Carrillo, Associate Planner II City of Moorpark 799 Moorpark Avenue Moorpark, CA 93021 fcarrillo@moorparkca.gov Re: Notice of Intent to File Suit Under the California Environmental Quality Act Regarding the Pentair Warehouse Expansion Project (SCH No. 2022070289) Dear Mayor Parvin, Clerk Spangler, Mr. Ennis, Mr. Wolens, Ms. Saxton, Ms. Farley, and Mr. Carrillo: Please take notice, pursuant to Public Resources Code (“PRC”) § 21167.5, that Supporters Alliance for Environmental Responsibility (“SAFER”) intends to file a Verified Petition for Peremptory Writ of Mandate and Complaint for Declaratory and Injunctive Relief (“Petition”) in Ventura County Superior Court under the provisions of the California Environmental Quality Act (“CEQA”), Public Resources Code § 21000 et seq., against the City Item: 6A Notice of Intent to File CEQA Suit Pentair Warehouse Expansion Project (SCH No. 2022070289) November 23, 2022 Page 2 of 4 of Moorpark, the City Council of the City of Moorpark, and the City of Moorpark Community Development Department (collectively “City”) and against Real Parties in Interest Keenan Wolens, Moorpark Lot A, LP, and Amir Development Co., challenging the November 3, 2022 decision of the City to (1) approve Industrial Planned Development No. 2022-01 and Conditional Use Permit No. 2022-01 for the development of a 90,566 square foot industrial warehouse building located at 10941 Los Angeles Avenue (Assessor’s Parcel Number 511-0-200-265) (“Project”); and (2) adopt the Mitigated Negative Declaration (SCH No. 2022070289) and Mitigation Reporting and Monitoring Plan for the Project. The Petition will argue that an environmental impact report (“EIR”) was required for the Project because there is a fair argument that the Project may have significant unmitigated adverse environmental impacts.
