment District No. AD-85-1 are apportioned by a formula that fairly distributes the net cost to each lot or parcel in accordance with the benefits that are received. AD-85-1" FOR THE FISCAL YEAR COMMENCING JULY 1, 1989 AND ENDING JUNE 30, 1990 PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972; AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO. HARE Chief of Police City Treasurer MEMORANDUM TO: The Honorable City Council FROM: Steven Kueny, City Manager �C DATE: February 10, 1989 SUBJECT: Resolution Initiating Proceedings for the Annual Assessments for the "Parks Maintenance Assessment District No. AD-85-1"- and Ordering Preparation of the Engineer' s Report As the City Council is aware, no assessments were levied in 1987-88 or 1988-89 for AD 85-1. The Council authorized the use of general funds for both of these fiscal years and the return of excess proceeds of taxes from 1985-86 for a portion of the costs for 1987-88. Even though the projections from the financial analysis calculated as part of the appropriation limit review show that park expenditures can be funded by projected general fund revenues in 1989-90, it is recommended that the proceeding be initiated for AD 85-1 for the following reasons: 1. The referenced Appropriation Limit Report made certain expenditure projections for parks and other services that may not reflect service levels ultimately decided upon by the Council . In addition, the estimated budget reserves provide little flexibility. 2. Any decision at this time would predetermine the funding source for parks maintenance prior to the annual budget review. 3. The City Attorney has indicated that to return any proceeds of taxes to the citizens by reducing or eliminating park maintenance assessments, such action must be based upon an Engineer' s Report prepared pursuant to State Law. The purpose of the Engineer' s Report and annual proceedings are explained in the companion staff report prepared for AD 84-2. If the Council concurs with the staff recommendation to proceed with initiation of the proceedings and preparation of the Engineer' s Report, an expenditure of an estimated $4,500 is needed. The cost to prepare the Engineer' s Report for (an The Honorable City Council February 10, 1989 Page 2 1988-89 was $3,500 since the Council decided not to levy assessments. The adopted 1988-89 Budget includes $3,500 for preparation of the 1989-90 Engineer' s Report. Projected expenditure savings in other line item accounts would permit the City to expend funds needed to prepare the report. If the Council determines to levy assessments for AD 85-1 for 1989-90, the additional cost would increase to about $5,200. STAFF RECOMMENDATION: 1. Adopt Resolution No. 89- Initiating Proceedings for AD 85-1 and Ordering Preparation of Engineer' s Report. 2. Authorize the City Manager to secure the services of a qualified engineer to prepare the Engineer' s Report for the Parks Maintenance Assessment District (AD 85-1) at a cost not to exceed $4,500. Any cost above $4,500 will require prior approval of the City Council .
