GENOVESE Chief of Police City Treasurer MEMORANDUM TO: The Honorable City Council FROM: Steven Kueny, City Manager DATE: February 26, 1988 SUBJECT: RESOLUTION FOR INITIATING PROCEEDINGS AND PREPARATION OF ENGINEER'S REPORT FOR ANNUAL ASSESSMENTS FOR THE PARKS MAINTENANCE DISTRICT (AD 85-11 As the City Council is aware, you determined that no assessments would be levied in 1987-88 for AD 85-1. The Council authorized the use of general funds. More specifically, the Council authorized the return of excess proceeds of taxes from 1985-86 if such were determined to exist. As we now know such was the case. As part of the recent review of the City' s appropriation limit, City staff projected revenues, expenditures, and the excess of proceeds of taxes through the 1991-92 fiscal year. For 1988-89 the following projections were developed. 1. Park expenditures $ 283,313 2. Total expenditures $2,412,087 3. Total General Fund revenue $2,445,478 within current Gann limit 4. Difference of lines 2 and 3 $ 33,391 5. Excess proceeds of taxes $ 223, 183 Even though the projections show that park expenditures can be funded by projected general fund revenues in 1988-89, it is recommended that the proceeding be initiated for AD 85-1 for the following reasons: 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 The Honorable City Council February 26, 1988 Page 2 1. The referenced Appropriation Limit Report made certain expenditure projections for parks and other services that may not reflect service levels ultimately decided upon by the Council . In addition, as estimated budget reserve of only $33,391 provides little flexibility. 2. Any decision at this time would predetermine the funding source for parks prior to the annual budget review. 3. The City Attorney has indicated that to return any proceeds of taxes to the citizens by reducing or eliminating park maintenance assessments, such action must be based upon an Engineer' s Report prepared pursuant to State law. In the event the proposed increase in the Appropriations Limit is rejected by the voters, the Council may want the option of using AD 85-1 to either return a portion of the excess proceeds of taxes or to allow general fund monies within the limit to be used for other than park expenditures. In addition, it would appear that there may be some excess proceeds of taxes remaining from 1985-86 that will need to be returned depending upon final 1987-88 park expenditures and final calculation of the actual amount of 1985-86 excess proceeds by the City' s auditors. The purpose of the Engineer' s Report and annual proceedings are explained in the companion staff report prepared for AD 84-2. If the Council concurs with the staff recommendation to proceed with initiation of the proceedings and preparation of the Engineer' s Report, an expenditure of an estimated $3,463 is needed. A copy of the Engineer' s proposal to prepare the report is attached. Task F in the Scope of Services in the estimated amount of $1,262 would not be needed if the Council does not actually make assessments in 1988-89. RECOMMENDED ACTION: 1. Adopt Resolution No. 88-9CSI Initiating Proceedings for AD 85-1 and Ordering Preparation of Engineer' s Report. 2. Authorize the City Engineer to prepare the Engineer' s Report for the Parks Maintenance Assessment District (AD 85-1) at a cost not to exceed $3,500. Any cost above $3,500 will require prior approval of the City Council . City Engineer will meet with the City to accomplish the following: 1 . Meet with the City and establish guidelines for land uses, i.e. , mixed uses (residential and commercial) . 2 . Utilizing last year' s formuid, make dppivpiiat� adjustments to unit values to the satisfaction of the Engineer for land uses. 3 . Identify any new special zones within the City and their accompanying values. 4 . Set dates for the hearings. II . City Engineer will provide the following: It should be noted that the service offered takes into consideration some efficiencies of work effort in Districts 85-1 and 84-2 . Our quote reflects these efficiencies as a single event and is divided equally between the 2 districts. The Scope of Services will include an initial spread to be used by the City and City Engineer as a working copy to establish the preliminary spread and Engineer' s Report to be submitted to the City Council for the first hearing. The services do not include revision to the method of spread except for refinements to the formula as stated in I .2 or New Special Zones . a. Obtain the computer tape of the latest equalized Assessor' s Roll . b. Modify, as appropriate, the boundary map to reflect existing land uses. Field verification will be limited to two man-days unless additional appropriations are authorized by the City. c. One copy of preliminary spread. d. Ten copies of preliminary Engineer' s Report. -1- e. Insertion of addresses and notices into envelopes, including additional items provided by City per #7 on Page 2 . One envelope per assessor parcel number for both assessment districts will be used. f . Deliver to City inserted envelopes. g. One copy of final spread. h. Ten copies of final Engineer ' s Report i. One copy of final spread to the County Assessor. j . Provide a magnetic tape of final spread to the County Assessor. k. The City Engineer will participate in all pubiiL hearings. III . The City will provide the following: 1 . City will provide budget data for 88-89 fiscal year with a breakdown of complete budget for each special zone as appropriate. * 2 . Printout from County with fallouts of latest equalized Assessor' s Roll . * 3 . Assessor maps, with special zones identified, from the latest equalized Assessor ' s Roll . 4 . A current street lighting and landscape inventory map of the City including a list of any revisions from the 1987/88 inventory map (provided by Edison) . 5 . A list of any additional or revised multiple- family dwellings by street address or Assessor' s Parcel Number indicating the number of dwelling units per parcel . 6 . Window envelopes, with City return address. City Engineer will deliver to the City inserted envelopes, (one for each assessor parcel for both assessment districts) . 7 . Notices, Resolutions and Cover letters - for inclusion in envelopes. * At City' s option, these items can be secured by City Engineer at direct cost of said items. -2- IV.
