HomeMy WebLinkAboutAGENDA REPORT 1985 0518 CC SPC ITEM 53C -3-- RESOLUTION NO . 85- 41201) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE ANNUAL ASSESSMENTS FOR THE "MOORPARK LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. AD-83-1" FOR THE FISCAL YEAR COMMENCING JULY 1 , 1985, AND ENDING JUNE 30 , 1986 , PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972; AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO. WHEREAS, the City Council, by Resolution No. 85- proposed to extend the improvement specified in "Moorpark Landscape Maintenance Assessment District No. AD-83-1 for the fiscal year commencing July 1, 1985 , and ending June 30 , 1986, pursuant to the provisions of the Landscaping and Lighting Act of 1972 (Part 2 , Division 15 of the California Streets and Highways Code) ; and WHEREAS, by said Resolution No. 85- , the City Council ordered the City Manager to cause to be prepared an Engineer' s Report pursuant to Article 4, Chapter 1, Part 2 , Division 15 of the said Streets and Highways Code; and WHEREAS, the Engineer' s Report was prepared and filed, and the same was approved by the Council on the day of May, 1985 , by Resolution No. 85- NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require and it is the intention of the City Council of the City of Moorpark to order the extension of the annual assessments for the "Moorpark Landscape Maintenance Assessment District No. AD-83-1" for the fiscal year commencing July 1, 1985 , and ending June 30 , 1986, to provide for the continued maintenance, operation and servicing of the Improvement Areas, and all improvements thereto and incidental expenses in connection therewith. SECTION 2. That the foregoing described work is to be located within said Assessment District, the boundary of which is more particularly described on a map on file in the City Clerk' s office and is entitled, "Diagram of Moorpark Landscape Maintenance Assessment District No. AD-83-1, " filed in the office of the City Clerk on the day of May, 1985. SECTION 3. That the contemplated continued operation, servicing and maintenance of the Improvement Areas as described by the District, and other improvements as specified in said Landscaping and Lighting Act of 1972, in the opinion of said City Council, are -1- of benefit to, and the said City Council hereby makes the expense of the said continued operation, servicing and maintenance, and other such improvements, chargeable upon the district. SECTION 4 . Reference is hereby made to the report of the Engineer on file with the City Clerk and open to inspection, for a full and detailed description of the improvements, the boundaries of the Assessment District and any zones therein, and the proposed assessments upon assessable lots and parcels of land within the District. SECTION 5. Notice is hereby given that on the 3rd day of June, 1985, at the hour of 7 : 00 P.M. , in the Council Chambers in the City Hall of said City, located at 799 Moorpark Avenue, Moorpark, any and all persons having any objections to the work or extent of the assessment district may appear and show cause why said work should not be done or carried out or why said district should not be extended for the fiscal year commencing July 1 , 1985 , and ending June 30, 1986, in accordance with this Resolution of Intention. Protests must be in writing and must be filed with the City Clerk prior to the conclusion of the hearing. Any such protest shall state all grounds of the objection, and if filed by a property owner shall contain a description sufficient to identify the property. SECTION 6. All the work herein proposed shall be done in accordance with the Landscaping and Lighting Act of 1972 , being Part 2 of Division 15 of the Streets and Highways Code of the State of California. SECTION 7 . The City Clerk shall cause notice of the hearing to be given by causing the Resolution of Intention to be published in the manner required by Part 2 of Division 15 of the Streets and Highways Code.
